TITLE: THIRTY-SIXTH SUPPLEMENT TO THE ENCINA JOINT POWERS BASIC AGREEMENT DPPT HD^^ V \ JT/2 riTY ATTY V/V^ CITY MfiR^V RECOMMENDED ACTION: Council adopt Resolution No . &?-*%& authorizing execution of the Thirty- Sixth Supplement to the Encina Joint Powers Basic Agreement providing for accelerated design of the Phase IV expansion to the Encina Water Pollution Control Facility. ITEM EXPLANATION: In order to insure that adequate wastewater treatment capacity is available to meet Growth Management Standards, it has been determined that there is a need to accelerate efforts to expand the Encina Water Pollution Control Facility. To expedite this process, the Encina Joint Advisory Committee is recommending the design of the facility expansion be "fast-tracked," as well as construction of additional pumping facilities utilized in the sewer outfall system. The Thirty- Sixth Supplement and the accompanying Capital Improvement Program adjustments accomplish the project acceleration by funding the design costs and pump installation in the current fiscal year. Cost allocations utilized in the supplement are based on current Unit 1 ownership, of which Carlsbad's share is 25.4%. Actual contributions will be adjusted when the final Phase IV cost allocation program is approved with the Year 2020 Facilities Plan. At that time, new ownership costs will be established, and it is likely that Carlsbad ownership percentage and costs will increase. FISCAL IMPACT: Accelerated funding of design will increase Carlsbad's 1987/1988 Encina Cost by $557,530. Adequate funds have been allocated in the City's Capital Improvement Program to fund this increase. Available funds of $1,380,000 were previously allocated for plant expansion costs and carried forward into the current year's budget. The proposed allocation will leave $822,470 for distribution toward future expansion costs. EXHIBITS: 1. THIRTY-SIXTH SUPPLEMENT TO BASIC AGREEMENT TO PROVIDE FOR (1) DESIGN OF PHASE IV OF ENCINA WATER POLLUTION CONTROL FACILITY, AND 2) DESIGN AND CONSTRUCTION OF INTERIM IMPROVEMENTS TO UNIT J. This Thirty-sixth Supplement to the Basic Agreement is made and entered into as of the of 19 , by and among: CITY OF VISTA ("Vista"), a municipal corporation; CITY OF CARLSBAD ("Carlsbad"), a municipal corporation; BUENA SANITATION DISTRICT ("Buena"), a county sanitation district, SAN MARCOS COUNTY WATER DISTRICT ("San Marcos"), a county water district; LEUCADIA COUNTY WATER DISTRICT ("Leucadia"), a county water district; and ENCINITAS SANITARY DISTRICT ("Encinitas"), a sanitary district. RECITALS A. Vista, Carlsbad, Buena, San Marcos, Leucadia and Encinitas, own and operate a Joint Sewer System, including Unit I the Encina Water Pollution Control Facility and Unit J, the Ocean Outfall. B. An enlargement of the Encina Water Pollution Control Facility (Unit I) is currently being planned called Phase IV which will provide for an increase in the capacity of Units I and J. This expansion is necessary to meet further flowage demands of the parties hereto and environmental protection requirements of applicable law. C. It is necessary to designate the Leucadia County Water District ("Leucadia") administrator of the project and authorize said agency to act as lead agency to complete all work as may be necessary to expand the facility in accordance with state and federal regulations. -1- D. Prior to th^^ompletion of Phase IV, it is -»«4cessary to expand the capacity of Unit J (Ocean Outfall) to meet present flowage demands of the par- ties hereto, and environmental protection requirements of applicable law. E. It is necessary to proceed in a timely manner with certain aspects of this project prior to the adoption of the Year 2020 Facility Plan. Therefore, it is necessary to collect funds for the project using present Unit I ownership allocations until adoption of the aforementioned Facility Plan, after which some adjustment to the formula for cost allocation may be necessary. F. This Supplement to the Basic Agreement is made pursuant to the provi- sions of Article 1, Chapter 5, Division 7, Title 1, of the Government Code of the State of California (commencing with Section 6500), relating the joint exer- cise of powers common to all public agencies; in this case being Vista, Carlsbad, Buena, San Marcos, Leucadia and Encinitas, each of which is authorized to contract with the others pursuant thereto. NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS: Section 1. Phase IV Enlargement of Units I and J Units I and J shall be enlarged and improved to meet future flowage demands of the parties hereto, and environmental protection requirements of applicable law, and such shall hereafter be referred to as the Phase IV Enlargement. The enlargement is a joint project of Vista, Carlsbad, Buena, San Marcos, Leucadia and Encinitas. Section 2 Designation of Administrator/Lead Agency Leucadia is hereby appointed as the Administrator of the joint project and is authorized to contract for engineering services as hereinafter provided. Pursuant to the provisions of Section 21165 of the California Public Resources Code, Leucadia, as the lead agency, has caused to be prepared a Facility Plan and Environmental Impact Report for the Phase IV Enlargement. -2- Section 3. Phas§«iy Engineering Services The engineering services to be furnished under the contract(s) executed by Leucadia and authorized hereunder shall include the following: (1) Preliminary engineering; (2) Design