DE PT. -~ TITLE: RESOLUTION OF SUPPORT FOR THE USE OF NONPRIME AGRICULTURAL MITIGATION FEES FOR THE CONSTRUCTION OF A BEACH ACCESS STAIRWAY AT MAPLE AVENUE
RECOMMENDED ACTION:
Adopt Resolution No. 88-/&supporting the use of mitigation fees
on deposit with the California Coastal Conservancy required for
the development of nonprime agricultural lands in the Coastal Zone within the city of Carlsbad for the construction of a beach access stairway at Maple Avenue.
ITEM EXPLANATION:
On January 1, 1988, Assembly Bill 1291 (Frazee) became effective amending Section 30171.5 of the State of California Public Resources Code providing the opportunity for the City to utilize for stated purposes within the Code mitigation fees on deposit with the California Coastal Conservancy required for the development of nonprime agricultural lands in the Coastal Zone within the city of Carlsbad. As amended, Section 30171.5 allows the City to seek the approval from the California Coastal Conservancy, in consultation with the California Coastal
Commission, to utilize up to fifty percent (50%) of the fees on deposit for construction of accessways to public beaches within
the city of Carlsbad. Conservancy staff has identified the
amount of $100,000 to be available to the City for this purpose. With the assistance of Conservancy staff and Assemblyman Robert C. Frazeels office, the California Coastal Conservancy will be considering this item at their meeting of January 21, 1988 in San Francisco. Approval of this request is anticipated.
Conservancy staff has requested a formal City of Carlsbad Council Resolution supporting the use of these funds to enhance access to public beaches within the city.
On December 8, 1987, the California Coastal Commission formally approved the City's application, with minor modifications, for the necessary Coastal Development Permit for the construction of the Carlsbad Boulevard Bluff-top Walkway project which includes proposed new access stairways at Maple and Hemlock Avenues and repair of the Cherry Avenue stairway. Easements from the State of California, Department of Parks and Recreation, affecting this project were obtained in 1986 in conjunction with the construction of the Carlsbad Boulevard Seawall project.
FISCAL IMPACT:
Detailed plans, project specifications, and contract documents for the construction of this project have been completed and are ready for advertisement of construction bids. This project is

proposed to be funded within the upcoming Tax Allocation Bond sale through the Housing and Redevelopment Commission. Request for Council approval to advertise for construction bids for the project will be withheld until after the Commission, i.e., City
Council, authorizes the bond sale and establishes the project
priority list.
The design engineer's updated estimate for the construction of
the Maple Avenue access stairway, subject to receiving formal
competitive bids, is $115,000. Of this amount, $100,000 would be
provided on a reimbursement basis to the City from the California
Coastal Conservancy in accordance with the provisions of Section
30171.5 of the Public Resources Code. Construction of the
proposed new access stairways at Maple and Hemlock Avenues will
complete the CityIs comprehensive access plan to improve the
general public's access to the beaches in this area.
Staff recommends the City Council adopt the attached Resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SUPPORTING THE USE OF MITIGATION
FEES ON DEPOSIT WITH THE CALIFORNIA COASTAL CONSERVANCY
REQUIRED FOR THE DEVELOPMENT OF NONPRIME AGRICULTURAL
LAND IN THE COASTAL ZONE WITHIN THE CITY OF CARLSBAD
FOR THE CONSTRUCTION OF A BEACH ACCESS STAIRWAY AT MAPLE
AVENUE WITHIN THE CITY OF CARLSBAD
WHEREAS, the California Coastal Act of 1976 requires
mitigation fees for development of nonprime agricultural lands
in the Coastal Zone within the city of Carlsbad outside of
specified areas to be deposited with the California Coastal
Consewancy; and
WHEREAS, said fees are appropriated from time to time by
means of special State legislation from the State Coastal
Conservancy Fund to the California Coastal Conservancy for
expenditure for specified purposes; and
WHEREAS, Assembly Bill 1291 (Frazee) became effective on
January 1, 1988 amending Section 30171.5 of the Public Resources
Code relating to coastal resources: and
WHEREAS, amended Section 30171.5 of the Public Resources
Code provides the opportunity for the city of Carlsbad to
request from the California Coastal Conservancy, in consultation
with the California Coastal Commission, the use of up to fifty
percent (50%) of said appropriated funds to provide access to
public beaches in the city of Carlsbad; and
WHEREAS, California Coastal Conservancy staff has
identified the amount of one hundred thousand dollars ($100,000)
to be available to the City of Carlsbad for this project; and
WHEREAS, the City Council of the City of Carlsbad,

California, is in support of the use of said funds to enhance
and promote access to public resources within the city of
Carlsbad;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City Council of the City of Carlsbad,
California, hereby respectfully requests and offers its support
for the use of the aforementioned mitigation fees on deposit
with the California Coastal Conservancy to construct a public
access stairway at Maple Avenue within the city of Carlsbad.

3. That the City Council of the City of Carlsbad,
California, shall fund the balance of all costs related to the
construction, administration, inspection, and all other
miscellaneous costs for the Maple Avenue Access Stairway project
in excess of the funds approved by the California Coastal
Conservancy in accordance with the provisions of amended Section
30171.5 of the Public Resources Code.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 19th day of January
1988, by the following vote, to wit:
