HD.- MTG.12/22/87 HUNT PROPERTIES - PACIFIC RIM DEPT. CA RECOMMENDED ACTION: If the City Council concurs take the following actions: 1. Adopt Ordinance No. 9839 approving MP 177 2. Adopt Resolution No. 7322 approving GPA/LU 85-2, LF'MP 87-19, LCPA 87-4 (LCPA 87-2(A), LCPA 87-5 (LCPA 87-2(B), CT 85-35, CP-323, PUD-102, PUD-103, PUD-104, PUD-105 AND SDP 86-2. ITEM EXPLANATION The City Council at your meeting of December 8, 1987 certified EIR 83-2(A) for the Hunt Properties Pacific Rim Master Plan. Council also approved three negative declarations issued by the Planning Director for the local facilities management plan and the two coastal plan amendments. Council then introduced Ordinance No. 9839 approving the master plan. As directed we have prepared a resolution approving the general plan amendment, local facilities management plan, two local coastal plan amendments, the master tentative map for Phase I and six individual development approvals all as recommended and conditioned by the Planning Commission. The two changes as directed by the Council have been incorporated adding a condition for reclaimed water and revising the condition for Lupin Street. If the City Council concurs, your action is to adopt Ordinance No. 9839 and Resolution No. 9,322 . EXHIBITS Ordinance No. 9839 Resolution No. 93;7rz 1 2 3 4 5 6 7 8 9 10 11 12 2 u 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 9839 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING MASTER PLAN MP-177 FOR THE PACIFIC RIM COUNTRY CLUB AND RESORT, A MIXED USE COMMUNITY CENTERED AROUND A HOTEL AND GOLF COURSE ON PROPERTY GENERALLY LOCATED NORTH OF IA COSTA AVENUE BETWEEN I-5 AND EL CAMINO REAL. APPLICANT: HUNT PROPERTIES CASE NO.: MP-177 WHEREAS, The City Council of the City of Carlsbad, California, has reviewed and considered a Master Plan for future development of the site; and WHEREAS, after procedures in accordance with the requirements of law the City Council has determined that the public interest indicates that said plan be approved. NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as follows: SECTION 1: The Pacific Rim County Club and Resort Master Plan, MP-177 dated "Revised November 4, 1987," on file with the Planning Director and incorporated by reference herein is approved. The Master Plan shall constitute the zoning for this property and all development of the property shall conform to the plan. SECTION 2: That the findings and conditions of the Planning Commission in Planning Commission Resolution 2594 shall also constitute the findings and conditions of the City Council with the addition of the following findings and conditions: FINDINGS 1. The Master Plan is consistent with the LCP. 2. Payment of an agricultural conversion mitigation fee in an amount not less than $5,000 and not more than $10,000 per net converted acre has been required as a condition of the Master Plan. 4. Conversion would be compatible with continued agricultural use on surrounding lands. 5. The Master Plan provides overriding benefits to the resources of Batiguitos Lagoon. 6. The Master Plan provides significant protection and enhancement of environmentally sensitive habitats above and beyond the existing land use control's current requirements. CONDITIONS "Development within this Master Plan shall utilize effluent or treated water for irrigation of the golf course and other major landscape areas maintained by the homeowners association when available from the appropriate agencies. Plans for each phase identifying these effluent irrigation areas and the location of the dual irrigation systems needed to serve them shall be submitted to the planning Director and City Engineer for approval prior to approval of the final map for each phase. The dual system shall be installed for the areas identified in the plan at the time of development even if effluent is unavailable at the time of construction." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. WHEREAS, Hunt Properties Inc. has filed a series of 1 applications for a major master planned community, Pacific Rim, ~ f or a 1286 residential unit mixed use community centered around a 1 hotel and golf course on approximately 1,402 acres of property generally located north of La Costa Avenue between I-5 and El Camino Real: and WHEREAS, on November 4, 1987 the Planning Commission of the City of Carlsbad held a public hearing on the EIR for the project (EIR 83-2(A)) and three negative declarations and on the following approvals: local facilities management plan for Zone 19 1 (LFMP 87-19), two local coastal program amendments (LCPAs 87-4 and 87-5), an amendment to the land use element of the general plan 7 . .- . . .- I . 