RECOMMENDED ACTION:
1. Direct staff to take actions necessary to improve and open a
new public access that is located in the eastern portion of
Agua Hedionda Lagoon, for walk-in traffic only.
2. Establish a 50 foot restricted buffer zone and create separate
areas for jet skis and boardsails in the AHL Special Use Area.
3. Direct staff to review Chapter 11.24 "Aquatic Areas and Devices"
of the Carlsbad Municipal Code and to revise and update the Code
to incorporate current operating policies, and accurately reflect
current changes by the Council.
ITEM EXPLANATION
On June 16, 1987 the City Council considered a request to allow
boardsailors on the inner Agua Hedionda Lagoon on a year round
basis. After discussion and hearing testimony from boardsail,
waterskiing and other water related enthusiast, Council directed
staff to explore access and parking as they relate to boardsailing
and to make revisions to the ordinance that would reflect current
operating procedures.
Staff has met with Planning, Engineering and the Risk Manager to
discuss and analyze a public access that was dedicated to the
State Land Department in January 1987. This 25 foot unimproved
easement runs from Park Drive 500 feet south to the Lagoon shore
with a 25 foot wide beach front access parallel to the water.
Parking for approximately 35+ cars can be accommodated in the
right-of-way adjacent to Park Drive.(Exhibit 1)
In staffs opinion, with certain improvements and approvals and at
a cost of less than $5,000 this subject easement with grading and
fencing could be made into a passible access for passive water
users.
ALTERNATIVES
The alternatives presented have been discussed with the Risk
Manager and are listed in order of increasing liability exposure
with regards to mixed use activities on the lagoon.
1. All passive use of Agua Hedionda Lagoon
2. All active use of Agua Hedionda Lagoon
3. Designate the existing "Special Use Area" for exclusive use
of both jet skis and boardsails based on a time-of-day use all
year round ie: (Exhibit 2)
7:00 a.m. - 2:00 p.m. - Jet Skis Only
2:00 p.m. - 6:00 p.m. - Boardsails Only
6:00 p.m. - Sunset - Jet Skis Only

4. Designate the area approximately 200 feet east of Bristol Cove
Marina entrance as an all "Special Use Area". This area would
then be divided into two separate areas; the eastern section
would allow boardsails and other passive use and the remaining
section would allow for jet skis.
The two use areas would be separated by a 50 foot restricted
buffer zone designated by bouys and posted with signs. The
only authorized use within this zone would be for lagoon
patrol, and research purposes. Any non-authorized use within
this zone would be subject to appropriate fines and/or exclusion
from use of the Lagoon. (Exhibit 3)
A corridor for jet ski transit from Snug Harbor Marina would
need to be established along the southern most portion of the
Lagoon.
Although the alternatives are listed in order of increasing liability
exposure, Parks and Recreation staff is recommending Alternative #4.
By creating a restricted buffer zone, staff feels liability exposure
has been mitigated to the best of our ability while accommodating
requests for all mixed uses.
FISCAL IMPACT
Access improvements, grading and fencing and additional buoys can
be done by a combination of City forces and volunteers at a cost
of less than $5,000. Funds are available in the Parks and Recreation
operating budget (001-820-4121-2330).

