ITEN EXPLANATION The developer of Carlsbad Tract No. 83-21, Unit 4, is requesting vacation of a portion of Harwich Drive which was previously offered for dedication on the final map for the subdivision. The offer was made in satisfaction of a Council imposed condition of approval which required the offer be made in order not to preclude the future installation of a cul-de-sac on Harwich Drive. Another condition of approval on the same resolution stated the offer of dedication could be vacated if a traffic study was prepared showing a cul-de-sac was not needed and Harwich Drive could safely function as a through road. A traffic study prepared by Federhart and Associates recommends the deletion of the future Harwich Drive cul- de-sac and finds the existing street to be safe for through traffic. Staff concurs with the recommendations of the consultant's traffic study and therefore recommends vacation of the offer to dedicate. No street improvements were made in the area offered for dedication. A sewer easement which crosses the area offered for dedication is excepted from the vacation. FISCAL IMPACT None. EXHIBITS 1. WHEREAS, the above street right-of-way previously offered for dedication and shown on attached Exhibit IA', will not provide improved circulation and access to the adjoining properties if converted to a cul-de-sac street. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbsd, California, as follows: 1. That the above recitations are true and correct. 2. That said portion of Harwich Drive, more particularly described on Exhibit "A" attached hereto, is excess right-of-way of a street not required for street purposes; and 3. That an easement for sewer lines and general utility pur- poses over Lot 265 of Map 11588 is excepted from this vacation. 4. That said portion of Harwich Drive has not been used for a period of five consecutive years and no public money has been expended for its maintenance during that period; and 5.
