PEDESTRIAN ONLY REGULATION FOR
CARLSBAD SEAWALL

RECOMMENDED ACTION:
Adopt Ordinance No. 3a I,? .
ITEM EXPLANATION
This agenda bill and ordinance was prepared at the request of
Mayor Pro-Tern, Ann Kulchin. Ordinance No. .?a 1'3 is an
urgency measure, a four fifths vote is required and it will go
into effect immediately. The ordinance would impose a pedestrian
only requirement for the Carlsbad Seawall between Tamarack and
Pine. It would prohibit bicycles, skateboards and any other form
of device from using the walk. The facts and circumstances
constituting the urgency are set out in the ordinance. If the
City Council concurs your action is to adopt Ordinance
No. 34!7 (We are also using this opportunity for a little code maintenance. Chapter 11.24 contains the regulations for use
of the City's parks but is presently titled aquatic areas and
devices, that has been corrected to Parks and Recreational Areas. )

XN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSRAD, CALIFORNIA, AMENDING TITLE 11,
CHAPTER 11.24 OF THE CARLSRAD MUNICIPAL CODE BY
THE ADDITION OF SECTION 11.24.145 TO IMPOSE A PEDESTRIAN ONLY REQUIREMENT ON THE CAF.LSRAD
SEAWALL.
WHEREAS, the City of Carlsbad has just completed and
opened to the public a walkway along the seawall adjacent to the
Carlsbad State Beach between Tamarack Avenue and Pine Street in
the City of Carlsbad; and
WHEREAS, the walkway is narrow and constrained by walls
on both sides, it is being used by bicyclist and skateboarders
which conflicts with the safe passage of pedestrians creating the
potential for injury to persons using the walk; and
WHEREAS, it is necesary that this ordinance be effective
immediately upon adoption in order to protect the health and
safety of the community, by preventing and protectinq persons
from injury,
NOW, THEREFORE, the City Council of the City of
Carlsbad, California does ordain as follows:
SECTION 1: That Title 1, Chapter 11.24 of the Carlsbad
Municipal Code is amended by the addition of Section 11.24.145 to
read as follows:
"11.24.145 Carlsbad Seawall - Pedestrian Only. The
Carlsbad Seawall sidewalk at the base of the bluff adjacent to
Carlsbad State Beach between Tamarack Avenue and Pine Street
shall be limited to pedestrians only. No person shall skate or
use or ride any rollerskate, coaster, skateboard, bicycle, toy
vehicle or any other form of transportation on the Carlsbad
Seawall sidewalk." ...
SECTION 2: This ordinance is hereby declared to be an
emergency ordinance adopted as an urgency measure to protect the
public health, safety and welfare and shall take effect
immediately upon its adoption. The facts constituting the
emerqency are set forth above and represent a serious threat to
the citizens of Carlsbad.
EFFECTIVE DATE: This ordinance shall be effective
immediately upon passage. The City Clerk of the City of Carlsbad
shall certify to the adoption of this ordinance and cause it to
be published once in the Carlsbad Journal within 15 days after
its adoption.
INTRODUCED, PASSED AND ADOPTED at a regular meeting of
said City Council held on the 16th day of June I
1987 by the following vote, to wit:
