HD/* CITY ATTYJ^-^3 CITY MGR^t^p RECOMMENDED ACTION: If Council concurs, your action is to introduce Ordinance No. amending Title 21, Section 21.81 of the Carlsbad Municipal Code to comply with Coastal Commission Certification of the Village Area Local Coastal Program. ITEM EXPLANATION The Coastal Commission has requested minor changes be made to Title 21, Section 21.81 of the Municipal Code prior to the Commission Certification of final permit authority in the Village Redevelopment Area. These changes are as follows: Section 6: That Title 21, Chapters 21.81 of the Carlsbad Municipal Code is amended by the amendment of Sectionsat the local district office21:81:110 3(b). The appeal shall be filedA not later than20 receipt of the noticed by that district office.ten- working days after the date of the A final local action A No City permit shall be issued or deemed approved until an appeal, if any, to the Coastal Commission has been resolved. Section 9: That Title 21, Chapter 21.81 of the Carlsbad Municipal Code is amended by the amendment of Section 21.81.130 to read as follows: "21.81.130 Effective date of permit. Coastal development permits for projects which are not appealable to the Coastal Commission shall be valid upon the mailing of the notice of final local action unless the notice of final local action does not comply with the requirements of Section 21.81.120. Coastal development permits for projects which are appealable to the Coastal Commission shall be .valid .upon the expiration20 receipt at the local district office of 15 working days from the date ofA atti-ting of the notice of final local action provided that the notice complies with the requirements of Section 21.81.120 and further provided that an appeal of the decision has not been filed with the Coastal Commission. " Section 12: That Section 12, Chapter 21.81 of the Carlsbad Municipal Code is amended by the addition of Section 21.81.165 to read as follows: AGENDA BILL NO. ^^77 PAGE 2 issued by the City Amendment to a coastal development permit A shall be processed in the same manner as an original application for a coastal development permit." The Coastal Commission will meet in March to consider transferring final permit authority in the Village Redevelopment Area to the City of Carlsbad pending this action. The Council needs to adopt Ordinance No. ^S^^ that will authorize the changes to the Municipal Code. The Coastal Commission will hear this item at their March 1987 meeting.
