RECOMMENDED ACTION:
It is recommended that the City Council APPROVE the agreement
between the City and the Boys and Girls Club for the
construction of a pool enclosure at 3115 Roosevelt St.
ITEM EXPLANATION
On November 26, 1985, the City Council selected improvements
of the Boys and Girls Club to be funded with llth Year
Community Development Block Grant funds and allocated $50,00o
for this purpose. HUD regulations require an agreement
between the City and the Boys and Girls Club to assure
federal guidelines are met. The attached agreement, which
addresses those federal requirements, has been approved by
the County. The City Council needs to approve execution of
the agreement.
FISCAL IMPACT
Approval of this agreement will allow release of $50,000 in
Community Development Block Grant funds to the Carlsbad Boys
and Girls Club.

3 THIS AGREEMENT is made and entered into this day of

1987, by and between the City of Carlsbad, a
5 municipal corporation, rporation, hereinafter referred to as the "City",
7 and the Carlsbad Boys and Girls Club, a nonprofit organization,
7 San Diego County, State of California, hereinafter referred to
8 as the "Club".

W I T N E S S E T H.
11 WHEREAS, in order to promote and P provide for the health and
12 general welfare of the people of Carlsbad, and to cultivate the
13 development of
p good citizenship by an adequate program of
14 communityrecreation the , parties hereto desire to enter into
15
an agreement for rehabilitation of the Carlsbad Boys and Girls
16 Club within the City;
17 NOW, THEREFORE, THE CITY AND THE CLUB agree as follows:
18 1. WORK TO BE PERFORMED: Club agrees to implement the
19IProject described in Attachment "A" hereof (entitled "Work
20 Write Up"). The obligations undertaken by the Club include,
21 but are not limited to, the obligation to comply with the
22 following:

(a) Activities operated by the Club and charges for programs
24 will be conducted in such a manner that persons of low
25 and low -moderate income will not be excluded from
26 participation.
27 (b) Bidding procedure and contractor selection will be
28 according to Federal regulations and subject to the
Davis -Bacon Act and the Equal Employment Opportunity

Clause as outlined in the HUD Requirement attached to

the Contract Bid Documents.

COMPENSATION SCHEDULE: The City agrees to reimburse the

Club for the cost of the rehabilitation work as
5
specified in the accepted Contractors Bid Proposal upon
6
the submittal by the Club of a request for reimbursement
7
supported by record of payment and assurance that the
8
work has been completed.

TERMS: This agreement shall commence when executed by
10
the parties hereto and shall continue in full force and
11
effect until terminated as provided herein. The
12
agreement may be terminated by either party after 30
13
days written notice of intention to terminate has been
14
given the other party or upon completion of the
15
rehabilitation work except that after completion of the
16
work and reimbursement thereof Club activities -may be
17
audited periodically to assure compliance with Section 1
18
a. of this agreement.
