H CITY ATTY CITY MGR RECOMMENDED ACTION: Adopt Resolution No._T2£j7__ quitclaiming an easement for drainage and access easement to maintain drainage facilities. Adopt Resolution No. purposes. accepting a Grant Deed for drainage ITEM EXPLANATION As a condition to the approval of Carlsbad Tract 82-26, the developer was required to install new drainage facilities and abandon a portion of the existing drainage facilities. This requirement is due to the location of the buildings on this site. The grant deed for drainage purposes is necessary to accommodate the extension of the existing drainage channel to its terminus adjacent to the La Costa Golf Course. With the construction of the open channel, the existing easement for drainage and access to maintain drainage facilities is no longer necessary. This easement was originally dedicated to the San Diego County Flood Control District on Map No. 7784. EXHIBITS 1. 2. Location Map. In granting its approval the Grantee, its successors and assigns, may impose reasonable con ditions including, but not limited to, the filing by the contractor or Grantor of an adequate performance bond to guarantee completion of the work. There is reserved to the Grantor, his successors and assigns, the right and privilege to use the above described land of the Grantor at any time, in any manner and for any purpose not inconsistent with the full use and enjoyment by the Grantee, its successors and assigns, of the rights and privileges herein granted.
