Introduce Ordinance No. ~~71 and set the matter for public hearing to adopt San Diego County Animal Control Regulations by reference at your meeting of September 23, 1986.
ITEM EXPLANATION
The City of Carlsbad adopts by reference the San Diego County Code of
Regulatory Ordinances for animal control. Enforcement is
accomplished by the County under contract with the City. San Diego
County has completed the adoption of extensive revisions to their
animal control regulations. It is now necessary for the Council to determine whether or not to adopt the revised regulations as a part
of the Carlsbad Municipal Code. The County of San Diego and the
responsible departments recommend that we adopt the new code. If the
Council concurs your action is to introduce Ordinance No. aby
reading the title and then, by motion, set the matter for public
hearing at your meeting of September 23, 1986. Copies of the code will be available in the office of the City Clerk. The ordinance
will make conforming changes in other sections of the Code to make
our penalty provisions track those of the County. The regulations
contain a number of significant measures including Section 62.674
regarding the regulation of vicious dogs and sections 62.700 and
62.701 regarding the transportation of animals in motor vehicles and the leaving of animals in unattended vehicles. A copy of the letter from the County asking us to adopt these measures and Sections 62.700 and 62.701 are attached.

Dear Captain Vales:
Attached is a copy of the ordinance you requested regarding dogs in
the back of open-bed vehicles. I’m also enclosing a copy of our revised Chapter 6 (Animal Control regulations) that was approved
by the Board of Supervisors on August 5, 1986.
Both of these new sets of laws are scheduled to be adopted by the
Board today and should become effective September 11, 1986. We
have expended numerous hours in developing what we believe may
be the finest set of animal regulations in the nation.
We are hopeful that the City of Carlsbad will adopt these laws
by reference to be effective on September 11, 1986. If you have
any questions regarding the changes, please contact John Humphrey
of our North County Shelter in Carlsbad at 438-3359.

COUNTY CODE OF REGULATORY ORDINANCES RELATING TO THE AND TRANSPORTATION OF ANIMALS IN MOTOR VEHICLES THE LEAVING OF ANIMALS IN UNATTENDED VEHICLES
The Board of Supervisors of the County of San Diego
ordains as follows:
Section $J Chapter 7 is hereby added to Division 2
of Title 6 of the San Diego County Code of Regulatory
Ordinances to read as follows:
'CHAPTER 7
ANIMALS IN VEHICLES
Sec. 62.700. TRANSPORTATION OF ANIMALS. No person
shall transport or carry, on any public highway or public
roadway, any animal in a motor vehicle unless the animal
is safely enclosed within the vehicle or protected by a
cab or container, secured cage , cross-tethe,r,-harness or other
device that will prevent the animal from falling from,
being thrown from, or jumping from, the motor vehicle.
Sec. 62.701. ANIMALS IN UNATTENDED VEHICLES. No
person shall leave an animal in any unattended vehicle
without adequate ventilation or in such a manner as to
subject the animal to extreme temperatures which adversely
affect the animal's health or welfare.

Section 2 . This ordinance shall take effect and-be-in force thirty (30) daya after the date of its paasage, and before the expiration of fifteen (15) days after its passage, it shall be published once with the names of the members voting for and against the siime in the San Diego Daily Transcript a newspaper of general circulation published in the County of San Diego.