AGUA HEDIONDA LAGOON - BOARD SAIL ISSUE
BACKGROUND
On July 23, 1987 staff met with representatives of various user
groups to work out an agreement for expanded use of the lagoon
by board sailors that would solve the City's liability concerns
and best meet the users' wishes.
The Risk Manager, Bob German, and the Snug Harbor Marina Operator,
Roxanne Rusing were also present.
A goal was established to work out an alternative that would meet
the users needs, simplify the existing procedures and to mitigate
the City's liability concerns.
After considerable discussion that required give and take, those
present unanimously agreed to the following:
RECOMMENDATION
1. Adopt and modify the existing ordinance that would divide the
AHL inner lagoon into three (3) separate use areas on a year-
round basis as outlined in the agreement and on Attachment (A).
2. The City establish a public access at the NE Section of the
Lagoon as soon as possible.
3. The slalom course will remain in the SUA with a condition that
it will not be used if there is any passive activity.
4. That the City actively pursue developing other resources, i.e.,
Batiquitos Lagoon or Lake Calavera, for passive uses.
AGREEMENT
1. JET SKI AREA:
Jet skiing will be allowed only in the Snug Harbor Marina area,
north of the sandbar;
Jet skiers who live in Bristol Cove will follow the northern
shoreline when going to and from Bristol Cove to the Jet Ski
area at a reduced speed, not to exceed 15 MPH;

A corridor along the eastern shoreline provides a 5 MPH lane
for transit of vessels to and from the other areas of the
lagoon from the launch ramp and jet ski area;
2. WATER SKI AREA:
All powered vessels will be allowed only in the middle area
of the Inner Lagoon, south and east of the sandbar, extending
east to the buoys designating the Special Use Area;
Power vessels will follow the counter-clockwise traffic pattern;
No water skiing "take-offs" or "drop-offs" will be allowed in
the Snug Harbor Marina area, north of the sandbar;
All water skiers will start from either deep water or south
beach shoreline starts; deep water starts will be inside the
continuing traffic pattern; continuing traffic has priority
over "take-off" traffic;
3. SPECIAL USE AREA:
The Special Use Area, in the eastern end of the Inner Lagoon,
will be designated for use by all non-motorized vessels and
fishing from shore will be allowed only in the Special Use Area;
The existing water ski slalom course will be allowed to remain in
the Special Use Area with a condition that slalom skiing will
occur ONLY when NO PASSIVE VESSELS ARE ON THE WATER.
4. EXTENDED HOURS OF OPERATION:
Water skiing may occur % hour after sunrise and will stop %
hour before sunset;
After sunset, the maximum speed on the lagoon is 5 MPH and
vessels must comply with the California Boating Laws;
5. MAXIMUM NUMBER OF VESSELS:
The maximum number of vessels on the water at one time establish
the intended safe limits; these recommendations may be changed
by the Patrol, in order to insure the safety and enjoyment of
all participants; {in the absence of the Patrol, the Marina
Operator will be responsible for limiting the launch of vessels
that would exceed the maximum number):
Power Boats: maximum 30
Board Sails: maximum 20
Jet Skis: maximum 10

6. APPROVED TYPES OF VESSELS:
The City may deny use to any new type of vessel in the interest
of safety on the entire Inner Lagoon, which is designated as
a "Special Use Area" and "Inland Waters" of the State of
California;
Vessels not presently approved for use must request approval
from the City prior to obtaining a permit or being on the water;
Parasails and hover craft are excluded;
7. PUBLIC ACCESS:
Unless otherwise posted, a public access around the lagoon is
for walk-in use only; no motorized traffic, no overnight camping,
no parking is allowed; no swimming or wading is allowed;
The City will direct staff to take actions necessary to provide
a new public access at Park Drive with parallel parking on the
unimproved right-of-way along the south side of Park Drive,
adjacent to the new access; the fiscal impact to improve the
access has been identified as under $5,000.
SUMARY AND CONCLUSIONS
The number of lagoon users is increasing and the mixed use on this
small body of water has been an escalating concern to the City.
The interested participants have met and compromised their wishes
in the goal of making the lagoon a safe place for use by all the
special interest groups. Staff commends those who volunteered their
time to solve the complex issues and arrive at a concensus.
Staff urges the City to actively pursue developing other resources,
i.e., Batiquitos Lagoon and Lake Calavera, for passive uses as a
means of further reducing the mixed use on Agua Hedionda Lagoon.
The staff will review Chapter 11 of the Carlsbad Municipal Code and
recommend other changes, including permit fees, to update the municipal
code.

