RECOMMEN,DED ACTION:
Adopt Resolution No, 9.:lo'I, supporting AB 2505 (Stirling) and authorize the
Mayor to send Resolution No, 2-2 0 ':/ to the appropriate individuals.
ITEM EXPLANATION:
AB 2505, as originally written, would have increased the County share of fine
and bail forfeiture revenue to 50% of monies collected. Currently, the County
only receives 8% of Carlsbad's fines and forfeitures, The additional revenue
to the County was earmarked for the construction of criminal justice facilities.
After a strong lobbying effort from the cities of San Diego County, Assembly-
man Stirling amended AB 2505. All language regarding the reallocation of fines
has been deleted, AB 2505 now provides for the creation of a limited purpose
special district to fund the construction of criminal justice facilities through a
¼-cent sales tax to be approved by a majority of the voters. This sales tax
would raise approximately $100-milllon per year.
The proposed resolution exhibits the City's good faith in working with the
County to resolve the problem of inadequate criminal justice faclllties.

RESOLUTION NO. 9204
l A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, SUPPORTING
2 ASSEMBLY BILL 2505 (STIRLING)
3 WHEREAS, AB 2505 (Stirling) provides for the creation of a limited
4 purpose special district to fund the construction of criminal justice facilities
5 In San Diego County; and
6 WHEREAS, the City Council of the City of Carlsbad recognizes the crisis
7 In the criminal justice system In San Diego County and supports the creation
8 of a limited purpose special district as the appropriate vehicle to fund the
9 construction of jail and courtroom facilities;
10 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
11 of Carlsbad, California, hereby expresses its support for AB 2505 (Stirling)
12 and urges its approval by the legislature and the Governor.
BE IT FURTHER RESOLVED, that Assemblyman Stirling is commimded
14 for his efforts In resolving this crisis and his willingness to make possible
15 the cooperation of the cities and the County in this important effort.

Thank you for your letter on AB 2505. I, of course, did not expect any
city to welcane a revenue loss. But it seems to rne that a reflection on
the primary pm:pose of governnent is to protect the public health and
safety.
It is clear that we are failing to gain the public confidence in that
regard. One IDuld have to be deaf not to hear the Board of Supervisors,
the judges, and the Sheriffs' deputies ccy out for relief on the jail and
court house issue.
I am noving ahead everJ way that I can personally. As you know, I
fought the lawsuits and battles to implanent a superior and additional
Municipal Courts in East County and South Bay. As Chair of the Public
Safety Ccrrr."ittee, I shepherded 33 million dollars into San Diego County for
jails.
Through county w"histleblower sources, I identified several million
additional dollars in the county coffers that could be used.
Santee is, of course, bearing its fair share of the jail IDrkload for
our county, and I respect that. But the cities have a vested and direct
interest in protecting their constituents, they cannot stand by and watch
thousands of arrestees end scofflaws thumb their noses at the county,
state, and your city ordinances. '!'his is :i time when the cities have to
join shouldf!r-to-shoulder with the Board of Supervisors to solve this
problem. Will they meet the chaljenge? Will you ask the other mayors to
help? I hope so.
