TITLE: MT& 02/03/87 ACCEPT BIDS, AWARD CONTRACT, AND APPROPRIATE FUNDS FOR THE CONSTRUCTION OF DEPT. Mf’ THE CYNTHIA LANE ASSESSMENT DISTRICT I RECOMMENDED ACTION: Adopt Resolution No. m&a accepting bids, appropriating funds and awarding Contract No. 3161 for the construction of the Cynthia Lane Assessment District. I ITEM EXPLANATION: At the March 25, 1986 City Council meeting, the Council adopted resolutions adopting the Cynthia Lane Assessment District Boundary Map, appointing assessment counsel, and ordering the installation of improvements in accordance with Chapter 27 of the Improvement Act of 1911. At a subsequent meeting of April 22, 1986, the Council approved the request of several property owners to undertake the installation of improvements fronting their property themselves prior to proceeding with the construction under the Assessment District. Private property owner work has now been completed on Cynthia Lane. On September 23, 1986, the City Council authorized the advertisement for bids for the above referenced project. Four (4) sealed bids were received on January 7, 1987, as follows: 1. William S. Kirchnavy $126,407.00 ' 2. Southland Paving 136,809.69 3. R. E. Hazard 147,403.85 4. A. B. C. Construction Company 151,762.42 The Engineer’s estimate for the construction portion of this project is $123,830.00. Full street improvements will be installed in Cynthia Lane within the boundaries of the Assessment District. Included will be asphalt surface, curb and gutters, two (2) street lights, one (I) fire hydrant, water main, sanitary sewer, and gas, electric, telephone and cable utilities. Points of connections for all above utilities will be provided for fifteen (15) lots which is the anticipated lot split among the eight (8) remaining property owners. FISCAL IMPACT: Funds in the amount of $30,000 have been previously appropriated for this project. Funds in the amount of $214,000 are recommended to be transfered from the unappropriated balance of the General Capital Construction Fund account No. 300-941 to the /- Page Two of Agenda Bill No. 7drt-y project account for the design, construction, project administration, bond and legal costs of this project. The financing method for this project was established at the Council meeting of April 22, 1986 in which under the Chapter 27 proceedings, the City would finance the project on an interim basis to enable proceeding with the District. Additional required project funding in the amount of $214,000, along with the original $30,000 C’t 1 y appropriation for District formation and design, represents temporary financing until proceeds from the sale of bonds for this project are generated in approximately six (6) months. All expenses associated with this project are to be reimbursed to the General Fund following the bond sale. EXHIBITS: 1. Location Map. 2. NO- EXHIBIT CYNTHIA LANE ASSESSMENT DISTRICT 3161 I 3 2 1 . 4 f f ‘i E S 1C 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8960 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS, APPROPRIATING FUNDS, AND AWARDING CONTRACT NO. 3163 FOR THE CONSTRUCTION OF THE CYNTHIA LANE ASSESSMENT DISTRICT IMPROVEMENTS WHEREAS, the City Council of the City of Carlsbad, California has instituted proceedings pursuant to the provisions of Chapter 27 of the “Improvement Act of 1911", being Division 7 of the Streets and Highways Code of the State of California, for the construction of certain authorized improvements in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 86-3 (CYNTHIA LANE) (hereinafter referred to as the "Assessment District”); and WHEREAS, this legislative body has held a public hearing and given notice in the manner and form as required by law, and a period of sixty (60) days has lapsed since notice was given directing that the work be performed, and said construction has not been commenced or completed at this time, and this City Council is now desirous to proceed to cause the completion of s.aid improvements and all appurtenances; and WHEREAS, this legislative body specifically finds that construction was not commenced within sixty (60) days after notice was given, and that this City Council now has jurisdiction to proceed to cause the completion of said works of improvement; and WHEREAS, sealed bids have been received for the doing of 1 the works of improvement described in the Resolution Ordering 2 Improvements, and this City Council is now desirous to proceed 3 to award a contract to the lowest responsible bidder; and 4 WHEREAS, the low bid received for the widening was 5 submitted by William S. Kirchnavy, Inc., in the amount of 6 $126,407.46; and 7 WHEREAS, a current appropriation for this project does not 8 exist; and 9 WHEREAS, funds in the amount of $244,000, representing 10 total project estimated costs, are required for both 11 construction and incidental expenses for this project; 12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the 13 City of Carlsbad, California, as follows: 14 1. That the above recitations are true and correct. 15 2. That the City Council has determined that construction 16 has not been commenced or completed since notice was given that 17 the works be performed. 18 3. That the City Council further determines that it now 19 has jurisdiction to proceed to cause the completion of said 20 works of improvement. 21 4. That the bid of $126,407.00 by William S. Kirchnavy, 22 Inc., for Contract No. 3161 for the construction of 23 improvements to Cynthia Lane is hereby accepted, and the Mayor 24 and City Clerk are hereby authorized to execute a contract 25 thereafter. 26 /// 27 /// 28 /// 5.
