RECOMMENDED ACTION:
Adopt Resolution No. ?2b? to summarily vacate a portion of Oak Avenue between Roosevel t Street and Tyler Street.
ITEM EXPLANATION
A request was made by Bill Saylor on behalf of the Boys and Girls Club, to vacate an area on the southerly right-of-way of Oak Avenue.
This vacation is a condition of approval of the Boys and Girls Club Redevel opment Permit No. RP86- 11. The Engineering Department has reviewed the request and concluded that this excess 10 foot strip of right-of-way is not needed as this portion of Oak Avenue is fully improved .
Utility Companies have been notified of the vacation. Pacific Bell has indicated that have existing facilities within the area proposed to be vacated, and has requested the reservation of an easement.
FISCAL IMPACT
Approval of this vacation will result in approximately 1400 square feet of land to be returned to the tax rolls.

RESOLUTION NO. 9282
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, SUMMARY VACATING AN EASEMENT OVER A PORTION OF OAK AVENUE
WHEREAS, the above street right-of-way previously dedicated and shown on
attached Exhibit "A", will provide no usable access to the adjoining properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said portion of Oak Avenue, more particularly described on
Exhibit "A" attached hereto, is excess right-of-way of a street not required for
street purposes; and
3. That a portion of Oak Avenue lies entirely within property under one
ownership and that does not continue through such ownership or end touching
property of another; and
4. That pursuant to Section 8334 of Article 1 of Chapter 4 of Part 3 of
Division 9 of the California Streets and Highways Code, said portion of Oak
Avenue be summarily vacated.
5. That an easement for all utility purposes is excepted from this
vacat i on.
6. The City Clerk is instructed to record this Resolution of vacation.