Public Easement from Park Drive
Council Members,
I am writing this letter as a representative from the Laguna del
Mar Homeowners Association, which consists of 112 homes located
on the north side of Park Drive, the Tarut residence (4730 Park
Drive), and the tfenner residence (4720 Park Drive).
We are currently against the proposed opening of the 25 foot
easement accessing the Agua Hedionda Lagoon from Park Drive. As
community members who live closest to the proposed easement area
we are forced to deal with the problems resulting from the
current illegal use of the easement and are concerned that the
following list of problems will escalate.
1. Easement is placed next to a blind curve,
which already has resulted in several accidents.
A designated parking area using a portion of the
unimproved street would seriously increase
accident rate in this area.
2. Loitering - There are currently people using the
easement at all times of day and night who are
not there to sail board. There is also a noise
problem with loud radios, dirt bikes, & autos.
3. Littering - There is currently a problem with
litter along Park Drive and at the Lagoon
shoreline. Increased use would only contribute
to this problem.
4. Dust - The proposed improvement calls for a
dirt parking lot. The current use of this
easement area causes a major dust problem for the
surrounding residences. Increased use of this
dirt area by motor vehicles would be untolerable
with the constant breeze.

5. Security - How would the area be secured during
and after hours and access limited to passive
users?
Agua Hedionda Lagoon is a unique water recreation area and we
believe there should be public access that contributes to the
beauty of the lagoon and serves all of the community. We propose
that if the public access from Park Drive is to be granted that
the following items be addressed to insure a quality improved
area.
Traffic Impact Study - Review current traffic problems
on Park Drive, easement access next to a blind curve,
and make recommendations for vehicular and pedestrian
safety.
Ecological Impact Study - Review impact of increased
activity to the lagoon shore/cliff line in this area.
Security - Have a person present to restrict easement
use to passive vehicles only and secure the area at
sundown.
Improvements - Pave the parking area, install trash
cans and restrooms to be maintained by the city. Plant
greenery to screen the parking lot and contribute to
the beauty of the lagoon.
In summary, we are against the current plan to open the Park
Drive easement to the Agua Hedionda Lagoon due to problems with
safety, loitering, and asthetic values. We feel that this public
easement should be treated as one of Carlsbad's City parks, to be
enjoyed safely by all of the community and contributing to the
beauty of the area.

Dear Mr. Mayor and Council Members:
Business obligations require my presence out of state, so I am
not able to present my support in person. I do, however,
appreciate your hearing my views.
I represent the Bristol Cove Boat & Ski Club. The club was
organized four years ago to promote safe boating on the lagoon
and to sponsor such events as Annual Lagoon Clean-Up Days,
water ski tournaments, water ski clinics, the Christmas Parade
of Lights, to maintain the slalom course, the ski and
volleyball beach, and to represent the lagoon boating
community in instances such as this. The club has a
membership of approximately sixty families who reside almost
exclusively in Bristol Cove.
The proposal before you from the Parks and Recreation
Department which, based on my understanding from the July 23
meeting in council chambers, is to set up three areas in the
lagoon as follows:
Area 1 - Snug Harbor Area, bounded by the sandbar at the
eastern end, would be for exclusive use by jet skis; boats
would have access at 5 m.p.h. only.
Area 2 - Middle sector of Lagoon, bounded by the sandbar on
the west and the Special Use Area buoys on the east, would be
for the exclusive use of power boats.
Area 3 - Special Use Area, bounded by the special use buoys to
the west, would be for the use of passive vessels and the
slalom course. Passive vessels have priority; and any time a
passive user is present, the slalom course would be strictly
off-limits to power boats.

As President of the Bristol Cove Boat & Ski Club, I am in full
support of this proposal as submitted. During the July 23
meeting with all user groups represented, we received
unanimous support for this proposal. In my opinion, this is
the best possible compromise given a limited and very popular
resource.
