RECOMMENDED ACTION:
If the City Council wishes to require that meetings of all of
City's boards, commissions and committees be open to the pub1
action is to introduce Ordinance No. 129.7
ITEM EXPLANATION
The municipal code which creates the City's standing boards a
commissions delegates to them the authority to adopt their oh
procedural rules. There is no requirement in the municipal c

ORDINANCE NO. 1297
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 2, CHAPTER
2.08 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITI
OF SECTION 2.08.110. TO REQUIRE ALL MEETINGS OF T€
CITY'S BOARDS, COMMISSIONS AND COMMITTEES TO BE
OPEN TO THE PUBLIC.
The City Council of the City of Carlsbad, Califor
does ordain as follows:
SECTION 1: That Title 2, Chapter 2.08 of the Cai
Municipal Code is amended by the addition of Section 20.08
to read as follows:
"2.08.110 Public access to meetings. (a) All meetings of the City's boards, commissi< committees shall be open to the public. If any board or commission appoints a subcommittee all meetings of the
subcommittee shall be open to the public. This section SI
apply to the Personnel Board when, upon the advice of the
Attorney, the commission determines a closed session is
required.
(b) Notwithstanding subsection (a) a board, comr
or committee may hold a closed session provided they first a written opinion from the City Attorney that the closed :
is allowed under the provisions of the Brown Act."
