RECOMMENDED ACTION:
Adopt Resolution No. 9-&?L/ :
Approving plans and specifications and authorizing the
advertisement of bids for the construction of improvements to
Palomar Airport Road, east of El Camino Real, Project No. 3243.
Approving an agreement between the City of Carlsbad and Costa
Real Municipal Water District for the construction of a 16-inch
waterline, pressure reducing station, and related water service
appurtenances concurrent with the City's roadway improvements
including reimbursement for all related project costs from Costa
Real to the City.
Acceptance of an easement for storm drainage facilities and related appurtenances required for the project from the County of
San Diego to the City of Carlsbad.
Granting of an easement for installation and maintenance of
waterline, pressure reducing station, and related water service
appurtenances from the City of Carlsbad to the Costa Real
Municipal Water District.
ITEM EXPLANATION:
On October 28, 1986, the City Council adopted Resolution No. 8860 approving a consultant agreement with the firm of Pountney and Associates for the design of roadway improvements to the north side of Palomar Airport Road, east of El Camino Real, Project No. --,.
3243. The project plans, specifications, and contract documents are complete and ready for advertisement of construction bids. Staff recommends approval of the plans and specifications and Council authorization to advertise for bids for the project.
The project includes construction of three (3) travel lanes,
streetlights, curb, gutters and sidewalks, traffic signal
modifications, striping, landscaping, and irrigation system a distance of approximately 1,900 feet from the intersection of El Camino Real easterly to connect with recently completed roadway improvements fronting the Kaiser industrial development on the north side of Palomar Airport Road. Although the raised median
islands to ultimate, prime arterial standards have been designed
at this time, striped medians will be installed in order to accommodate four (4) lanes of traffic on Palomar Airport Road, from El Camino Real easterly to El Fuerte Street. Construction of the permanent, raised median islands in this area will occur when the south side of Palomar Airport Road, east of El Camino Real is developed.

The intersection of Palomar Airport Road and El Camino Real is
the only current location joining two (2) prime arterial roadways. Consequently, this intersection contains numerous
underground facilities including high-pressure gas lines,
telephone and electric lines, sewer and storm drains, a high- pressure fuel line, and several waterline connections. Staff has coordinated the City's street improvements to Palomar Airport Road with Costa Real Municipal Water District's needs to install a 16-inch waterline, pressure reducing station, and related water facilities in conjunction with this project. Installation of the
Water District's facilities at this time provides potential for
significant cost savings for construction of these facilities and
eliminates the requirement of future disturbance of the completed
roadway, intense traffic circulation, and adjacent parkway
landscaped areas.
The attached agreement between the City and the Water District provides for the City's contractor to install the Water District facilities as items of work within the City's project. Following
completion of the project, the City will assemble and forward to
the Water District for reimbursement a detailed accounting of all
design, construction, inspection, project administration, soils
and concrete testing, and other related project expenses
associated with the installation of the waterline facilities.
The design engineer's estimate for the construction portion of
the Water District's water service facilities is $197,350. Staff
recommends approval of the attached City/Water District
agreement.
Attached for the City Council's approval is an easement from the County of San Diego to the City of Carlsbad enabling installation of storm drain facilities associated with the
project. Also attached for Council approval is an easement from the City of Carlsbad to the Costa Real Municipal Water District to enable the installation and access for future maintenance of
the waterline facilities.
All publicly and privately held rights-of-way required to facilitate the installation of the street and waterline improvements have been obtained.
FISCAL IMPACT:
The City Council appropriated $900,000 of Public Facility Fee funds for the design and construction of the roadway improvements
in the 1986-87 Capital Improvement Program budget. The design
engineer's estimate for the street improvement portion of the
project is $728,570 with the accompanying Water District
improvements estimated at $197,350. Staff recommends proceeding
with the advertising of bids for the project at this time.
Submission and subsequent analysis of bids will determine cash
flow options for the project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING THE ADVERTISEMENT
OF BIDS FOR CONSTRUCTION OF IMPROVEMENTS TO PALOMAR AIRPORT ROAD, EAST OF EL CAMINO REAL, PROJECT NO. 3243
WHEREAS, the City Council of the City of Carlsbad has
previously appropriated funds for the design and construction of
improvements to Palomar Airport Road, east of El Camino Real,
Project No. 3243; and
WHEREAS, final plans, specifications, and contract
documents to affect the installation of said improvements are
now complete; and
WHEREAS, the City of Carlsbad and the Costa Real Municipal
Water District have explored the potential for including certain
water service facilities within the aforementioned street
improvements; and
WHEREAS, the City Council of the City of Carlsbad has
determined it necessary, desirable and in the public interest to
accept and grant certain easement interests required to
facilitate the installation of the aforementioned street
improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the project plans, specifications and contract
documents as presented are hereby approved.
3. That the City Clerk of the City of Carlsbad,
California, is hereby authorized and directed to proceed to

