RECOMMENDED ACTION: It is recommended the City Council affirm the action of the Personnel Board as set forth in Personnel Board Resolution No. 11. ITEM EXPLANATION: Police Officer Britton Call appeared before the Personnel Board on November 13 and 20, 1986, to appeal his reduction from Senior Police Officer to Police Officer and his termination from participation in the Off Road Law Enforcement Program. The Personnel Board heard the appeal and sustained the discipline imposed as appropriate to the offense. The board further recommended specific departmental procedural changes for consideration. FISCAL IMPACT: There is no fiscal impact resulting directly from this action. RESOLUTION NO. 11 A RESOLUTION OF THE PERSONNEL BOARD OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING ACTION ON THE APPEAL OF BRITTON CALL. WHEREAS, the Personnel Board of the City of Carlsbad, California, met on November 13 and 20, 1986, to hear the appeal from discipline of Britton Call: and WHEREAS, the Personnel Board heard evidence and arguments presented by the City and Officer Call: and WHEREAS, the Personnel Board after consideration of all the evidence and arguments presented recommends that the discipline imposed be sustained and further recommends consideration of speci f ic procedural changes. NOW, THEREFORE, BE IT RESOLVED by the Personnel Board the City of Carlsbad, California as follows: 1. That the foregoing recitations are true and correct. 2. That on July 20, 1986 Officer Call gave chase to two motorcyclists in connection with a municipal code traffic infraction and in conducting the stop he drew his service revolver and displayed it without cause or reasonable justification. 3. That in conducting this stop and investigation, Officer Call used rude and inappropriate language. 4. That these facts constitute violations of Police Department Rules and Regulations 1.02, 1.12, 1.16, 1.18 and 1.26. 5. Officer Call appealed the discipline imposed by Chief Jimno in his letter of September 10, 1986. of c I I 1( 1: 1: 1: 1f l! 1t 15 1€ 1s 2c 21 22 23 24 25 26 27 2a 6. The Board sustains the discipline imposed by said letter of September 10, 1986 as follows: a. Officer Call be reduced in rank to police officer from senior police officer by a vote of 3 to 2, members Veale and Kimbrell dissenting. b. Officer Call's participation in the Off Road Law Enforcement Program be terminated by a vote of 5-0. 7. It is further recommended that the Police Chief personally conduct staff meetings with all levels of police department personnel to explain and interpret departmental rules, regulations, and policies. Further that these meetings be regularly scheduled and that meeting reports, summaries, sign-up sheets, and other follow-up procedures be instituted. 8. That the Carlsbad Police Department equip all off- road motorcycles with red lights, sirens, and two-way radio equipment. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Personnel Board of the City of Carlsbad, California, on the 20th day of November 1986, by the following vote, to wit: AYES: Mitkevich, Veale, Driver, Hinkle, Kimbrell NOES : ABSENT: - AhLA] CRAIRMAN OF THE BOARD ATTEST: n
