APPLICABILITY OF BROWN ACT TO COMMUNITY MEETINGS
The Brown Act does not apply to purely social gatherings nor does
it apply to educational programs of a general nature such as the
League of California Cities meetings. Although it is less clear
it is also my opinion that the Act does not preclude council
training and development seminars focusing on decision making
ability or improvement of council-administrative relationships.
The Brown Act would not apply to a meeting with community groups
that was within these guidelines. The problem, of course, is the
likelihood that people in attendance at the meeting will want to
discuss problems particular to the City of Carlsbad. The courts
have defined the Brown Act's prohibition broadly to include
to a decision. It is, therefore, m.y advice that if a quorum of
the Council wishes to be present at the community meeting you
should comply with the requirements of the Brown Act. An agenda
bill should be prepared and placed before the Council at your
meeting of May 25, 1987. The agenda bill should reflect the
proposed community meeting on June 1, 1987 giving the time and place with an indication that the purposes of the agenda item
were to be a general discussion of City programs relating to the neighborhood. At the conclusion of your meeting of May 25, 1987 you should adjourn the City Council meeting to the comm.unity meeting, Compliance with the Brown Act means that the public and press would be free to attend. Beyond that it wouldn't be necessary to go through any of the meeting formalities on June 1st. The Mayor or other council member in attendance could note
the times of the meeting, the council members in attendance and
note that a general discussion occurred of matters of interest to that community for inclusion in the minutes.

Council has received the attached invitation to participate in a neighborhood meeting which will
be held on June 1, 1987.
Will you please advise whether this neighborhood
meeting falls under the Brown Act, and whether
more than two Council Members can be attenda-me
at the meeting. If this does fall under the Brown
Act, what guidelines would have to be followed to
allow more than two Council Members to attend?

I have organized a neighborhood meeting in order-to meet
with the members of the City Council and the Planning
