ITEM EXPLANATION
The Registrar of Voters has canvassed the returns of the General Municipal
Election held on November 4, 1986. The certificate showing the results of that
canvass is attached as Exhibit "A".
The attached resolution declares the following results of the election:
Claude "Bud" Lewis was elected Mayor.
Mark V. Pettine was elected Member of the City Council.
Oohn 0. Mamaux was elected Member of the City Council.
Bill Esterline was elected City Treasurer.
Aletha "Lee" Rautenkranz was elected City Clerk.
Proposition E passed.
Proposition F failed.
Proposition G failed.
Proposition H failed.

RESOLUTION NO. 8884
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, RECITING THE FACT OF A GENERAL
MUNICIPAL ELECTION HELD IN SAID CITY ON THE 4th DAY
OF NOVEMBER, 1986, DECLARING THE RESULTS THEREOF
AND SUCH OTHER MATTERS AS ARE REQUIRED BY LAW.
WHEREAS, a General Municipal Election was held and conducted in the City of
Carlsbad, County of San Diego, State of California, on Tuesday, the 4th day of
November, 1986, as required by law; and
WHEREAS, pursuant to Resolution No. 8671, said election was consolidated
with the Statewide Election held on said date; and
WHEREAS, notice of said election was duly and regularly given in time, form
and matter as provided by law, that voting precincts were properly established,
that election officers were appointed, and that in all respects said election
was held and conducted and the votes cast thereat, received and canvassed and
the returns made and declared in time, form and manner as required by the
provisions of the Elections' Code of the State of California for the holding of
elections in cities; and
WHEREAS, City Council Resolution No. 8671, adopted on the 8th day of Ouly,
1986, authorized the Board of Supervisors of the County of San Diego to canvass
the returns of said election; and
WHEREAS, pursuant to the Election's Code said canvass has been completed by
the Registrar of Voters, who has conducted the canvass, and has provided a
certificate with the results of the canvass, said certificate is listed as
Exhibit "A", on file with the City Clerk.
NOW, THEREFORE, the City Council of the City of Carlsbad, California, does
resolve as follows:
1. That the above recitations are true and correct.

7. That the four measures voted upon at the election are as follows:
Proposition Et Shall an ordinance be adopted to provide as a part of
the 1986 growth management plan that 1) NO DEVELOPMENT SHALL BE
APPROVED by the City of Carlsbad unless it is guaranteed that
concurrent with need all necessary public facilities be provided as
required by said plan with emphasis on ensuring good traffic
circulation, schools, parks, libraries, open space and recreational
amenities; and 2) the City Council shall not approve residential
development which would increase the number of dwelling units beyond
the limit in said ordinance WITHOUT AN AFFIRMATIVE VOTE OF THE
CITIZENS. The City may add additional public facilities. The City
shall not reduce public facilities without a corresponding reduction ir
the residential dwelling limit.
Proposition Ft Bond Proposition: Shall the City of Carlsbad,
California, incur a bonded indebtedness in the principal amount of
$5,950,000 for the purpose of the acquisition by said City of a certain

