The Planning Commission approved the proposed general plan amendment, zone change and zone code amendment unanimously despite the submittal of a letter from the ATSrSF railroad objecting to the proposed designations.
staff disagreed with the railroad's contention that the TC, Transportation Corridor designation should only apply to a 55 foot wide strip centered on the existing railroad tracks. The Commission felt the entire strip was necessary to maintain the open space benefit of this corridor. For future information please see the attached report to the Planning Commission.

The Planning Director has determined that this project will not cause any significant environmental impacts and, therefore, has issued a Negative Declaration, dated July 16, 1986, which was recommended for approval by the Planning Commission on August 2; 1986. A copy of the environmental documents is on file in the
Planning Department.

Amendments to the General Plan and Zoning Ordinance to
create a land use designation and zone for the AT&SF
Railroad Right-of-way and the Interstate 5 Freeway.
I. RECOMMENDATION
That the Planning Commission APPROVE the Negative Declaration
issued by the Planning Director and ADOPT Resolution Nos. 2590,
2591 and 2602 recommending APPROVAL to the City Council of
GPA/LU 86-7/ZC-349 and ZCA-197, based on the findings contained
therein.
11. PROJECT DESCRIPTION AND BACKGROUND
The Atchison, Topeka & Santa Fe Railroad, its right-of-way, and
the 1-5 Freeway do not have a General Plan land use designation
Development proposals for projects located in the railroad righ
of-way legally cannot be processed because this property is
undesignated. This was discovered when the Carlsbad Inn tried
process a proposal for tennis courts to be located in the right
of-way in the downtown area. Council, at that time, directed
staff to analyze the railroad right-of-way and formulate a land
use designation for it.
The proposed land use designation and zone is Transportation
Corridor (TC). The intent of this designation is to preserve a
corridor for future public transportation, such as light-rail 0.
trolley lines. Permitted uses will be limited to those not
requiring permanent structures, and which generally will benefi'
the public. Uses could include light-rail transit facilities,
such as tracks, stations, overhead lines and maintenance
equipment; certain agricultural uses: open space: certain public
recreational facilities, such as bike paths, picnic areas, pass
parks, pedestrian trails, or tennis courts; and parking areas.
Any use other than passive open space, transit facilities and
agriculture would require approval of a conditional use permit.

Planning Issues

DISCUSSION
The proposed Transportation Corridor (TC) land use designation
zone change will establish the City's priorities for land uses
that shall occur in the railroad right-of-way. It is apparent
from future projections of traffic on 1-5 that it will be
necessary to provide other modes of transportation throughout S
Diego County as our population grows. The most recent SANDAG
study (19841, which prioritizes future light-rail systems (i.e.
similar to the San Diego/Tijuana system) in San Diego, predicts
that a system would go through Carlsbad within 15 years, using
existing railroad right-of-way. Numerous land uses occupying t
right-of-way could create additional problems or preclude the
possibility of a light-rail line between San Diego and Oceansid
Studies have not been conducted yet to determine which side of
the corridor, i.e. east or west, would be best suited for light
rail transit. The right-of-way may be wide enough to accommoda
both a rail system and other uses; however, each new use or
obstacle located in the right-of-way could make planning the
system more difficult and implementation more expensive. Thus,
the City has the responsibility to take steps now that will ass
future possibilities for transportation options. In addition,
connecting light-rail system along Highway 78 is also being
considered by a committee of North County agencies including
Carlsbad.
In addition to the City's desire to preserve the railroad corrj
for future light-rail, the right-of-way essentially provides UE
a 200-foot wide open space corridor which is the only real vist
break left in certain parts of the City, such as in downtown ar
the beach area. Presently, only a few uses are located in the
right-of-way south of Grand Avenue -- an old church, a small pz
and a City parking lot. Some storage and automotive type uses
appear to be located in the railroad right-of-way north of Grar
Avenue. With the creation of a land use designation and zone,
City can establish the types and intensities of development whj
can occur there.
Finally, the creation of the Transportation Corridor (TC)
designation and zone will not adversely impact surrounding
properties. When future transit programs are implemented,
appropriate environmental studies will be conducted. Conditio1
use permits will assure appropriate buffers i.e. fencing,
landscaping, lighting, for the uses that would be permitted
through the conditional use permit process.

For the reasons discussed above, the creation of a land use
designation and zone for the railroad right-of-way and 1-5 Free
is desirable from the City's standpoint. Creating the designat
and implementing the zone will not have adverse impacts to
properties along the right-of-way. Therefore, staff recommends
approval of GPA/LU 86-7/ZC-349 and ZCA-197.
The proposed General Plan Amendment and Zone Change to create t
T-C, Transportation Corridor and Zone Code Amendment to establi
the T-C, Transportation Corridor Zone will require an amendment
Carlsbad's Coastal Plan. If the City Council determines that t
Local Coastal Plan Amendment is warranted, it could establish t
State mandated six-week review period. During this period, all
interested parties including other agencies would have the
opportunity to comment on the merits of the proposed amendment.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not
have a significant effect on the environment and, therefore, ha
issued a Negative Declaration on July 16, 1986.

This is in regard to recent Notice of Public Hearing set for August 27, 1986,
before the Planning Commission to consider approval of amendments to the
General Plan and Zoning Ordinance to create a land use designation and zone
for the AT&SF Railway Company right of way as proposed under Case File
GPA/LU 86-7IZCA-197.
As a matter of record, we did not receive any notice of a hearing to consider
whether this proposal would have any significant effect on this environment
which would require preparation of an environmental impact report. Therefore
this is the first opportunity to state Santa Fe's position on this proposal.
Santa Fe strongly objects to this proposal in its present form, since it
includes property that is clearly outside the perimeters of what could
reasonably be considered a transportation corridor and is presently being use
for purposes which are only indirectly connected with transportation, if at
all.
We have no objection to the establishment of a transportation corridor,
per se, but request that it be confined to an area not to exceed 30' from the
centerline of the main track on the east side and 25' from the centerline of
the main track on the west side, for a total width of 55'. Our property
either side of this 55' wide transportation corridor should be given the same
zoning as the adjoining private property. of this property in a manner which would be beneficial to both the City and
Santa Fe and would not hinder the development of other compatible transit use
