RECOMMENDED ACTION:
Adopt Resolution No. 8938 approving a Memorandum of Agreement
between the City of San Marcos, County of San Diego and City
of Carlsbad regarding construction of a truck bypass and the
routincr of truck traffic on Rancho Santa Fe Road, and introduce
Ordinaice No. J~o? dessignating Rancho Santa Fe Road as a
northbound truck route upon completion of construction of the
bypass and section of Rancho Santa Fe Road south of La Costa Avenue.
ITEM EXPLANATION:
At its January 6, 1987 meeting, the Carlsbad City Council considered a proposal negotiated with the City of San Marcos and County Supervisor McDonald's office regarding the issue of truck traffic on Rancho Santa Fe Road.
The tentative agreement reached by the Council Subcommittee composed of Mayor Lewis and Mayor Pro Tem Kulchin, calls for the establishment of truck traffic on Rancho Santa Fe Road pending the completion of a truck bypass north of La Costa Avenue and the reconstruction of Rancho Santa Fe Road south of La Costa Avenue. The attached
Resolution and Memorandum of Agreement reflect the agreement
approved in concept by the Council at its last meeting. As part
of the agreement, Carlsbad will make its best faith efforts to
expedite construction of the truck bypass and to encourage the
developer to expedite completion of the reconstruction of Rancho
Santa Fe Road south of La Costa Avenue. The City will attempt
to have these projects completed by April 30, 1987.
Also attached is an ordinance that will designate Rancho Santa
Fe Road as a truck route for northbound truck traffic only upon
completion of the bypass and completion of Rancho Santa Fe Road
south of La Costa Avenue.
FISCAL IMPACT:
The estimated cost to design and construct the bypass is $200,000.
The agreement calls for the County's Solid waste Enterprise Fund
to pay for the design and construction of the bypass not to exceed
the engineer's estimate of $200,000. Any costs in excess of
$200,000 would have to be absorbed by the City of Carlsbad. Supervisor
McDonald's office will request additional funding beyond the
$200,000 to be offered as a bonus incentive to the contractor selected to build the project as an incentive for early completion of the project. The amount of that additional funding request has yet to be determined.

RESOLUTION NO. 8938
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT WITH THE CITY OF SAN
MARCOS AND THE COUNTY OF SAN DIEGO TO CONSTRUCT A TRUCK
BYPASS ALONG RANCHO SANTA FE ROAD IN THE CITY OF CARLSBAD.
WHEREAS, Rancho Santa Fe Road has served as access to the
solid waste landfill in San Marcos; and
WHEREAS, the City of Carlsbad has not designated Rancho Santa
Fe Road through the City of Carlsbad as a truck route thereby
prohibiting solid waste truck traffic; and
WHEREAS, 'the City of Carlsbad is concerned about the impact
of solid waste truck traffic through the residential areas along
Rancho Santa Fe Road in the City of Carlsbad; and
WHEREAS, the City of San Marcos has concern regarding the impac
of traffic on roads within the City of San Marcos used as access
to the Solid Waste Facility; and
WHEREAS, the City Council of the City of San Marcos has intro-
duced an ordinance which would establish a mitigation fee for truck
traffic along certain San Marcos streets; and
WHEREAS, the impact of prohibiting truck traffic on Rancho
Santa Fe Raod through the City of Carlsbad and the mitigation fee
proposed by the City of San Marcos result in increased costs to
citizens for collection and disposal of trash generated in the
North County and transported to the County's San Marcos Solid
Waste Facility; and
WHEREAS, solid waste management is a regional concern that must
be addressed by all cities and the County; and

WHEREAS, it is in the best interest of all users of the San
L,arcos Solid Waste Facility to cooperate in ensuring access to
this regional facility.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the agreement between the cities of San Marcos,
Carlsbad and the County of San Diego attached hereto is hereby
approved.
3. That the Mayor is authorized and directed to sign the
agreement on behalf of the City of Carlsbad.