municipal improvement, to wit: approximately 52.68 acres of
undeveloped land known as Hosp Grove to be acquired for park and open
space purposes, and for the payment of all costs and expenses in
connection with such acquisition and the issuance of the bonds?
Proposition G; Shall an initiative ordinance be adopted adding Chapter
21.64 to the Carlsbad Municipal Code which would RESTRICT THE RATE OF
CONSTRUCTION OF RESIDENTIAL DWELLING UNITS in the City for ten years
commencing January 1, 1987 to not more than 1,000 units in 1987, 750
units in 1988 and 500 units each year thereafter through 1996 with
exceptions for the replacement of damaged or destroyed units and for
low income or senior citizen projects. The City of Carlsbad shall
vigorously defend any challenge to the validity or constitutionality of
this ordinance inasmuch as this ordinance represents the desires of a
majority of the voters of Carlsbad.
Proposition H; Shall an initiative ordinance be adopted as follows:
"During the calendar years 1987 and 1988 the City of Carlsbad,
California shall (must) build in the Macario Canyon Park, all of the
following: 1) Five (5) baseball/softball fields, each with a minimum
distance from home plate to any outfield fence of three hundred feet,
and each field lighted for night use; 2) Four (4) rectangular
soccer/football fields, each with minimum measurements of two hundred
feet wide and three hundred fifty feet long, each field will be lightec
for night use; 3) One (1) community center, containing a gymnasium
large enough to house an official full sized basketball court, plus
spectator seating; 4) A tot lot, picnic area, and adequate public
facilities (restrooms, parking lots, bleachers, etc.) to service the
entire Ballfield and Sports Complex facility. We believe the estimatec
cost of this project to be approximately Three and One-Half Million
Dollars ($3,500,000.00) and feel that it is a good investment in our
City's future.
8. That the number of votes given at each precinct and the number of vote:
given in the City to each of the persons above named for the respective offices
for which the persons were candidates, and for and against the measures, were a:
listed in Exhibit "B", on file with the City Clerk, incorporated by reference
herein.
9. The City Council does declare and determine that:
(a) Claude "Bud" Lewis was elected as Mayor for the full term of four
years; and
(b) Mark V. Pettine was elected as member of the City Council for the
full term of four years; and
(c) John 3. Mamaux was elected as member of the City Council for the
full term of four years; and
(d) Aletha "Lee" Rautenkranz was elected as City Clerk for the full
term of four years; and
1 (e) Bill Esterline was elected as City Treasurer for the full term of
four years; and

(f) As a result of the election, two thirds of the voters voting on
3 Proposition F relating to the Hosp Grove Bond Issue did not vote
in favor of it, and that the proposition was not carried, and
4 shall not be deemed adopted and ratified; and
5 (g) As a result of the election, a majority of the voters voting on
Proposition H relating to development of ballfields in Macario
6 Canyon did not vote in favor of it, and that the Proposition was
not carried, and shall not be deemed adopted and ratified.

(h) As a result of the election, a majority of the qualified voters
8 voting on Propositions E and G did vote in favor thereof;
however, said measures as a matter of fact and by their own
9 express terms are in conflict and were presented to the voters in
the alternative. Therefore, in accordance with Section 4-016 of
10 the Elections Code, Proposition E (Ordinance No. tffflj^ attached
hereto as Exhibit "C") having received the highest number of
11 affirmative votes shall prevail, therefore, Proposition G is not
adopted and Proposition E was carried, and shall be deemed adopted
12 and ratified.
13 10. That the City Clerk shall make and deliver to each of the persons so
14 elected a Certificate of Election signed and duly authenticated; that the City
15 Clerk shall also administer to each person elected, the Oath of Office
16 prescribed in the State Constitution of the State of California and shall have
17 them subscribe thereto and file same in the City Clerk's Office whereupon each
18 and all of said persons so elected shall be inducted into the respective office
19 to which they have been elected.
20 11. That the City Clerk shall certify to the passage and adoption of this
21 resolution; shall enter the same in the file of Original Resolutions of said
22 City; and shall make a minute of the passage and adoption thereof in the record;
23 of the proceedings of the City Council of said City in the minutes of the
24 meeting at which the same is passed and adopted.

