RECOMMENDED ACTION:
Adopt Resolution No. 72bJ- accepting the construction of the La
Costa Avenue Mitigation Project, No. 3233, as complete and
directing the City Clerk to record the Notice of Completion.
TITLE: NOTICE OF COMPLETION FOR
CONSTRUCTION OF THE
LA COSTA AVENUE MITIGATION PROJECT
ITEM EXPLANATION:
Construction of the La Costa Avenue Mitigation Project has been satisfactorily completed. The final contract amount of
$709,457.52 includes one (1) Change Order for $3,500, handled
administratively in accordance with Administrative Order No. 7,
for the cost of chain link fence approximately 650 linear feet
installed to protect newly planted areas from pedestrian and
vehicular traffic. The project's construction purchase order No.
3861 is recommended to be increased $10,597.52 for additional
grading quantities as a result of the material removal process.
This project was necessitated by approvals of the City's California Coastal Commission and U. S. Army Corps of Engineers
permits required to offset lagoon infill for the accompanying
intersection improvements to La Costa Avenue and El Camino Real,
as well as the future, ultimate widening of La Costa Avenue from
1-5 to El Camino Real. The project was completed prior to the
September 30, 1987 deadline established by both permitting agencies.
The City Council has previously approved a contract with Willdan
Associates and Westec Services, Incorporated, engineering and
environmental consultants, for a five (5) year mitigation
monitoring program also required as a condition of the City's
environmental permits. It is anticipated that during this period
of time a minor amount of replanting and irrigation system maintenance will be required within the enhanced wetland and
riparian areas. These contingencies have been previously
programmed into the project budget.

FISCAL IMPACT:
Funds in the amount of $902,250 have been previously appropriated
by the City Council for this project. A summary of the project
costs is as follows:

Total Project Costs $766,307.52
Current Appropriations 902,250.00
Remaining Project Balance $135,942.48

RESOLUTION NO. 9265
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION OF THE LA COSTA AVENUE MITIGATION PROJECT, NO.
3233 AS COMPLETE.
WHEREAS, the City Council of the City of Carlsbad has
deemed it necessary and in the public interest to offset lagoon
infill required by the California Coastal Commission and U. S.
Army Corps of Engineers' permits for the City's La Costa Avenue
improvements; and
WHEREAS, the City Council of the City of Carlsbad has
previously awarded a construction contract to fulfill the
aforementioned permit requirements; and
WHEREAS, the contractor for this project has
satisfactorily completed the installation of the lagoon
mitigation efforts;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the La Costa Avenue Mitigation Project
improvements are hereby accepted and
to record the Notice of Completion.

3. That the Purchasing Officer is hereby directed to
increase Purchase Order No. 3861 an additional $10,597.52 for
additional grading quantities as a result of the material
removal process for the project.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the Carlsbad City Council held on the 20th day of October
1987 by the following vote, to wit:

To All Laborers and Material Men and to Every Other Person Interested:
YOU WILL PLEASE TAKE NOTICE that on September 15, 1987
the engineering project consisting of the construction of
the La Costa Avenue Miticration Project on which William J.
Kirchnavy Construction, Incorporated was the contractor, and
Hartford Accident and Indemnity Companv was the surety, was
completed.
VERIFICATION OF CITY CLERK
I the undersigned, say:
I am the City Clerk of the City of Carlsbad; the City
Council of said City on 0- 40 1987 accepted the above
described work as completed and ordered that a Notice of
Completion be filed.
I declare under penalty of perjury that the foregoing is
true and correct.
