CM LEASING .., RECOMMENDED ACTION: Adopt motion authorizing Mayor to send letter to Congressman Packard urging him to oppose oil drilling leases off the San Diego Coast. BACKGROUND In 1986 Carlsbad City Council adopted a resolution requesting that oil leasing not be allowed off the San Diego Coast. The resolution was sent to Secretary of Interior and Congressman Packard. Some tracts were deleted, but the Secretary retained the right to lease offshore. Under Federal law a five-year (1987-92) leasing program was proposed on February 2, 1987. The 30-day public comment period has expired. The proposed program will be filed with Congress for approval in the future. If the Council still opposes offshore leasing, it is recommended that Mayor Lewis write to Congressman Packard expressing the City Council's opposition. EXH I B I TS 1. Resolution 8480 Carlsbad. 2. The Secretary of Interior has now proposed a five-year leasing program off the San Diego Coast. This program will shortly be presented to Congress for approval. "BUD" LEWIS Mayor mhs I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ObkF AGENDA ITEM: Council Meeting 4/1/8t No. AB e RESOLUTION NO. 8480 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REQUESTING THAT THE TRACTS OFFSHORE SAN DIEGO COUNTY BE DELETED FROM THE THE PROPOSED FIVE-YEAR OUTER CONTINENTAL SHELF OIL AND GAS LEASING PROGRAM WHEREAS, The City Council of Carlsbad, California, has been concerned about the adverse impacts of oil and gas developments offshore Carlsbad for the past ten years; and WHEREAS, the Department of Interior has proposed a Five-Year Outer Continental Shelf Oil and Gas Leasing Program for January 1987-December 1991; and WHEREAS, the proposed five-year program has identified two lease sales for the Southern California planning areas: NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Carlsbad approves the following comments and requests that the tracts offshore San Diego County be deleted from the proposed five-year plan: 1. ,All leasing activity associated with the five-year program should be scheduled after the EIR (Environmental Impact 1 Report) has been reviewed and approved. 2. The following lease areas should be deleted in the five-year proposed program: a. The tracts deleted by the Department of the Interior in previous Southern California lease sales. b. Tracts not bid upon by the petroleum industry in previous Southern California lease sales. c. The tracts requested by the Department of Defense to be deferred from Lease Sale No. 80. e. The nearshore tracts which, if developed, would adversely impact the air quality of the San Diego County region. f. The nearshore tracts which are adjacent to the following sensitive biological coastal resources: -- Oceanside Harbor -- Buena Vista Lagoon -- Agua Hedionda Lagoon -- Batiquitos Lagoon -- San Elijo Ecological Reserve -- San Dieguito Lagoon -- Scripps Shoreline Underwater Reserve -- Penasquitos Lagoon -- San Diego-La Jolla Ecological Reserve -- Mission Bay -- San Diego Bay I -- Tiajuana River National Estuarine Sanctuary 3. The tracts that have depth greater than 400 meters should be deleted from the five-year proposed program. Council adopted the following Resolution: RESOLUTION NO. 8479, REAPPOINTING DAVID DONNE AND RICHARD GOODWIN TO THE CARLSBAD PARKING AUTHORITY. OFF-AGENDA ITEM: Mayor Casler requested the Council consider an off- agenda item on the Resolution for the outer- continental shelf preservation. (62) Outer-Continental Shelf Preservation Council agreed to consider a Resolution regarding the preservation of the outer continental shelf as an off- agenda item. WHEREAS, the Department of Interior has issued the California component of the "Proposed 5-Year Outer Continental Shelf Leasing Program for 1987 through 1992" which out1 ines plans for offshore drilling lease sales during this period; and WHEREAS, pursuant to P.L. 99-591, the Secretary of Interior has been required by Congress to submit the California Component of his 5-Year OCS Leasing Program to the designated Congressional Negotiating Team anid to California local agencies for a comnent period of thirty days prior to submission of said Program to the full Congress; and WHEREAS, the Proposed OCS Program continues to propose a total of five leasing actions offshore California during the time period covered by the Program, including two lease sales for the Southern California OCS Planning Area, one lease sale for Central California, and two lease sales for Northern California; and WHEREAS, the Proposed OCS Program remains comitted to massive area-wide leasing actions and a streamlined pre-lease planning process which would not permit adequate consideration of local land-use priorities, conflicts with comnercial fishing, or locaT agency input to leasing decisions; and WHEREAS, the Proposed OCS Program will significantly affect onshore air quality and cause or contribute to violations of Ambient Air Quality Standards; and WHEREAS, the Proposed OCS Program fails to adequately consider the exist-ing or anticipated uses of the sea and seabed, including fisheries, navigation, existing or proposed sealanes, or military use areas; and WHEREAS, the Proposed OCS Program does not contain provisions for considering adverse regional and local economic impacts of OCS leasing actions on the existing and future economic base of each comnunity; and WHEREAS, the Proposed OCS Program does not consider the special nature of the California coast as a unique national resource attracting mill ions of visitors; and m W WHEREAS, OCS production from the already-developed areas of the California coast is currently making a substantial contribution to domestic energy supply without the need for additional lease sales; and WHEREAS, the Proposed OCS Prgram fails to adequately evaluate environmental risks and consider the relative marine productivity and environmental sensitivity of various OCS Planning Areas as required by the OCS Lands Act, nor does the Program consider the equitable sharing of developmental benefits and environmental risks among the various regions of the United States; and WHEREAS, the Proposed OCS Program fails to incorporate necessary environmental stipulations at the 5-Year Program stage; and WHEREAS, the Proposed OCS Prgram fails to consider adequately the laws, goals, and policies of the State of California as required by the OCS Lands Act; and WHEREAS, the Proposed OCS Program does not conduct the necessary "critical balancing" required by the OCS Lands Act; and WHEREAS, the City of Del Mar finds that the Proposed OCS Leasing Program and the accompanying Environmental Impact Statement to be in noncompliance with the legal requirements of the National Environmental Policy Act, the OCS Lands Act and Amnendments, the Endagered Species Act, the Coastal Zone Management Act, and the California Coastal Zone Management Plan, nor does the Proposed OCS Leasing Program adequately address local agency concerns nor regional economic imp1 ications; and NOW, THEREFORE BE If RESOLVED, 'the City of Del Mar hereby adopts this resolution opposing adoption and implementation of the February 2, 1987 Proposed QCS Leasing Program by the Department of Interior.
