TITLE:APPEAL OF PLANNING COMMISSION DENIAL
OF A CONDITIONAL USE PERMIT FOR A
BOYS AND GIRLS CLUB FACILITY
CUP-296 - BOYS AND GIRLS CLUB CITY MGR.<^^
RECOMMENDED ACTION:
The Planning Commission and staff are recommending that the City Council direct
the City Attorney's Office to prepare documents upholding the Commission
decision to DENY CUP-296.
ITEM EXPLANATION
The applicant is appealing a Planning Commission decision to deny a proposed
conditional use permit to establish a Boys and Girls Club on 1 .5 acres located
on the east side of El Camino Real approximately 1 ,000 feet south of Camino Vida
Roble. The proposed facility for approximately 30 children would include a
large grassy play field, a 900 square foot playground equipment area, and a
portable building providing 1 ,440 square feet of indoor activity and
administrative office space. The facility is requested as a temporary facility
(approximately two years) until a permanent facility can be constructed at
another location.
The Planning Commission felt that the Boys and Girls Club provides an extremely
important function in the community and expressed regret in not approving the
project. The major concern of the Planning Commission was that the site is
unsafe and approval at this location could place children in a dangerous
situation. They felt that children would be walking along and crossing El
Camino Real to get to the club at a point where there is no signal light and
many autos travel in excess of 50 mph. The applicant felt these concerns can be
mitigated by requiring children to be driven to the site. In addition, the
Commission was concerned about auto traffic to the site in that southbound
vehicles on El Camino Real would have to make a U-turn on El Camino Real to get
into the site.
The Planning Commission is recommending denial of this project. For further
information please see the attached report to the Planning Commission.
ENVIRONMENTAL REVIEW
The Planning Director determined this project was categorically exempt from
environmental review pursuant to Chapter 26, Section 21.080(b)(5) of the
California Environmental Quality Act.
FISCAL IMPACT
This project is exempt from payment of the Public Facility Fee and was exempted
from Chapter 21.90 (Growth Management) of the Carlsbad Municipal Code and
related fees. Excluding the loss of fees, no direct fiscal impact is
anticipated.

The proposed temporary location of the Boys & Girls Club
is unsuitable due to its location on a partially improved
section of El Camino Real, a prime arterial.
The location of the site could cause motorists to attempt
to make illegal u-turns on El Camino Real to facilitate
dropping off and picking up children.
The Boys & Girls Club has no way to prevent children from
walking or riding their bikes along El Camino Real to
access the site.
The site is adjacent to a flight activity zone of Palomar
Airport.

SUBJECT: CUP-296 - BOYS & GIRLS CLUB OF CARLSBAD - Request for
the construction of a Boys & Girls Club for thirty
children. The site proposed is approximately 1.5 acres
in size, adjacent to and east of El Camino Real,
approximately 1,000 feet south of the intersection of El
Camino Real and Camino Vida Roble.
I. RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 2601 DENYING
CUP-296 based on the findings contained therein.
II . PROJECT DESCRIPTION
The applicant proposes developing on previously undisturbed land
a 20,000 square foot grassed play field, a 900 square foot play
equipment area, and 1,440 square feet of administration and
classroom space within a portable structure. Twenty-seven
standard parking spaces are provided within a decomposed granite
parking lot. Access to the site is from El Camino Real. Three
employees and thirty or less children are anticipated to use the
site at any given time. The use will operate from 2:00 p.m.,
through 6:00 p.m., when schools are in session; 8:00 a.m.,
through 2:00 p.m., when schools are not in session; and,
occassionally for one hour sessions during weekday afternoons,
Sunday mornings, and special events on evenings and Saturdays.
III. ANALYSIS
Planning Issues
1) Can the four findings required for approval of a conditional
use permit be made, specifically:
a) That the requested use is necessary or desirable for the
development of the community, is essentially in harmony
with the various elements and objectives of the General
Plan, and is not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed
use is to be located;
b) That the site for the intended use is adequate in size
and shape to accomodate the use;

c) That all of the yards, setbacks, walls, fences,
landscaping, and other features necessary to adjust the
requested use to existing or permitted future uses in the
neighborhood will be provided and maintained;
d) That the street system serving the proposed use is
adequate to properly handle all traffic generated by the
proposed use;
2} Are both the proposed site and site plan sufficiently safe
given the intended land use?
DISCUSSION
This application proposes a temporary Boys & Girls Club along El
Camino Real. The applicant anticipates abandoning this proposed
temporary operation within two years to relocate to a permanent
site and facility near the future Carrillo Way. Although only
temporary, the proposed use provides a desirable service to the
community by allowing an opportunity for children to participate
in lower-cost, semi-supervised recreational activities on a
walk-in or drop-off basis.
In some ways, the Boys and Girls club functions as a lower cost
day care facility. However, to retain it's exempt status from
State day care regulations, the Boys and Girls clubs do not
provide as extensive a level of adult supervision and training
and cannot restrict the comings and goings of children to and
from the club. It is this aspect of the use along with the
proposed location which presents potential incompatability with
land use and public safety goals of the City.
There is concern that children coming to and leaving the site
will walk or bike along El Camino Real, which is the only
accessway to the site. El Camino Real has a design speed of
sixty miles per hour. The applicant has partially addressed this
issue by enclosing the site in a six foot high chain-link fence,
requiring children leaving the site to do so in an adult's
vehicle or in the Boys and Girls Club bus, and suggesting that
parents do not allow their children to walk or bike to the club.
However, the potential still exists to have children, by foot or
on bike, along this segment of partially improved El Camino
Real.
The Engineering Department has reviewed the site access and
believes the site's location and access point as potentially
unsafe. Of particular concern is the turning movements that
could be established into and out of the site. South bound
vehicles on El Camino Real would have to U-turn into the site.
Site distance at this U-turn point is limited by both horizontal
and vertical curves in El Camino Real further to the south.
Vehicles northbound on El Camino Real would have to decelerate
from El Camino Real, ease into a deceleration lane and make a
right angle turn within a distance of 130 feet. Vehicles exiting
the site would make a right angle turn and accelerate within the
90 feet of frontage to transition into the traffic flow of El
Camino Real.
Minor concerns also exist due to the site's pathway to both the
airport influence area and the flight activity zone of Palomar
Airport. The site .is just outside of the airport influence area
and less than 100 feet from the flight activity zone. A small
but potential aircraft crash hazard exists on the site.
Sensitive land uses such as schools and large assemblages of
people are discouraged around the flight activity zone according
to Palomar Airport's Comprehensive Land Use Plan (CLUP).
The applicant has made significant efforts, short of site
relocation, to make the use and site safe. However, even with
these modifications, the site is still severely constrained by
it's location on El Camino Real and proximity to Palomar Airport
and, as such presents a potentially unsafe location for the
proposed use. For this reason staff recommends denial of the
application.
IV. ENVIRONMENTAL REVIEW:
The Planning Director has determined the project at present is
statutorially exempt from environmental review pursuant to
Chapter 2.6, Section 21080 (b) (5) of the California
Environmental Quality Act.

an application for the construction of a Boys and Girls Club for thirty children on
approximately 1.5 acres on property generally located adjacent and east of El Camino
Real, approximately 1,000 feet south of the intersection of. El Camino Real and Camino Vida
Roble, and more particularly described as:
Northwest portion of Parcel 3 as shown on Map filed at
Page 11118 in Book of Parcel Maps on December 20, 1972
in the County of San Diego, State of California.
