AMEND CAFUSBAD MUNICIPAL CODE, SECTION 10.32.090, CITY Amm TO REVISE DEFINITION OF TRUCKS CITY MOR.* RECOMMENDED ACTION: Introduce Ordinance No.32 jo amending Carlsbad Code, Section 10.32.090 ITEM EXPLANATION: Due to the way the Carlsbad Municipal Code is currentl! written, truck route restrictions do not apply to two axle trucl,; regardless of weight. Vehicles in the previously excluded classification could legally weigh up to forty thousand (40,000) pounds and include a large percentage of the trash trucks operated by local companies. The proposed amendment would include all commercial vehicles exceeding a maximum gross vehicle weight of fourteen thousand (14,000) pounds. The revised code section would enable the police department to more effectively enforce truck route restrictions. FISCAL IMPACT: No direct impact from this action. EXHIBITS: 1. The City Council of the City of Carlsbad, does ordain as follows: SECTION 1: That Title 10, Chapter 10.32 of the Carlsbad Municipal Code is amended by the amendment of Section 10.32.090 to read as follows: "10.32.090 Truck routes generally. The use of all streets within the City, exceptinq those streets described in Section 10.32.091, is prohibited as to all commercial vehicles exceeding a maximum gross vehicle weight of fourteen thousand (14,000) pounds." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