MEMORANDUM OF AGREEMENT AMONG THE CITY OF CARLSBAD
AND THE CITY OF SAN MARCOS AND THE COUNTY OF SAN DIEGO
TO CONSTRUCT A SOLID WASTE TRUCK BYPASS TO THE EXISTING
RANCHO SANTA FE ROAD IN THE CITY OF CARLSBAD
WHEREAS, the permanent alignment of Rancho Santa Fe Road
through the City of Carlsbad will be finalized within six months
and construction is expected to occur within three to five years;
and
WHEREAS, the City of Carlsbad is concerned about the impact
of solid waste truck traffic through the residential areas along
Rancho Santa Fe Road in the City of Carlsbad; and
WHEREAS, the City of San Marcos has concerns regarding the
impact of traffic on roads within the City of San Marcos used
as access to the Solid Waste Facility; and
WHEREAS, the City of Carlsbad has not designated Rancho
Santa Fe Road through the City of Carlsbad as a temporary truck
route, thereby prohibiting solid waste truck traffic; and
WHEREAS, the City Council of San Marcos has introduced an
ordinance that would establish a mitigation fee for solid waste
truck traffic along the City of San Marcos roads; and
WHEREAS, Rancho Santa Fe Road is not now, but is planned
to be constructed as a prime arterial road through the City
of Carlsbad; and
WHEREAS, the impact of prohibiting truck traffic on Rancho
Santa Fe Road through the City of Carlsbad and the mitigation
fee proposed by the City of San Marcos result in increased costs
to citizens for collection and disposal of trash generated in
the North County and transported to the County's San Marcos
Solid Waste Facility; and

WHEREAS, solid waste management is a regional concern that
must be addressed by all cities and the County; and
WHEREAS, it is in the best interests of all users of the San
Marcos Solid Waste Facility to cooperate in assuring access to this
regional facility.
NOW, THEREFORE, BE IT RESOLVED AND AGREED THAT:
1. The City of Carlsbad alternate solid waste truck access
through Carlsbad, utilizing approximately one mile of the old
Rancho Santa Fe Road right-of-way (as shown on Attachment A), will
be constructed for use by northbound trucks until the permanent
alignment of Rancho Santa Fe Road is improved. Upon completion
of this alternate truck access, the City of Carlsbad shall
designate Rancho Santa Fe Road as a truck route for northbound
trucks only. Southbound truck traffic will not be allowed on the
existing alignment of Rancho Santa Fe Road within the City of
Car 1 sbad .
2. The City of Carlsbad will administer the design and
construction of the project. All in-house administrative costs
will be absorbed by the City of Carlsbad. The City of Carlsbad
will take all steps necessary and reasonable to expedite construc-
tion of the alternate truck access along the old Rancho Santa
Fe Road and will make a good faith effort to have the construction
completed by April 30, 1987. In the event that the truck bypass
route is completed prior to the reconstruction of Rancho Santa Fe
Road to its proposed six lane configuration south of La Costa
Avenue, the City of Carlsbad will reopen the entire roadway to
northbound truck traffic or provide an alternate route utilizing
the Mission Estancia loop or some other alternative approved by
the City Council.
3. The County’s Solid Waste Enterprise Fund will fund the
out-of-pocket expenses for the design and construction of the
bypass. Said expenses shall not exceed the engineer’s estimate
of $200,000 (see Attachment B). Provided, however, that the County
hereby agrees to contribute additional funding to be offered as
a financial incentive to the contractor for early completion of the
alternate truck access route, the amount of said incentive shall be
included in the construction contract and shall not exceed $1,000
per day that the project is completed ahead of the contract completion
date.
4. The City of San Marcos agrees that it will take no further
action until April 30, 1987 regarding implementation of solid
waste truck mitigation fees, and further agrees that it shall not
arbitrarily impose said fees if the alternate truck access route on
old Rancho Santa Fe Road is substantially completed by April 30, 1987.
5. The City of San Marcos agrees to allow northbound solid
waste trucks to travel on San Marcos City streets.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 10, CHAPTER
10.32, SECTION 10.32.091 OF THE CAFLSRAD MUNICIPAL
CODE BY THE ADDITION OF SUBSECTION (1) DESIGNATING
PORTIONS OF RANCHO SANTA FE ROAD AS A TEMPORARY
NORTHROUND ONLY TRUCK ROUTE.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 10, Chapter 10.32, Section
10.32.091 of the Carlsbad Municipal Code is amended by the
addition of Subsection (1) to read as follows:

EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify

least once in the Carlsbad Journal within fifteen days after its
adoption.
OPERATIVE DATE: This ordinance shall be operative upon
certification by the City Manaqer that the construction of the
truck bypass and the six lane section of Rancho Santa Fe Road are
complete. The truck route desiqnation shall be temporary and be
reevaluated when Rancho Santa Fe Road is constructed.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 13th day of January , 1987

Ordinance No. 3209, adopted by Council on January 20, 1987, provides that Rancho Santa Fe Road would be designated as a one-way north bound truck route upon the certification by the City Manager that construction of the truck bypass and the six lane section of Rancho Santa Fe Road are completed.

opened to north bound truck traffic by the City of Carlsbad on August 7,
1987. South bound Rancho Santa Fe Road between Olivenhain and
Questhaven is not being designated a truck route.
