Approve the attached offer of employment Ca Ray Patchett €or t
position of City Manager.
I ITEM EXPLANATION:
On September 8, 1987, the City Council appointed Mr. Ray Patcl to the position of City Manager for the City of Carlsbad.
The attached letter establishes the salary and benefits of thc appointment and provides for annual review and goal setting.
Mr. Patchett has accepted and agreed to the established terms,
FISCAL IMPACT:
The necessary funds for this appointment are contained in the
1987-88 Operating Budget within the City Manager's Department<

Dear Mr. Patchett:
On behalf of the City Council, it is my pleasure to officially offer you the position of City Manager for the City of Carlsbad.
It is my understanding that you are already familiar with the duties and responsibilities of the City Manager as set forth in the Carlsbad Municipal
Code. The purpose of this letter is to set forth the additional terms and
conditions of employment for that position and, execpt as otherwise provic
in this letter agreement, incorporate the provisions of the Carlsbad Munic
Code and Management Compensation and Benefit Plan (Attachment A).
1) Appointment - Your appointment will be effective retroactive to September 8, 1987.
2) Salary - Your base salary shall be $2,808 bi-weekly.
3) Redevelopment Pay - Your Redevelopment Pay shall be $100
per month.
4) Car Allowance - The City shall pay a car allowance of $250 per month.
5) Annual Review - The City Council shall review and evaluate the performance of the City Manager in January of each year. This review and evaluation shall be in accordance with the
criteria developed jointly by the City and the City Manager.
The Mayor shall provide the City Manager with a summary written statement of the findings of the City Council and
provide an adequate opportunity for the City Manager to
discuss his evaluation with the City Council.
6) Annual Goal Setting - Annually, the City Council and the City Manager shall define such goals and performance objec- tives which they determine necessary for the proper operation of the City, and an attainment of the City Council’s policy objectives. They shall also establish a relative priority among those various goals and objectives and this should be reduced
to writing.

7) Professional Development - All normal business expenses, such
as attendance at the League of California Cities, California
Redevelopment Association, and International City Managers
Association’s meetings and conferences, as well as business
lunches and dinners, etc., will be provided for separately in
the Operating Budget of the City Manager’s Office.
8) Severance - Should you be involuntarily terminated by the
City for any reason other than conviction of an illegal act
involving moral turpitude or personal gain to you, you will
be provided with six months of severance pay.
9) Management Development - The City Council concurs with your belief that the continuinq development and professionalism
6f the management team is important. ’ As such, the Council
supports your management development efforts, including but
not limited to, team training programs and at least one off-site
management seminar of not more than two nights per year in
Southern California.
This offer of employment is made with the approval and authorization of
the Carlsbad City Council.

MANAGEMENT COHPENSATION PLAN ~
I. INTRODUCTION. This dttdchment constitutes the Manaaement Compens
Plan (MCP). The MCP contains three parts, an introduction, d sch
benefits, and, d salary schedu1.e.
A. DEFINITIONS
1. Manaaement Employees. Management employees dre defined u provisLons of Carlsbdd Municipal Code Section 2.48.030 (7).
2. City Council Appointed Employees. The City Mandoer and C Attorney are hired by and responsible directly to the City Counci

II. SCHEDULE OF BENEFITS
. A. LIFE INSURANCE. All manaaement personnel shall receive City
insurance in an amount equal to two times the basic yearly earnin
determine benefits, the amount of insurance is rounded to the nex
$1,000 multiple, unless the amount equals a $1,000 multiple.
B. RETIREMENT. All management personnel sha!.l participate in th
Employees' Retirement System on the same basis as other employees
respective departments.
C. RETIREMENT CONTRIBUTION. All management employees shall have
portion of the retirement contribution to the Public Employees' R
System paid by the City, on the same basis as other employees of respective departments, as provided by Government Code Section 20
D. VACATION. All management employees shall earn vacation.on a equal to that of other employees in their respective department e

E. EXECUTIVE LEAVE. All manaaement personnel shall be eliaiblc to I

Lieutenant. A maximum of 56 hours per year are el.iqible for executil

As of 3uly 1, 1986, all manaaement employees will be required to earl executive leave on an hour per hour basis.
The City Manaqer is authorized to pay overtime to any management emp
who is required to work extended hours due to emergencies such as Pi
storms, floods, or other emeraencies. The position of Pol.ice Lieutei
shall receive overtime at the rate of time and one-half for actual h
worked.
F. SICK LEAVE. All management personnel shall be granted sick leav
basis equal to that of other employees in their respective departmen
G. SICK LEAVE CONVERSION. Any management employee who has accrued
maintains a minimum of one hundred (100) hours of sick leave shall t:
. permitted to convert up to twelve (12) hours of sick leave and
uncompensated sick leave to vacation at a ratio of three (3) sick le
days per one (1) day of vacation. The sick leave conversion option
vacation is not elected, earned sick leave will be added to the exis
total.

H. SEPARATION COMPENSATION. All unclassified manauernent employees
involuntarily separated from the City service due to budget cutbacks
layoffs, contracting'out of service or for other reasons not due to
misconduct which would justify involuntary separation for cause of a
permanent classified employee shall receive thirty (30) working days
salary computed at the salary ranae of the employee at the time of
separation.
I. HOLIDAYS. All management employees except for the position of P
Lieutenant, shall enjoy paid holidays in accordance with the schedul
eleven (11) established by the City Council.
The position of Police Lieutenant shall receive holiday pay at the I time and one-half in lieu of receiving holidays off. The Lieutendnl
charge of the police investigations division shall receive time and
half for all holidays actually worked.

3. MEDICAL, DENTAL AND VISION INSURANCE. The City will share the (
medical, dental, and vision insurance premiums. Any increase or de(
employee on the same basis as City and employee costs are divided ir
table in Exhibit A to the Manaqement Compensation Plan..

K. ANNUAL PHYSICAL EXAMINATION. All management employees shall be
eligible for reimbursement of up to the amount of three hundred fifi
dollars ($350) durino each fiscal year to pay the cost of an employt annual physical examination. Such examination may be accomplished t

shall be required to authorize the release of a copy of the results examination to the City Manager or his designated employee.
L. INCOME PROTECTION INSURANCE. All management personnel shall be
grdnted income protection insurance coverage equal to that provided
employees in their respective department. -Long-term disability is
available for all mdndgement personnel after 30 days of disability.
M. DEFERRED COMPENSATION. The City shall provide a deferred cornper
plan which may be utilized by any management employee. The City re?
the right to accept or reject any particular plan and to impose spec
.- conditions upon the use of any plan.
N, HEALTHY EMPLOYEE AWARD. The Healthy Employee Award is earned by
management employees using not more than one day of sick leave in a
calendar year period. Each employee earning this will be eligible f $100 Cash Award.
111. MANAGEMENT SALARY SCHEDULE.
The management salary schedule, attached hereto as Exhibit 8, shall
establish a salary range for each management position.
The City Manager shall have authority to determine the salary for ea
management employee within the salary range established for each
management position. The City Manager may delegate to department he,
of the department head.

January. Salary adjustments within the salary range shall be based ( performance; The salary level within the salary range of all mangemc
employees shall be reviewed in January. Salary adjustments shall be
at the discretion of the City Manager subject to any limitation or controls imposed by the City Council. The City Attorney shall have
authority to determine the salary level of the Assistant City Attornc
within the salary range established for the position.
Employees at the top of the range may be granted up to a 5% merit inc
above the existing range based on performance. Authority to grant
increases beyond the range would expire December 31 of the pay plan 1
