FOR STREET PURPOSES

ITEM EXPLANATION
accepting a Grant Deed for stre(
Martin Lock and Janet O’Connell have made application for a sing family residence located at 1410 Buena Vista Way (Building Perm No. 87-122). The right-of-way adjacent to the proposed residence is 1 feet wide which is less than the required standard of 60 feet. Chaptt
18.40 of the municipal code requires dedication of needed right-of-w prior to issuance of a building permit. The Engineering Department h determined an additional 10 feet of right-of-way is needed to fulfi their dedication requirement. Mr. Martin Lock and Ms. Janet O’Connel owners of the property, therefore present for Council acceptance grant deed for the additional required right-of-way in satisfaction the dedication requirement of their building permit.
FISCAL IMPACT
Requiring dedications as a condition of development will save the Ci expenses in the future right-of-way acquisitions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED.
WHEREAS, Martin E. Lock and Janet L. O'Connell have submitted a Gran.
conveying an easement to the City of Carlsbad for street purposes over a pi
of Buena Vista Avenue; and
WHEREAS, the City Council of the City of Carlsbad has determined it
in the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ci
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deed from Martin E. Lock and Janet L. O'Connell,
December 14, 1987, conveying an easement for street purposes over a porti
Buena Vista Avenue to the City of Carlsbad which is on file with the City
and is incorporated herein by reference, is accepted.
3. That the City Clerk is authorized to cause the original Deed
recorded in the Office of the County Recorder of San Diego County, St;
California, with the appropriate Certificate of Acceptance attached.
