ITEM EXPLANATION The City Fire Department annually inspects all property in the city as part of the Weed Abatement Program. Property owners with hazardous overgrowth of weeds or accumulation of trash and debris are notified to clear their lots. If the property owner fails to clean the property, the Fire Depart- ment, through the use of a private contractor, causes the property to be cleaned, and the property owner is billed for the costs involved. This agenda bill is a request to, :tend the present contract with Bert Ingold. The Staff's request for a two year extension of the contract is based on the excellent nervice provided by Mr. Ingold. He has demonstrated an eager willingness to work closely with Staff to satisfy routine requirements and to solve the unusual problems that arise during the Weed Abatement process. His expertise has assisted Staff in conducting a trouble free Weed Abatement Program. Due to the excellent quality of service being pro- vided and the modest price increase quoted by Mr. Ingold, Staff is rec- ommending that the existing contract be extended two years. This request is permissable under the purchasing ordinance, and the purchasing agent concurs. FISCAL IMPACT The contractors Fees are being increased 5% to cover increased cost of operation. This increase will be borne by property owners, with no fis- cal impact to the city. EXHIBITS 1. 2. 3. KUNDTZ, Deputy City Clerk (SEAL) A G R E E M E N T (Weed Abatment) EXHIBIT THIS AGREEMENT, made and entered into this day of ---- 1986, by and between the City of Carlsbad, a municipal corporation (hereinafter called "Contractor"). WITNESSETH: WHEREAS, the City Council of the City of Carlsbad, pursuant to Section 39560 et.seq of the Government Code, has determined that a Weed Abatement Pro- gram is in the public interest; and WHEREAS, public interest requires that the City enter into this Agreement with the Contractor to complete said program; and WHEREAS, the Contractor is willing to abate said weeds in the manner hereinafter provided; and WHEREAS, the specifications and addendum thereto, accurately and fully described the terms and conditions upon which Contractor is willing to fur- nish the labor and mater:als to abate said weeds and clean said property as callc~ for by said specifications and said proposal and the manner and time within which the same shall be accomplished; NOW, THEREFORE, in consideration of the premises and of the covenants herein contained; IT IS AGREED BY AND BETWEEN THE PARTIES as follows: (1) Said specifications and addendum thereto, filed with City Clerk, as aforesaid are made a part hereof, and that the same do, in all particulars, become a part of the agreement and contract between the parties hereto in in all matters and things set forth therein and described, and that both parties hereto, hereby accept and agree to the terms and conditions of said specifications and addendum thereto, and bonds so filed. {2) The Contractor agrees to perform the work in the manner set forth in said specifications and addendum thereto and the City agrees to pay for said work after completion at the prices set forth as follows: (Fee Schedule as submitted by Contractor). (3) The Contractor shall ind~mnify and defend the save harmless the City of Carlsbad, its officers, agents and employees from and against any and all claims, demands, loss or liability of any kind or nature which the City of Carlsbad, its officers, agents and employees may sustain or incur or which may be imposed upon them or any of them for injury to or death of persons or damage to property arising out of or in any manner connected with the negli- gence of lack of care of Contractor, his officers, agents or employees in the performance of this contract. This provision shall include any and all claims arising from sub-contractors retained by the Contractor. (4) The Contractor hereunder shall commence work at the time fixed by the Fire Chief and the entire work contemplated hereunder shall be completed by July 24, 1987 Time shall be deemed of the essence regarding this con- tract, and Contractor shall be equipped to commence work on ten (10) days written notice from Fire Chief. No extension of time beyond the time of com- pletion herein mentioned will be granted except by the Fire Chief (unless otherwise directed by the City Council) for good cause. (5) The term of this agreement shall be for a period of two years, commencing on the date of this Agreement and terminating on December 31, 1988, or such later date as may be required for the contractor to complete the work set forth in the specifications.