services, including preparation of contract documents; (3) Preparation of operation and maintenance manuals; (4) Miscellaneous engineering services; (5) Preliminary construction management services. Section 4. Payment for Cost of Phase IV Engineering Services The parties hereto shall advance to Leucadia the estimated costs of such engineering services contracted for by Leucadia in the following proportions: Vista, 30.00%; Carlsbad, 25.4%; Buena, 4.59%; San Marcos, 17.78%; Leucadia, 16.67%; and Encinitas, 5.56%. These proportions are based upon existing ownership percentages in Unit I. However, the ultimate liability of each of the parties hereto for the costs of such engineering servcies shall be equal to the actual total cost of such engineering services multiplied by the proportions to be set forth and adopted as part of the Year 2020 Facility Plan by all par- ties hereto. The parties hereto shall advance to Leucadia forthwith, as admi- nistrator, for the engineering services described in paragraphs (1) through (5) of Section 3 of this Agreement, an amount that shall be set forth in the duly adopted Operating Budget of the EWPCF. Thereafter, each party hereto shall pay Leucadia for the engineering services described in section 3 of this Agreement, upon written demands forwarded to them by Leucadia. Such demands will be for- warded and such payments shall be made at such times as will enable Leucadia to pay for the costs of such services. Leucadia shall be strictly accountable to all parties hereto for all funds received by it pursuant to this Agreement and shall maintain adequate records of all receipts and disbursements' pursuant hereto. -3- Section 5. Interhw'Expansion of Unit J The Encina Ocean Outfall System shall be enlarged and improved by adding a third pump and associated equipment, to meet short-term flowage demands of the parties hereto. The cost of such expansion is set forth in the duly adopted operating Budget for the Facility and shall be paid for in the percentages set forth in Section 4. Section 6. Payment for Cost of Interim Expansion of Unit J The estimated cost and allocation between agencies of such cost of the interim expansion, including design and construction, is as follows: Agency Share of Cost of Interim Unit J Expansion Vista $120,000 Carlsbad 101,600 Buena 18,360 San Marcos 71,120 Leucadia 66,680 Encinitas 22,240 $400,000 Cost allocations are based upon present ownership percentages in Unit I. Section 7. Counterparts This Agreement may be executed in counterparts, and upon excution thereof by all of the parties set forth on page 1 hereof, each such counterpart shall be deemed to be an original. A draft Facilities Plan to the year 2020 has been reviewed by the Encina Joint Advisory Committee (JAC). In light of the information in the draft plan and the recent and pro- jected north county growth the JAC has authorized "fast tracking" of additional treatment (Unit I) and disposal (Unit J) facilities. Therefore, the JAC RECOMMENDS The Encina member agencies: 1. Adopt the Thirty-Sixth Supplement to the Encina Basic Agreement; and 2. Adopt a revised Encina FY 87/88 Capital Improvement Program Budget increasing it from $1,015,000 to $3,210,000. DISCUSSION The Thirty-Sixth Supplement authorizes Leucadia County Water District (LCWD) to administer the Encina Phase IV project to expand Unit I (treatment plant) and Unit J (ocean outfall). The Supplement provides that Phase IV design funds be initially provided under present Unit I ownerships. In addition, design and construction of a third pump on the outfall will be funded initially on present Unit I ownerships. The Supplement contains provisions that allow for adjust- ments in Phase IV costs based on actual ownerships in the final Year 2020 Facility Plan. The Facility Plan is scheduled for adoption by the member agencies in June 1988. It will incorporate a Phase IV cost allocation based on several factors including revised ownerships and Phase IV costs (planning, design and construction). Adjustments for pre-Phase IV ownerships in both Unit I and J will be factored. The allocation will also consider adjustments in ownerships for existing common facilities, such as the operations/administration building. In addition, the final Facility Plan will incorporate any required mitigative measures resulting from the on-going environmental review. Certification of the Facility Plan Environmental Impact Report by LCWD is scheduled for May 1988. For information the existing CIP is also attached. The FY 87/88 increase from $1,015,000 to $3,210,000 reflects the "fast tracking" of Phase IV and the ocean outfall third pump designs. It is at this meeting that the Phase IV design contract ($2,269,000) will be considered for award if the member agencies have adopted both the Thirty-Sixth Supplement and the revised CIP and the funds have been forwarded. In summary, the Thirty-Sixth Supplement and revised Capital Improvement Program will provide initial funding and authorization for the following: Increasing Encina liquid treatment capacity from 22.5 millions gallons per day (mgd) to 36 mgd. Increasing solids treatment capacity from 22.5 mgd to 38 mgd. Increasing permanent outfall disposal capacity from 40.5 mgd peak wet weather flow (PWWF) to 65.0 mgd PWWF. Increasing interim disposal capacity via temporary flow equalization from 65.0 mgd PWWF to 81 mgd PVVWF. Preliminary allocations of these capacities are shown on Tables 1 and 2 (attached).
