processing Hillside Development
On February 10, 1987 the City Council approved the Hillside
Development Regulations, which added Chapter 21.95 to the
Carlsbad Municipal Code. Section 21.95.030 of the Hillside
Development Regulations requires the issuance of a Hillside
Development Permit for development on all properties with slopes
of 15% or more and an elevation differential of at least 15 feet
The Ordinance requires that a Hillside Development Permit be
processed and approved concurrently with any other development
permits required by Titles 11, 18, 20 or 21 of the Carlsbad
Municipal Code. All requests for Hillside Development Permits
must be accompanied by a detailed slope map as well as three
slope profiles. It will take some staff time to review these
exhibits to determine their accuracy. Staff will also have to
determine whether the proposed project complies with all of the
findings required for the issuance of a Hillside Development
Permit.
Staff recommends that the following fees based on acreage be
established for review of Hillside Development Permits.

This fee structure should generate sufficient revenue to cover
staff time required for the review of Hillside Development
Permits. As of this time only one or two single family homes
have applied for Hillside Development Permits. However, as Local
Facilities Management Plans are approved new applications for
large projects requiring Hillside Development Permits will be
submitted. Staff believes it would be timely to establish a fee
structure and modify the City's standard application form before
applications for Hillside Development Permits are submitted.

FISCAL IMPACT
The proposed fee should cover the cost of staff time required for
the review of Hillside Development Permits, therefore, the
recommended fee should have neither a negative or positive
impact.

RESOLUTION NO. 9208
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA AMENDING RESOLUTION NO. 7515 TO ESTABLISH A FEE
STRUCTURE FOR THE REVIEW OF HILLSIDE DEVELOPMENT PERMITS.
Be it Resolved, by the City Council of the City of
Carlsbad, California as follows:
1. That Resolution No. 7515 is amended by the addition of the
following fee schedule for the review of Hillside Development
Permits according to the applicable provisions of Title 21 of
the Carlsbad Municipal Code as indicated below:
Single Family Home No Charge
More Than One Single Family,
Multifamily or Non-Residential
Project sites of:
0 - 1 acre in size $ 50.00
1 - 10 acres in size $100.00
That the fees, except for appeals which shall be paid to the
City Clerk at the time the appeal is filed and deposited to
the appropriate Planning accounts, shall be paid to the
Planning Department at the time the Hillside Development
Permit is requested.
17 3. That the fees referred to in this resolution shall become
effective on August 18 , 1987.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 18th day of August
1987 by the following vote, to wit:
