RECOMMENDED ACTION:
If Council concurs your action is to adopt Resolution No.9/03 declaring and designating Underground Utility District No.
10, Garfield Street between Elm and Grand Avenues.
ITEM EXPLANATION
On MayS9, 1987, the City Council adopted Resolution No. 9076
calling a public hearing on June 2, 1987, on the proposed Underground Utility District No. 10. Notices of the hearing have been mailed to affected property owners and utility companies as required by ordinance.
After interested parties have had the opportunity to speak, the Council may determine that the public health, safety and
welfare require removal of overhead lines and the installation of underground utilities.
If the district is formed, San Diego Gas and Electric will prepare plans and obtain permits. The undergrounding will be done in conjunction with Garfield Street Parking Lot construction. The dates when properties must disconnect from overhead lines and when the overhead lines will be removed will be established by Council as soon as a definite construction schedule has been established.
Estimated cost of conversion is $15,000-20,000 which will be paid from the City’s unallocated balance of $398,950 in Title
20 funds available from San Diego Gas and Electric. Individual hook-ups of approximately $1,000 will be paid by
property owners.
FISCAL IMPACT
The estimated $15,000-20,000 cost will be paid by funds made available from San Diego Gas and Electric Title 20 Conversion Funds. Utility hook-ups will be paid by individual property owners.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DECLARING AND DESIGNATING GARFIELD
STREET BETWEEN ELM AND GRAND AVENUES AS UNDERGROUND
UTILITY DISTRICT NO. 10.
WHEREAS, on May 19, 1987, the City Council of the City
of Carlsbad, California adopted Resolution No. 9076
expressing its intent to initiate proceedings pursuant to
Chapter 11.08 of the Carlsbad Municipal Code and calling a
public hearing to determine the necessity for formation of an
Underground Utility District in a portion of Carlsbad; and
WHEREAS, pursuant to Resolution No. 9076 a public

hearing was held on June 2, 1987, at 6:OO P.M. in the Council
Chambers, Carlsbad, Carlsbad to ascertain whether public
health, safety or welfare required the removal of poles,
overhead wires and associated overhead structures and the
underground installation of wires and facilities for
supplying electric, communication or similar or associated
service, within that certain area of the City known as
Garfield Street between Elm and Grand Avenues as shown on the
attached Exhibit A" attached hereto and made a part hereof;

WHEREAS, said hearing was also held to determine if the
City should proceed to create and implement said underground
utility district to accomplish said removal and installation;
and
WHEREAS, notice of said hearing was given in the manner
and time required by law to all affected property owners and

WHEREAS, said hearing has been duly held and all

interested persons have been given an opportunity to be

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, as follows:
1. That the above recitations are true and correct.

welfare require the removal of poles, overhead wires and

associated structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in the above described area.

affected utilities and all persons owning real property within Underground Utility District No. 10 of the adoption of this resolution within five (5) days after

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF -BAD, CALIFORNIA EXPRESSING ITS INTENT TO INITIATE
PROCEEDINGS PURSUANT TO CHAPTER 11.08 OF THE CARLSBAD MUNICIPAL CODE AND CALLING A PUBLIC HEARING TO DETERMINE WHETHER THE PUBLIC HEALTH, SAFETY OR WELFARE REQUIRE THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT IN GARFIELD
STREET BETWEEN ELM AVENUE AND GRAND AVENUE.
WHEREAS, Chapter 11.08 of the Carlsbad Municipal Code
provides for the formation in the City of Underground Utility
Districts to accomplish the orderly removal of existing
overhead facilities and the construction of new underground
facilities; and
WHEREAS, City staff has consulted with affected
utilities on the feasibility of such a district in Garfield
Street between Elm Avenue and Grand Avenue; and
WHEREAS,. preliminary staff studies indicate further
proceedings pursuant to Chapter 11.08 are warranted;
NOW, THEREFORE, BE IT RESOLVED by the City of Carlsbad,
as follows:
13 The Council hereby expresses its intent to initiate
proceedings for the formation of Underground Utility District No. 10.
Notice is hereby given that a public hearing will be
held by the City Council of the City of Carlsbad on June 2, 1987, at the hour of 6:OO P.M. in the Council Chambers of the City Hall, Carlsbad, California, to ascertain whether the public health, safety, or welfare require removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communications, or similar associated service in the area hereinabove described and to determine if the City should continue proceedings to create and implement and underground utility district to accomplish said removal and installation.