1 2 3 4 5 6 7 5 18 19 20 21 22 23 24 25 26 27 28 -- from the existing designations to a combination district of residential low medium (RI&I), residential medium (RM), open space (0s) I recreational commercial (RC) and neighborhood commercial (N) (GPA/LU 85-2), a 360 lot tentative subdivision map (CT 85-35), a site development plan for planning areas 1, 2, 10 and 11 (SDP 86-2), a 12 lot non-residential planned unit development for planning areas 1, 2 10 and 11 (PUD-102), a 101 lot 96 unit planned unit development for planning area 4 (PUD-103), a 77 lot 75 unit planned unit development for planning area 8 (PUD-104), a 52 unit 20.9 acre planned unit development for planning area 14 (PUD-105), and a 4 lot 100 unit condominium permit for planning area 9 (CP- 323); and WHEREAS, the Planning Commission after hearing from all persons desiring to be heard adopted the following resolutions recommending approval: Resolutions No. 2592, 2698, 2699, 2593, 2594, 2595, 2596, 2607, 2604, 2605, 2606 and 2608; and WHEREAS, the City Council at their meeting of December 8, 1987 held a public hearing on the project and after hearing from all persons desiring to be heard by motion certified EIR 83- 2(A) and approved the three negative declarations for the project in compliance with the California Environmental Quality Act and the Carlsbad Environmental Protection ordinance. NOW, TBEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Local Facilities Management Plan for Zone 19 (LFMP 87-19) as contained in the document entitled Local Facilities Management Plan Zone 19 dated November 4, 1987 on file with the City Clerk and incorporated herein by reference is approved. Any development of the Pacific Rim Project is conditioned upon compliance with all of the requirements of that plan. 4. That two local coastal program amendments LCPAs 87-4 and 87-5 as contained in Planning Commission Resolution No. 2699 on file with the City Clerk and incorporated herein by reference are approved. 5. That in addition to GPA/LU 85-2 the City Council considered a series of other proposed changes to the Land Use Element of the General Plan at the December 15, 1987 City Council meeting and directed the City Attorney to return with appropriate documents to allow the City Council to vote on all the changes individually while all are being considered and made as a part of one single amendment to the Land Use Element of the General Plan. That the Land Use Element of the General Plan is hereby amended to change the existing designations to a combination district consisting of residential low medium (RI&I), residential medium VW * open space (OS), recreational commercial (RC), and neighborhood commercial (N) all as shown on Planning Commission Resolution No. 2593 on file with the City Clerk and incorporated by reference herein. = 1 . . That a 360 lot subdivision map on approximately 540 acres of the property (CT 85-35) as described in and subject to the satisfaction of all the conditions of Planning Commission Resolution No. 2595 on file with the City Clerk and incorporated by reference herein is approved except that a cash deposit in an amount determined by the City Engineer shall be posted for the completion of the construction of Lupin Street. The actual construction of the street shall be as required by the City Engineer providing a full connection to the adjacent street will not be made separating it with a turf block and landscaping trail. The street will be constructed and open to through traffic when the City Council determines it is required. 7. That a Site Development Plan for the Planning Areas 1, 2, 10 and 11 (SDP 86-2) for the golf course as described in and subject to all of the conditions of Planning Commission Resolution No. 2596 on file with the City Clerk and incorporated by reference herein is approved. 8. That a Planned Unit Development permit (PUD-102) for a 12 lot non-residential planned unit development for Planning ~ Areas 1, 2, 10 and 11 of MP-177 as described in and subject to all ~ of the conditions of Planning Commission Resolution No. 2607 on file with the City Clerk and incorporated by reference herein is approved. 9. That a Planned Unit Development permit (PUD-104) for a 77 lot and 75 unit planned unit development for Planning Area 8 of CT 85-35 as described in and subject to all of the conditions of Planning Commission Resolution No. 2605 on file with the City Clerk and incorporated by referenced herein is approved. 11. That a Planned Unit Development permit (PUD-105) for a 52 unit planned unit development on 20.9 acres for Planning Area 14 of CT 85-35 as described in and subject to all of the conditions of Planning Commission Resolution No. 2606 on file with the City Clerk and incorporated by referenced herein is approved. 12. That a Condominium Permit (CP-323) for a four lot condominium permit with 100 units for Planning Area 9 as described in and subject to all of the conditions of Planning Commission Resolution No. 2608 on file with the City Clerk and incorporated by referenced herein is approved.
