Adopt Resolution No. 930r, declaring the results of the Special Municipal
Election held November 3, 1987.
ITEM EXPLANATION:
The Registrar of Voters has canvassed the returns of the Special Municipal
Election held on November 3, 1987. The certificate showing the results of that
canvass is attached as Exhibit "A".
The attached resolution declares that the voters adopted Ordinance No. 6082 by
their passage of Proposition K.
Tax on new construction and approved increasing the tax to 3.5%.
Ordinance No. 6082 ratified the 2.5% License

RESOLUTION NO. 9308 ,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, RECITING THE FACT OF A
SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE
3rd DAY OF NOVEMBER, 1987, DECLARING THE RESULTS
THEREOF AND SUCH OTHER MATTERS AS A REQUIRED BY LAW.
WHEREAS, a Special Municipal Election was held and conducted
in the City of Carlsbad, County of San Diego, State of California, on
Tuesday, the 3rd day of November, 1987, as required by law; and
WHEREAS, pursuant to Resolution No. 9166, said election was
consolidated with the Countywide Election held on said date; and
WHEREAS, notice of said election was duly and regularly given in
time, form and manner as prescribed by law, that voting precincts were
properly established, that election officers were appointed, and that
in all respects said election was held and conducted and the votes
cast thereat, received and canvassed and the returns made and declared
in time, form and manner as required by the provisions of the
Elections Code of the State of California; and
WHEREAS, City Council Resolution No. 9166, adopted on the 28th
day of July, 1987, authorized the Board of Supervisors of the County
of San Diego to canvass the returns of said election; and
WHEREAS, pursuant to the Elections Code said canvass has been
. completed by the Registrar of Voters, who has conducted the canvass,
and has provided a certificate with the results of the canvass, and
has provided a certificate with the results of the canvass, said
certificate is listed as Exhibit "A" attached.

NOW, THEREFORE, the City Council of the City of Carlsbad,
California, does resolve as follows:
1. That the above recitations are true and correct.
2. That the whole number of votes cast in said City was 7,918.
3. That the measure voted upon at the election is as
follows:
Proposition K: Shall Ordinance No. 6082 be adopted
amending Chapter 5.09 of the Carlsbad Municipal Code to
ratify the existing 2.5% license tax on new construction
and to authorize an increase to 3.5% to insure that new
development generates the general revenues necessary to
provide the facilities and services required by the Growth
Management Plan?
4. That the number of votes given at each precinct and the
number of votes given in the City for and against the measure,
were as listed in Exhibit "A", attached.
5. The City Council does declare and determine that:
(a) As a result of the election, a majority of the voters
voting on Proposition K relating to the license tax on
new construction did vote in favor of it, and that the
proposition was carried, and shall be deemed adopted
and ratified.
6. That the City Clerk shall certify to the passage and
adoption of this resolution; shall enter the same in the file of
. Original Resolutions of said City; and shall make a minute of
the passage and adoption thereof in the records of the
proceedings of the City Council of said City in the minutes of
the meeting at which the same is passed and adopted.

PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, held on the 8th day of
December, 1987, by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and Larson
NOES: None
ABSENT: None