ORDINANCE NO. *9/J^
AN INITIATIVE ORDINANCE OF THE CITY OF CARLSBAD,
CALIFORNIA AMENDING THE LAND USE AND PUBLIC
FACILITIES ELEMENTS OF THE GENERAL PLAN AND THE
ZONING MAP TO REQUIRE A GUARANTEE THAT ALL PUBLIC
FACILITIES WILL BE AVAILABLE BEFORE A DEVELOPMENT
CAN BE APPROVED AND REGULATING RESIDENTIAL
DEVELOPMENT AND POPULATION IN THE CITY.
The people of. the City of Carlsbad, California do
ordain as follows:
SECTION A: That the Carlsbad general plan shall be
amended by the amendment of the Public Facilities and Land Use
Elements to add the following:
"The City of Carlsbad in implementing its public
facilities element and growth management plan has made an
estimate of the number of dwelling units that will be built as a
result of the application of the density ranges in the Land Use
Element to individual projects. The City's Capital Improvement
Budget, growth management plan, and public facilities plans are
all based on this estimate. In order to ensure that all
necessary public facilities will be available concurrent with
need to serve new development it is necessary to limit the number
of residential dwelling units which can be constructed in the
City to that estimate. For that purpose the City has been
divided into four quadrants along El Camino Real and Palomar
Airport Road. The maximum number of residential dwelling units
to be constructed or approved in the City after November 4, 1986
is as follows: Northwest Quadrant 5,844; Northeast Quadrant
6,166; Southwest Quadrant 10,667; Southeast Quadrant 10,801.
The City shall not approve any General Plan amendment,
zone change, tentative subdivision map or other discretionary
approval for a development which could result in development
above the limit in any quadrant. In order to ensure that
development does not exceed the limit the following growth
management control points are established for the Land Use
Element density ranges.

The City shall not approve any residential development
at a density that exceeds the growth management control point for
the applicable density range without making the following
findings:
1. That the project will provide sufficient additional
public facilities for the density in excess of the control point
to ensure that the adequacy of the City's public facilities plans
will not be adversely impacted.
2. That there have been sufficient developments
approved in the quadrant at densities below the control point to
cover the units in the project above the control point so the
approval will not result in exceeding the quadrant limit.
The City Manager shall monitor all approvals and report
to the Planning Commission and City Council on an annual basis to
ensure that the construction of residential units within each
quadrant, on a cumulative basis, will be at or below the growth
management control points and that the overall quadrant limits
are being maintained. If the annual report indicates in any way
that it is likely that the limit may be exceeded, the Council
shall take appropriate action by revising the growth management
plan and the City's zoning code to ensure that the ceilings will
be maintained.
The City Council or the Planning Commission shall not
find that all necessary public facilities will be available
concurrent with need as required by the Public Facilities Element
and the City's 1986 growth management plan unless the provision
of such facilities is guaranteed. In guaranteeing that the
facilities will be provided emphasis shall be given to ensuring
good traffic circulation, schools, parks, libraries, open space
and recreational amenities. Public facilities may be added. The
City Council shall not materially reduce public facilities
without making corresponding reductions in residential
densities.
Nothing in this section shall be construed as changing
the requirement that any specific residential density above the
minimum allowed by the Land Use Element density ranges and the
applicable zoning shall be justified according to the
requirements of the appropriate General Plan and zoning
provisions.
SECTION B. The zoning map of the City of Carlsbad shall
be amended to provide that building permits issued or approved
for residential dwelling units in the City after November 4, 1986
shall not exceed the limits established in the map in this
section. The numbers on the map shall not be increased without
an affirmative vote of the people.

SECTION C. The City Council shall adopt amendments to
Chapter 21.90 of the Carlsbad Municipal Code (Growth Management)
as necessary to implement the General Plan amendment of Section A
and the Map of Section B.
SECTION D. This ordinance is inconsistent with and
intended as an alternative to any initiative ordinance which
would place an annual numerical limitation on the rate of
residential construction. If this ordinance and any such
initiative ordinance are both passed by a majority voting thereon
then the one with the most votes shall prevail.

SECTION E: This ordinance shall not be codified.
EFFECTIVE DATE: In accordance with Section 4013 of the
Elections Code of the State of California, this ordinance shall
be considered as adopted upon the date that the vote is declared
by the City Council, and shall go into effect ten days after that
date.
