RECOMMENDED ACTION:
Staff is recommending that the Citv Council ADOPT Resolution No. -f'97& . , APPROVvING the annexition of all County Islands within the City's existing sphere of influence.
ITEM EXPLANATION
Early in 1986 the County of San Diego agreed to process all County Islands located within the Carlsbad Sphere of Influence so they could be annexed to the City of Carlsbad. The annexation process through LAFCO was completed on December 1, 1986. The next step in
the process is for the City, as conducting authority, to hold a
public hearing and adopt a resolution approving the boundary
changes.
The proposed annexation involves 8 areas comprising approximately 2,300 acres. These areas are shown generally on the attached
location map and more specifically on the map attached as Exhibit . All involved property owners have been noticed along with the "XI1
required notice in the newspaper. This was a condition required by LAFCO. The individual acreage and legal description for each arcel is also attached as part of the LAFCO information (Exhibit EA,,)
ENVIRONMENTAL IMPACT
A Statement of Prior Compliance was issued by the Planning Director as a negative declaration had been adopted by the County of San
D iego .
FISCAL IMPACT
Over time the amount of services provided to these areas will increase costs, although some services (police and fire) are being provided currently. As property changes hands and is developed the City will share in the assessed value of the property. Carlsbad is not getting a share at this time. The City would also receive
future commercial tax or TOT tax if any of these areas are
developed for commercial use.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAKLSBAD, CALIFOKNIA, APPROVING THE AiiNEXATION OF CERTAIN UNINHABITED TERRITORY HEREINAFTEK DESCRIBED AND DESIGNATED AS THE CARLSBAD COUNTY lSLANDS ANNEXATION
WHEREAS, an application for approval of a proposal for the
initiation of proceedings for the annexation of territory
hereinafter identified and described as the Carlsbad County Islands
Annexation to the City of Carlsbad, County of San Diego, State of
California, was filed with the Local Agency Formation Commission
Keference No. CA 86-5; and
WHEKEAS, a resolution of application was submitted to
LAFCO by the County of San Diego for annexation of territory to the
City of Carlsbad, which resolution was adopted by the Board of
Supervisors of San Diego County as Resolution No. 2, dated August
20, 1986, pursuant to Title 5, Division 3, commencing with Section
56000 of the Government Code; and
WHEREAS, a resolution of the said Local Agency Formation
Commission, after a hearing held in the manner required by law, was
duly passed and adopted on the 1st day of December, 1986, approving
the application for annexation of the territory described by metes
and bounds on Exhibit "A", attached hereto, to the City of
Carlsbad; and
WHEREAS, the territory proposed for annexation is as
described in the application on file with the Local Agency
Formation Commission; and
WHEREAS , on March 3, 1987 , the City Council of the City
of Carlsbad held a public hearing on the proposed annexation, and
at said hearing, upon considering all testimony and arguments, if
any, of all persons desiring to be heard, the Council considered

all factors relating to said annexation.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Carlsbad as follows:
(1) The hearing was held on the date set therefore, and due notice of said hearing was given in the manner conditioned in LAFCO Kesolution Reference CA 86-5; (2) At that hearing the City Council called for, heard,
and considered all interested parties. (3) The City Council certifies that no environmental impacts will occur as a result of this application as a statement of prior compliance was issued by the Planning Director based on previous review by the County of San Diego.

To THE CITY OF CARLSBAD
On motion of Commissioner Eckert, seconded by Commissioner
Bilbray, the following resolution is adopted:
WHEREAS8 a resolution of application was submitted to this
Commission for annexation of territory to the City of Carlsbad,
which resolution was adopted by the Board of Supervisors of San
Diego County as Resolution No. 2, dated August 20, 1986, pursuant
to Title.5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as
described in the application on file with the Local Agency
Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed
her report on said annexation, which report was received and considered by the Commission; and
WHEREAS, pursuant to Government Code Section 56828, the
Executive Officer of this Commission set a public hearing on the
proposed annexation for December 1, 1986, and gave notice of the
date, time, and place of said hearing in accordance with
Government Code Sections 56834 and 56835;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds, determines, and orders as follows:
(1) The hearing was held on the date set therefore, and due
notice of said hearing was given in the manner required by law.
(2) At that hearing the Commission called for, heard, and
considered all interested parties and read and considered the
report of the Executive Officer.
(3) The Commission certifies that it has reviewed and considered the information contained in the Negative Declaration
prepared by the County of San Diigo.
(4) The Commission hereby approves the annexation with
modified boundaries, as described in Exhibit A attached hereto.
(5) The Commission recommends to the City Council that it give mailed notice to all affected property owners of the
conducting authority'8 public hearing.
(6) The boundaries of the territory as described in
Exhibit A are defin,ite and certain.
(7) The boundaries of the territory do conform to lines of
assessment and ownership.
(8) The territory includes 2,300 acres and is inhabited.
(9) The territory proposed to be annexed is hereby
designated the "Carlsbad County Islands Annexation" to the City of Carlsbad.
(10) The Commission hereby designates the City of Carlsbad
as the canducting authority and authorizes the City Council to
initiate proceedings in compliance with this resolution.
(11) The Executive Officer is hereby authorized and directed
to mail certified copies of this resolution as provided in
Section 56853 of the Government Code.

hearing, at the Carlsbad Safety and Service Center, 2560 Orion Way, Carlsbad, California,
at 6:OO P.M., on Tuesday, March 3, 1987, to consider approving the annexation of all
County Islands within the City of Carlsbad’s sphere of influence.
