Accept improvements, authorize City Clerk to record th Notice of Completion, release construction performanc
bonds, and direct the Utilities and Maintenance Departmen
to commence maintaining the storm drain improvement adjacent to Batiquitos Lane.
ITEM EXPLAWATION
As a condition of approval for Carlsbad Tract 73-2 (Pacesetter) the developer was required to install an off site storm drain improvement down Batiquitos Lane t mitigate the projects storm water drainage. The develope has completed the storm drain improvement and now request the City to accept the improvements. City forces ha\ inspected the storm drain and found it to be satisfactor]

City to accept the basin improvements or to relieve thc
from the maintenance responsibility at this time. The Cil has an agreement and bond with the Developer for tl maintenance of the desiltation basin. The bas:
maintenance will continue to be the responsibility ( Pacesetter Homes until such time as the City Enginet determines all associated project slopes are stabilized.

RE: Batiquitos Drive Desiltatisn Basin and Storm Drain System from Pacesetter project tc Lagoon.
Dear Mr. Wickharr:
We are once again reques:ing that the Ci-;y of Carlsbad consider
accepting the maintenance and ownership of the Desiltation Basin,
the storm drain pipe in Batiquitos Drive and the outlet structure
all as constructed by t'le iyprovement pl(ins numbered 227-2 (6 of
6 sheets),
These plans have been "As 3uilt" and accepted by the City.
Enclosed is a copy of your letter dated December 6, 19E4 in which
you answered our previoJs request to consfder the above inquiry.
As I understand the sitJat'on has changed some what in that the
County is or has turned over to "_e City all of the drainage
systems that they maintained.
Please elaborate ilpon the conditions undt2r which the City will
accept the maintenance os ti?e Desiltation Basin, the drainage
system and the outlet sti-3ctJr-e at the L(1900n.
Please specify any time limits involved,
