ITEM EXPLANATION The Cities of Carlsbad and Oceanside have been considering improvements consisting of an overcrossing of Highway 78 at Rancho Del Oro Road and the extension of Marron Road in the City of Carlsbad easterly to the Rancho Del Oro overcrossing. The proposed study will determine the financial feasibility of constructing these facilities through a benefit district that would pass the costs on to benefited property owners. The study will attempt to determine if these facilities can be built and financed through some public financing vehicle; if there is sufficient benefited area to support such funding; to define the benefits received by the various properties surrounding the area; to determine project cost estimates; and to prepare a preliminary spread of these costs to affected owners. Such a study would interface the two cities with CALTRANS and the major owners. The study will not create any obligation on the part of either city at this time other than the necessary coordination and cooperation in the preparation of the study itself. The study will also recommend which City should be the lead agency. FISCAL IMPACT Project proponents have deposited with the City $25,000 as an initial deposit to pay the costs incurred by the City under this proposed agreement. The Consultant, NBS/Lowry, will bill on an hourly rate and the fee will not exceed $25,000 without written authorization by the City Engineer and an additional deposit from the developers. The eighth supplemental agreement to an agreement between the City of Carlsbad and firm of NBS/Lowry for consulting assessment engineering8 services for the Rancho del Oro/Marron Road 78 overcrossing is hereby approved.9 2. RAUTENKRANZ, City Clerk (SEAL) 8TH SUPPLEMENTAL AGREEMENT TO AGREEMENT FOR ASSESSMENT ENGINEERING SERVICES DATED MARCH 13, 1985 (MASTER AGREEMENT) RANCHO DEL ORO/MARRON ROAD 78 OVERCROSSING AND CIRCULATION THIS 8TH SUPPLEMENTAL AGREEMENT to the above described agree- ment as approved by the City Council of the City of Carlsbad on March 19, 1986, hereinafter referred to as "Master Agree- ment", is made and entered into as of the /£ _ day of <^C^A^J _ , 1987, by and between CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as "City" and NBS/Lowry Incorporated, hereinafter referred to as "Consultant". RECITALS The Cities of Carlsbad and Oceanside recognize the need for improved circulation and access to State Highway 78 in the vicinity of Rancho Del Oro Road and the need to cooperatively investigate funding methods for providing said facilities. A financing feasibility study will identify areas of benefit, project costs and a preliminary spread of the costs to benefited property owners. The City requires the services of an assessment engineering consultant to prepare said study as hereinafter defined. Major property owners have indicated a willingness to provide the funding and will deposit with the City an initial sum of Twenty-five Thousand Dollars ($25,000). The project is described as: Rancho Del Oro Road/Marron Road - 78 overcrossing and circulation roads. -1- NOW, THEREFORE, City and Consultant mutually agree to supple- ment the above referenced agreement as follows: I. CONSULTANT'S OBLIGATION The Consultant shall review existing studies relating to the project, including traffic, environmental, costs, agreements etc., as said studies relate to the potential for public funding of said improvements. The Consultant will prepare a financing feasibility study for the project to include - a) Determine feasability for financing the construction of Highway 78 overcrossing at Rancho Del Oro Road and the extension of Marron Road by advance funding through sale of bonds in a benefit district. 1. Preliminary Spread b) Determine property owner acceptance. c) Review alternative funding processes. d) Consultant shall interface with major owners, Cities of Oceanside and Carlsbad and Caltrans. e) Develop data with respect to determination of future lead agency support (i.e., Carlsbad, Oceanside). f) Recommend tentative boundaries for a benefit district. II. ADDITIONAL SERVICES When authorized in writing by the City Engineer, Consul- tant shall perform or obtain from consultants or subcontrac- tors approved by City, additional services in connection with the Project not otherwise provided for in this Agreement. Said additional services shall be paid for by City as provided in Section 5 of the Master Agreement. III. PERIOD OF SERVICE Work shall begin immediately after receipt of notifica- tion to proceed by the City Engineer. Work shall proceed in a diligent manner to conclusion and estimated not to exceed Sixty (60) calendar days. Extensions of time may be granted by the City Engineer in accordance with Section 3 of the Master Agreement. IV. FEES TO BE PAID TO CONSULTANT City shall pay Consultant for services as hereinafter set forth. Schedule 1 A. It is recognized that this initial payment made to the City by the property owners is an estimate. Defining the total scope of work and the cost thereof at this time would be extremely difficult. Consultant shall perform services based upon hourly billing rates attached hereto. Consultant shall keep the City and property owners advancing funds appraised of progress and cost in a timely manner. -3- IN WITNESS WHEREOF, this Supplement to Agreement as dated above has been executed by the parties through their duly authorized representatives as of the date first hereinabove written.
