Introduce Ordinance No. 6072 amending certain provisions of
the Code which are inconsistent with the recently adopted county animal control regulations.
ITEM EXPLANATION
At your meeting of September 23, 1986 the City Council adopted
Ordinance No. 5071 which adopted the County Code of Regulatory
Ordinances for animal control as part of the Carlsbad Municipal
Code. This adoption necessitates the repeal of old Section
7.08.030 of the Carlsbad Municipal Code relating to vicious
dogs. This matter is dealt with in the recently adopted
County Code of Regulatory Ordinances. Previously, the
county required a wild animal permit. However, because the
county wild animal permit duplicated the provisions of state law, which also required a permit, the recent amendments to the County Code of Regulatory Ordinances deleted the requirement for a county permit. The revision to the Carlsbad
Municipal Code relating to wild animals will require a valid
state permit rather than a county permit.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLEBAD, CALIFORNIA AMENDING TITLE 7, CHAPTER 7.08 OF-THE CARLSBAD MUNICIPAL CODE BY THE
DELETION OF ,SECTION 7.08.030 AND BY THE AMENDMENT
OF TITLE 21, CHAPTERS 21.42 AND 21.53 SECTIONS
21.42.010(K) AND 21.53.085 OF THE CARLEBAD MUNICIPAL CODE TO DELETE THE REQUIREMENT FOR A COUNTY WILD ANIMAL PERMIT.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 7, Chapter 7.08 of the Carlsbad
Municipal Code is amended by the repeal of Section 7.08.030.
SECTION 2: That Title 21, Chapter 21.42 of the
Carlsbad Municipal Code is amended by the amendment of Section
21.42.010(K) to read as follows:
"(EC,) Private zoos: provided the property for such
private zoo has a minimum of 20,000 feet, no animal is kept within 20 feet of any property line, and a valid wild-animal permit has been issued by the State of California."
SECTION 3: That Title 21, Chapter 21.53 of the
Carlsbad Municipal Code is amended by the amendment of Secton
21.53.085 to read as follows:
"21.53.085 Wild animals. A wild animal may be kept in
any zone provided that a wild animal permit has been issued for
it by the State of California and provided the keeping of such wild animal does not constitute the establishment or maintenance
. . .
of a private zoo. Private zoos may be established or maintained
only as provided in Section 21.42.010(K) of this Code." - --
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published
at least once in the Carlsbad Journal within fifteen days after
its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the day of er 7th
1986, and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 14th day of October ,' 1986 by
the following vote, to wit:
