City Council hear objections of property owners concerrting costs of weed abatement activity on their properties. 2. Adopt Resolution No. 9/££ for abatement and directing the copy of the Resolution with the August 7, 1987. ITEM EXPLANATION: approving the cost assessments City Clerk to file a certified County Auditor on or before Council's Resolution 9027 of April 21, 1987, directed the City Manager to abate nuisances on 1408 parcels throughout the City. The abatement has been completed and the cost assessments determined for each parcel cleaned by the City contractor. The assessment includes the contractors charge plus the administrative charge of $54 per parcel. The total for each parcel will be forwarded to the County Auditor for inclusion in the property tax bill. FISCAL IMPACT: All contractor's fees plus administrative costs incurred by the City which can be attributed directly to a particular parcel are recovered. Typically the cost recovery rate is 88%. Unrecovered costs for FY86-87 total $5,304.97. Under Council's current policy, owners who respond to Council direction and abate their hazards are not charged administrative fees. Staff feels this policy is sound and recommends it be continued. However, as a result of Council's interest in improving the cost recovery rate, staff will implement a data management system which will allow staff to identify all vacant parcels requiring abatement without a physical inspection of the property. Due to this significant reduction in personnel costs, staff expects next year's recovery rate to increase to 96%. EXHIBITS: 1. Resolution No . 2. Cost List RESOLUTION NO. 9184 ----- l A RESOLUTION OF THE CI'T'Y COUNCIL OF THE CITY OF CARLSBAD CALIFORNIA, CONFIRMING THE REPORT OF THE FIRE CHIEF SHOWING 2 COST OF WEED ABATEMENT AGAINST EACH PARCEL OF LAND IN SAID REPORT, CONFIRMING THE COST, AND PROVIDING FOR COLLECTION 3 ON THE REGULAR TAX BILL 4 WHEREAS, on April 7, 1987 this City Council adopted Resolutio 5 No. 9006 pursuant to Government Code Sections 39501 through 59588 6 declaring weeds, rubbish, refuse and dirt on the real property 7 described therein to be a public nuisance; and 8 WHEREAS, pursuant to said resolution, a hearing was held 9 by said City Souncil, and thereafter said City Council adopted 10 Resolution No. 9006 directing the fire chief to abate the nuisance 11 by removal of the weeds, rubbish, refuse and dirt on the real 12 property described in said resolution; and 13 WHEREAS, California State Government Code Section 39560, et. 14 seq., requires that a report of the cost of such abatement be 15 submitted to the City Council for consideration and confirmation 16 following a public hearing, and the fire chief has kept the 17 required accounts and has submitted his report to the Council 18 for confirmation; and 19 WHEREAS, said work has been duly performed in accordance with 20 said resolution, and a Notice of Time of Hearing has been posted 21 on or near the Chamber door of this City Council in the manner 22 and form required by law; and 23 WHEREAS, at the appropriate time and place said report was 24 received and considered for confirmation by this City Council, 25 at which time all protests and objections were heard, and this 26 City Council gave all persons present an opportunity to be heard 27 in respect to any matter relating to said abatement work; and 28 / / i: l WHEREAS, all persons desiring to be heard have been heard 2 by this City Council. 3 NOW, THEREFORE, BE IT RESOLVED by the City Cou~cil of the 4 City of Carlsbad as follows: 5 6 1. That the above recitations are true and correct. 2. That the abatement work, the report submitted to this 7 Council, and the posting of the Notice of Time and Hearing on said 8 report were duly and regularly performed in the manner and time 9 required by law. 10 3. That all protests and objections, other than those 11 heretofore allowed and deleted from said report, if any, were and 12 are hereby overruled and denied. 13 4. That said report, a copy of which is on file in the office 14 of the City Clerk, and by this reference made a part hereof, is 15 hereby confirmed, and each of the amounts set forth therein are 16 hereby assessed against the parcel of real property shown with 17 said sum and shall constitute a special assessment and a lien 18 against such parcel of land. 19 5. PUBLIC HEARING TO HEAR PROTESTS TO COST ASSESSMENTS AND ADOPTION OF RESOLUTION CONFIRMING COSTS AND PROVIDING FOR COLLECTION _ST NOTICE IS HEREBY GIVEN that on the 7th day of April 1987, the City Council of the City of Carlsbad passed a resolution declaring that noxious or dangerous weeds were growing upon or in front of the property on certain streets in the City as described in the resolution, and that rubbish was upon or in front of said property, and that the weeds and rubbish constitute a public nuisance which must be abated by the removal of the weeds and rubbish. Otherwise, they will be removed and the nuisance will be abated by the City and the cost of removal assessed upon the land from or in front of which the weeds or rubbish are removed and will constitute a lien upon such said land until paid. (NOTE: PROPERTY OWNERS WITH SPECIAL CLEANING PROBLEMS MUST CONTACT THE CITY FIRE MARSHAL PRIOR TO April 21, 1987). Reference is hereby made to said resolution for further particulars. A copy of the resolution is on file in the Office of the Cicy Clerk. All property owners having any objection to the removal of such weeds are hereby notified to attend a meeting of the City Council of said City on April 21, 1987 at 6:00 p.m. when their objections will be heard and given due consideration. A public hearing is scheduled at 6:00 p.m. on August 4, 1987 by the City Council of said City to consider the Weed Abatement Cost Report. In conformity with the provisions of Sections 39560, et. seq., of the California Government Code, you are hereby notified to remove such vegetation and refuse from the above mentioned property by May 27, 1987. Poster notices will not be placed on the property. Please refer to the notice on the reverse side of this letter. Property cleared and maintained free of flammable vegetation and refuse that complies with the requirements listed on the enclosed Fire Prevention Information Sheet is not subject to further action by this department. After May 27, 1987 property that is not cleared and maintained by the owner is subject to being cleared by City contracted crews as manpower and equipment are available. THE COST FOR CLEANING, PLUS AN ADMINISTRATIVE CHARGE OF APPROXIMATELY $45 WILL BE ADDED TO THE OWNER'S TAX STATEMENT. The condition of property not cleared by City contracted crews remains the responsibility of the owner and legal action may be initiated to enforce applicable regulations.
