ITEM EXPLANATION:
Council Member Mamaux requested that the bill for legal services
connected with the Blade-Tribune’s demand for telephone records be placed on Council Agenda.
Attached is an invoice for $768.75 from the law firm of Brown and
Diven for services of Daniel Hentschke. These services were
rendered to staff in regard to the public records act request
for the City Attorney’s telephone billing records.
When staff approached the City Attorney in regard to this public
records request and the threat of litigation, he felt that it
would be a conflict of interest for his office to render an opinion. Under the Carlsbad Municipal Code, staff has authority
to retain outside professional services without City Council
approval if the cost does not exceed $10,000, budgeted funds
are available, and it is deemed appropriate.
FISCAL IMPACT:
Funds to pay this invoice are available in the Finance Department budget account no. 01-13-10-2470.
