TITLE:
ACCEPTANCE OF PUBLIC IMPROVEMENTS
OF SPINNAKER POINT
(CARLSBAD TRACT NO 74-04)
RECOMMENDED ACTION:
Accept the public improvements, authorize the City Clerk
to release bonds, and direct the Utilities and Maintenance
Department to commence maintaining the public improvements
associated with Carlsbad Tract No. 74-04 (Spinnaker Point).
ITEM EXPLANATION
The developer has constructed all improvements required of
this project and has requested to City to accept the public
improvements listed in Exhibit 3.
The improvements have been inspected by City forces and
found to be satisfactory.
FISCAL IMPACT
The Utilities and Maintenance Department will be required
to maintain the public improvements. The value of the
improvements is estimated at $1,853,169.00.

Tract 74-4 (Quail Ridge-Spinnaker Point)
Dear Mr. Hubbs:
Enclosed herewith are copies of the following bonds on file with
the City of Carlsbad for the subject tract:
Bonding Surety: The American Insurance Company
1. Bond #712-0830; Faithful Performance $2,191,491.00
Bond #712-0830; Labor & Material $1,095,745.50
2. Bond #712-0831; Grading & Erosion Control $1,599,728.00
3. Bond #712-0833; Faithful Performance $224,688.00
Bond #712-0833; Labor & Material $112,344.00
(This bond secures improvement of Elm Ave. offsite, on the east
side and adjacent to C.T. 74-4)
4. Bond #712-0834; Monumentation $26,500.00
5. Bond #712-0835; Faithful Performance $25,000.00
Bond #712-0835; Labor & Material $12,500.00
(This bond secures payment of $25,000.00 contribution toward
construction of signals at Elm Ave. and El Camino Real. These
signals have not been installed as of this date.)
These bonds were all issued May 28, 1981, and are coming due for
another renewal on May 28, 1987. All improvements and grading have
been completed and all homes constructed and sold.
We respectfully request your staff review the project for acceptance
by the City and the issuance of warranty bonds as required.

We have additionally enclosed a copy of Bond #712-0832-A in the
amount of $300,000.00 which acts as surety for construction of
water main improvements. We are contacting Bill Blakesley for
exoneration of this bond.
We would be pleased to have one of our superintendents meet with
your staff as soon as possible to expedite any necessary pick-up
work. Please feel free to call at your convenience. There are
substantial premiums involved for the bond renewals which we would
hope to avoid.
