RECOMMENDED ACTION:

ITEM EXPLANATION
Section 36516 of the California Government Code provides that a
general law city with a population over 50,000 up to 75,000 may
compensate each member of the city council in the amount of $500 per
month. Effective November 4, 1986 pursuant to Ordinance No. 1289 the
City Council members receive $457 per month. In a memorandum dated
January 14, 1987 Mr. Hagaman reports that the city's actual estimated
population as of January 1, 1987 is 54,300. For the $500 salary to
be effective the City status as a city over 50,000 in population must
be validated by an estimate approved by the Department of Finance.
Mr. Hagaman reports that he has reason io believe that that official
estimate will be received prior to the March 3, 1987 special
municipal election. If the Council wishes to proceed your action is
to introduce Ordinance No. authorizing the $500 per month
salary. Under law that could not be effective until a new member is
seated on the City Council which would occur after the March
election. For these things all to come together the ordinance must
be introduced and adopted between now and the election. In the
alternative, if we wait to adopt the ordinance until actual receipt
of the department's estimate that will probably result in the
ordinance not being effective until after the March election which
would mean the new salary could not be implemented until after the
regular municipal election in November 1988.

1293
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 2, CHAPTER.
2.04. OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 2.04.010 TO INCREASE THE
COMPENSATION OF THE MAYOR AND MEMBERS OF THE
CITY COUNCIL.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: Title 2, Chapter 2.04 of the Carlsbad
Municipal Code is amended by the amendment cf Section 2.04.010
to read as follows:
"2.04.010 Compensation. Each member of the City
Council shall receive as salary the sum of $500 per month as
authorized by Section 36516 of the Government Code for cities
over 50,000 and up to and including 75,000 in population payable
at the same time and in the same manner as salaries are paid to
other officers and employees of the City.
The salaries established by this section are exclusive
of any amounts payable to each member of the City Council as
reimbursement for actual and necessary expenses incurred in the
performance of official duties for the City.
This section shall become opertive only on and after the
date upon which one or more members of the City Council become
eligible pursuant to Section 3f516.5 of the Government Code for a
salary increase by virtue of be-ginninq a new term of office
following adoption of this section."
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 27th day of January
1987, and thereafter
