ITEM EXPLANATION This petition is being presented to the City Council requestin! authorization, under Section 21.90.120(d) of the Carlsbad Municipal Code, for a group of owners to prepare a Local Facilities Management Plan. The Council has previously receivc similar requests from Zones 15, 20, and 22. For each of those requests, and this request, staff believes the following considerations should be made prior to rendering a decision: I. Is the development of this area of the City premature? REQUEST REVIEW 1. Ninety-nine percent of the property owners have agreed to have the local plan prepared. 2. There is one approved project and one pending project that are being held up until the adoption of a Local Facilities Management Plan. 3. The petitioners have made a reasonable attempt to discuss their desire to prepare a local plan with the one propert) owner who has not given authorization to do the plan. Of the 288 acres which make up Zone 25, this one owner has a single parcel of 3.1 acres. The other property owners have also agreed to pay for all costs associated with the plan and not to have this one owner required to pay a proportional share of the plan preparation costs. 0 0 Page Two of Agenda Bill No. Y/e-,L: 4. Attached is a zone map and letters of authorization from all but one property owner. As indicated on the map, the property owners who have authorized the plan's preparation comprise 99% of the zone's land area. The outstanding ownershi (Caron) is 3 acres in size and is developed with a residence. Several effo have been made by me and one other property owner to secure the remaining authorization without success. Carlsbad's Growth Management Ordinance Section 21.090.120(d) provides for petitioning, by cooperating property owners, to the City Council for author ization of the zone plan's preparation. As the authorized representative o Carlsbad Professional Park (Parcel 167-040-24) and Joe Sherman (Parcel 167-040-32) I request that you set this matter for public hearing before th Carlsbad City Council. I also request that the Lightfoot Planning Group be designated as the plan preparer.