publish, in accordance with law, NOTICE TO CONTRACTORS inviting
bids for the construction of improvements to Palomar Airport
Road, east of El Camino Real, Project No. 3243, in accordance
with the project plans, specifications, and contract documents
hereinabove referred.
4. That the agreement between the City of Carlsbad and
Costa Real Municipal Water District for the installation and
reimbursement of certain water service facilities is hereby
approved and the Mayor and City Clerk are hereby authorized and
directed to execute said agreement. Upon execution of the
agreement by the Mayor, the City Clerk is hereby authorized and
directed to forward a copy of said executed agreement to the
Costa Real Municipal Water District.
5. That a Grant of Easement for storm drainage facilities
from the County of San Diego to the City of Carlsbad affecting
the aforementioned project is hereby accepted and the City
Clerk is hereby authorized and directed to execute and record
said easement. Upon recordation of said easement, the City
Clerk is hereby authorized and directed to forward a copy of
said recorded easement to the County of San Diego, Department of
General Services, 5555 Overland Avenue, San Diego, California,
92123, attention: Lewis L. Farias, Real Property Agent.
6. That a Grant of Easement for waterline services from
the City of Carlsbad to the Costa Real Municipal Water District
affecting the aforementioned project is hereby granted and the
Mayor and City Clerk are hereby authorized and directed to
execute said easement. Upon execution of said easement by the
Mayor and City Clerk, the City Clerk is hereby authorized and

AGREEMENT FOR REIMBURSEMENT
TO CONSTRUCT 16" WATERLINE IN
PALOMAR AIRPORT ROAD EST OF EL CAMINO REAL
This Agreement entered into this lp day of I
1987 -- , between the COSTA REAL MUNICIPAL WATdR DISTRICT
(hereinafter "DISTRICT") and the CITY OF CARLSBAD (hereinafter
"CITY") with respect to the following facts:
A. The CITY is widening Palomar Airport Road east of El
Camino Real. The DISTRICT desires to construct a 16" waterline,
pressure:yreducing station and appurtenances to serve lands east
of El Camino Real and north of Palomar Airport Road in accordance
with DISTRICT'S Master Plan.
B. The CITY and the DISTRICT agree it is advantageous to both parties to install the waterline at the time of this road
improvement.
NOW, THEREFORE, it is agreed between the parties:
1. The DISTRICT agrees to review the design of the waterline improvements, including the pressure-reducing station
and appurtenances, for compliance with DISTRICT standards, and forward its comments to the CITY or the CITY's consultant. It is
understood that the CITY's consultant, Pountney & Associates,
Inc., will design the waterline, pressure-reducing station and
appurtenances under contract with CITY, in accordance with DISTRICT'S standards and specifications, for a total not-to-
exceed figure of $9,500.00
2. The DISTRICT will provide to CITY, at no cost, shop
drawing review and approval, construction inspection and testing for the waterline, pressure-reducing station, and appurtenances and that the CITY, acting as project manager for the total
project, will be responsible for all communication between the
DISTRICT and the CITY'S construction contractor and subcontractors concerning the pipeline project.
3. Upon completion and final acceptance of the total
project by the CITY, the DISTRICT will reimburse the CITY for its
contracted design services for the waterline and construction of same; provided that DISTRICT shall not be required to pay for or

accept work not conforming to DISTRICT standards and
specifications and CITY dedicates the waterline, pressure- reducing station and appurtenances, and easement therefor, to
DISTRICT. Following the dedication of the easement by the CITY to the DISTRICT, the DISTRICT shall first obtain an encroachment permit from the CITY prior to commencing any maintenance work within the easement. The DISTRICT will also reimburse the CITY for its reasonable administrative services for the waterline portion of its project, The CITY will make available for
DISTRICT review the data and documents used in determining the
amounts to be reimbursed to the CITY,
4. DISTRICT shall not be held liable or responsible to
CITY, its contractors, subcontractors or consultants, for any
defect, error or omission in the design or inspection of the
water1in.e improvements, including the pressure-reducing station
and apptrtenances, unless the error, omission or defect is a direct result of the negligence of DISTRICT.
5. Attorney's Fees. In the event of any claim, dispute or action arising out of the terms and conditions of this agreement,
the prevailing party shall be entitled to reasonable attorney's fees , *
