Charles Grimm, Assistant Planning Director, reviewed the
background of the project and stated that Gerico's Restaurant (formerly Daisy's) consists of a restaurant, coffee house, and cocktail lounge, located on the northwest corner of Tamarack Avenue and 1-5. The original plan approved under
Specific Plan 27 in 1972 established the site layout as it exists today which requires 60 parking spaces, one access off
shared with the neighboring service station. The restaurant facilities contain about 6,500 sq. ft. The applicant is now requesting an amendment to the Specific Plan to convert 200
sq. ft. of the existing lobby into a retail liquor store. Their on-premise liquor license does allow for off-premise sales through a separate permit issued by the Alcohol Beverage Control Board. An application for a permit to sell liquor at a gas station on the southeast corner of 1-5 and
Tamarack was recently denied by the City.

11. PROJECT DESCRIPTION AND BACKGROUND
Gerico's Restaurant (formerly Daisy's) consists of a restaurant,
coffee house, and cocktail lounge, located on the northwest
corner of Tamarack Avenue and 1-5. The original plan was
approved under Specific Plan 27 in 1972. That plan basically
approved the site layout as it exists today which required 60
parking spaces, one access off Tamarack, and freeway signage
limited to one pole sign to be shared with the neighboring service station. The restaurant facilities contain about 6,500
square feet.
At this time, the applicant is requesting an amendment to the
Specific Plan to convert 200 square feet of the existing lobby
into a retail liquor store. Their on-premise liquor license
does allow for off-premise sales through a separate permit
issued by the Alcohol Beverage Control Board. An application
for a permit to sell liquor at a gas station on the southeast
corner of 1-5 and Tamarack was recently denied by the City.
The Commission expressed some concern about selling liquor so
close to the freeway.
111. ANALYSIS
Planning Issues:

DISCUSSION
This project cannot meet the requirements of the C-2 zone. In
particular, parking standards have changed since the original
Daisy's Restaurant was built in 1972. Today's standards require
90 parking spaces for a 6,500 square foot restaurant. The
original Specific Plan required 60; thus, there is an existing
building, while having a lower parking standard than a
restaurant, is still an intensification of use on the property.
The retail proposal, i.e. 200 square feet, would require one
additional space,
Another zoning requirement for an off-sale liquor store is that
there be an unobstructed view into the premises from the street,
i,e. Tamarack. The building's entrance is on the side of the
restaurant and is not visible from the street. In this case,
even if it were visible to the street, the building is set back
so far on the lot that the intent of the requirement may not be
viable.
Another finding which must be made is that traffic flow on
public streets cannot cause congestion or be detrimental to othei
nearby commercial uses, and the project has to be compatible wit1

the existing restaurant, will not generate a substantial number
of new trips. The restaurant is bordered on three sides by 1-5

SUBJECT : Appeal of Planning Commission’s denial of
amendment to Specific Plan 27.
This letter is in response to the Planning Commission’s March 4th denial of the request by Gerico’s restaurant for an amendment Lo Specific Plan 27. This amendment asks for a 200 square foot retail liquor store within Gerico’s restaurant at 850 Tamarack Avenue, in the C-2 zone.
We would like to briefly describe how we intend to use
the liquor license. We would like to deliver the combi- nation of hot meals and liquor to the homes in Carlsbad. We feel that there is not only a need for this service, but that this would be a tremendous asset to the elderly and the handicapped. We have worked with ”Meals on Wheels” in the past and they have informed us that the demand for home delivered meals far exceeds their capabilities. Just as with any successful dinner house, we feel liquor is necessary to make our dinner delivery program a success.
If it were possible, we would use this license for home delivery only, but as mandated by the Alcoholic Beverage Control Board (ABC), we must have a storefront open to the general public. Since delivering food and liquor is how we intend to use the license, and that we anticipate the majority of our sales to come from delivery, we have allocated only 200 square feet for the retail store. The small size of the store would inhibit any large walk-in trade.
The ABC has been out to Gerico’s to examine the proposed site, and has fully approved the license. At that time, all
neighbors within 500 feet of Gerico’s were informed of the proposed liquor store, and there was no negative response from the neighborhood.
The Planning Commission based their denial on certain specific points regarding our proposed amendment, without giving due consideration to the nature of our intended use of the license, i.e. food and liquor delivery. We feel that these points can be corrected. The Planning Commission’s concerns were: inadequate parking, the visibility of the liquor store to Tamarack Avenue, and the fact that there are already two existing licenses operating on Tamarack Avenue.

to the square footage being reduced from 6500 to 6300 square
feet with the liquor store addition, the seating capacity of restaurant has already been reduced by six seats. This furtl reduces the parking requirement. Also, as many as five additional parking spaces can be added to the northern end
of the parking lot.
In paragraph three of the Planning Department staff report, the staff found that "the 200 square foot retail operation, which also may be used in conjunction with a trip to the existing restaurant, will not generate a substantial number of new trips." If this is true, as we believe, the question of parking being an issue becomes further unsubstantiated.
The Planning Department staff also raised some question as t(
the visibility of the liquor store to Tamarack Avenue. This can be rectified very simply by shifting the entrance of the

At the Planning Commission hearing of March 4, 1987, it was pointed out that there are two existing licenses on Tamarack Avenue. We realize that there are currently eight liquor
licenses operating in Carlsbad. However, not one of these licenses offers the delivery features we will offer.
We also understand that the Texaco station on Tamarack Avenue was denied a license to sell liquor. We think it is unfair to compare a gas station that sells liquor to our proposed format of delivering food and liquor directly to the home.
To briefly summarize, we feel that the Planning Commission's denial was based unfairly on requirements that may be easily remedied, and did not take into account the intended use of the license,
