RECOMMENDED ACTION:
Adopt Resolution No. J>J'-J~ , approving trie purchase of a triple combination
pumper for Fire Station #5.
ITEM EXPLANATION
The 1987-88 Capital Improvement Program includes $1,680,000 for the construction and
apparatus for Fire Station ·§5 at the Safety Center. This station is expected to be
operational in December, 1988, and in order to have the apparatus delivered in a
timely manner, it is necessary to place the order now.
After reviewing the various purchasing options that are available, including formal
bidding and competitive negotiations, the staff decided the cooperative purchasing
procedures (Section 3.28.360) were most advantageous to the City. By using this
section of the Code, the City can purchase equipment when another agency h~s made
their purchase in a competitive manner. The City of Ukiah used the formal bidding
procedures when they purchased a fire apparatus in September, 1987. Beck Fire
Apparat~s Company was awarded the bid for a triple combination pumper and will allow
the City of Carlsbad to cooperatively purchase the same unit at the basic price.
FISCAL IMPACT
Unencumbered funds in the amount of $1,680,000 are available in the Fire Station #5
Account No. 320-820-1810-3290. The cost of the triple combination pumper is
$168,557 plus tax, for a total of $178,670.42.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE PURCHASE OF A
TRIPLE COMBINATION PUMPER.
WHEREAS, the City of Carlsbad desires to purchase a triple .combination
pumper;
WHEREAS, it is desirable for the triple combination pumper to be:purchased
using Section 3.28.160 Cooperative Purchasing;
WHEREAS, the purchase of the triple combination pumper from Beck Fire
Apparatus is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California? as follows:
1. That the above recitations are true and correct.

(Exhibit A) and made a part hereof, is hereby approved.

PURCHASE AGREEMENT TERMS AND CONDITIONS BETWEEN
BECK FIRE APPARATUS AND CITY OF CARLSBAD, CALIFORNIA
1.01 DEFINITIONS
1.010 The word "City" shall mean the "City of Carlsbad, California" and its
authorized representative.
1.011 The term "authorized representative" shall mean the Fire Chief and/or his
des ignee, and no other person. For the purpose of this agreement, the Fi re
·Chief of the Carlsbad Fire Department or his designee shall serve as technical
advisor to the Purchasing Officer, and shall assist and advise on all technical
matters pertainin-g to the materials, design, engineering principles and/or
equipment specified herein.
1~012 The word "Contractor" shall mean "Seek Fire Apparatus" and its authorized
representatives.
l.02 PRE-CONSTRUCTION CONFERENCE
The purchaser and contractor will participate in a pre-construction conference
to review and discuss the construction details after receipt of.the order by the
contractor but before construction commences.
All plans and specifications must be approved by the Department prior to awarri
of contract. Manufacturer mus~ supply all expenses for motel, meals and
transportation for two (2) reprusentatives of. thE! Department to the factory
where the apparatus is being built for three (~) inspection trips at the time
convenient to the Department as directed by the Fire Chief.
1.03 INSPECTION AND ACCEPTANCE
1.030 ·The City of Carlsbad, through its authorized representative, shall be the
judge as the acceptability of materials, equipment and/or workmanship furnished
under this agreement.
1.031 All material, equipment and workmanship furnished must be in conformity
with specifications, and will be subject to inspection and acceptance. The
right is reserved to reject and return at the risk and expense of the contractor
any portion of any shipment or schedule which may be defective or which fails to
comply with specification without invalidating the other items listed in
schedule.
1.032 Proposed apparatus shall conform to all rules and regulations of the U.S.
Department of Transportation and the State of California Motor Vehicle Code.
1.033 An inspection by authorized representatives will be held at the
Contractor's facility:
A. For a pre-construction conference.
8. To inspect and accept the chassis within five (5) days of chassis
delivery to the contractor.
C. After final assembly, for preliminary acceptance.
1.04 DISPUTES -
Except as otherwise provided in this agreement, any dispute arisrng under this
agreement which is not disposed of by agreement shall be decided by the City of
Carlsbad through its authorized representatives who shall reduce his decision to
writing and ma i1, or othP.rwi se furnish a copy thereof to the vendor. This
decision shall be final and binding on both parties.
1.05 CONTRACTOR'S SPECIFICATIONS
The Contractor must provide two (2) sets of specifications which contain
apparatus assembly drawings, complete wiring diagrams and other information.
Scaled drawings shall show both sides, rear and top views, location and size of
compartments and hose beds, discharge gates, suction intakes, control gauges,
valves, lights, overall dimensions of body, midship pump and water tank. This
inf9rmation shall be submitted at the preconstruction conference. If the
specifications differ in any respect from the specifications contained in the
attached exhibits, the City shall be the sole judge of acceptance or rejection
of same.
1.06 MANUALS
Literature from the pump manufacturer, including a pump curvet shall be
included·.
The following items shall be delivered with each of the completed apparatus:
Two (2) detailed lubrication charts.
Two (2) detailed wiring diagrams.
Two (2) Parts Manuals.
Two (2) Service Manuals.
Two (2) Operators Manuals.
1.07 WARRANTIES
At the time of delivery, the Contractor shall deliver to the City one (1) copy
of each of the certificates or forms. properly completed and covering the
apparatus delivered:
A. Chassis manufacturer's certified warranty.
B. Accessory item information and warranties.
C. Beck apparatus warranties.
At the time of acceptance of this agreement, the vendors shall complete the
following:

manufactured by us as proposed to you to be free from defects in materials and
workmanship under normal use and service. If during a period of one (1) year
from the date of final acceptance, there is a failure in any part of the
apparatus or equipment due to defective material or workmanship, including
latent defects, we shall replace such part without cost to the City."

Delivery shall be on the 3rd inspection trip, in Cloverdale, CA. Any costs for
delivery shall be included in the cost of the apparatus.
A competent delivery engineer shall arrive in Carlsbad two weeks after delivery
of the apparatus and shall instruct the Fire Department personnel in the proper
operat i'on and ma i n_tenance of the apparatus. The de 1 ivery engineer sha 11 remain
in the area for the period of time deemed necessary by the Fire Chief, but
unless unusual circumstances prevail, not to exceed two (2) days. The delivery
engineer shall be a full time employee of that company manufacturing the
apparatus. The City is to provide a 1 etter of self-insurance before the
Contractor delivers the apparatus.
1.09 TESTING AND SPECIAL PROVISIONS
In addition to complying with the aforementioned detailed specifications, the
apparatus, as delivered shall comply with the following applicable provisions
1 isted in the latest edition of the National Fire Protection Association,
Pamphlet 1901.
"Provisions applying to apparatus equipped with a fire pump."
"Provisions applying to apparatus equipped with a hose body."
"Provisions applying to apparatus equipped with a water tank."
"Acceptance tests and requirements."
In all cases the detailed fire apparatus specifications, and detailed fire
apparatus chassis specifications, shall govern construction.
The apparatus shall conform to all rules and the regulations of the U.S.
Department of Transportation and the State of California Motor Vehicle Code.
1.10 DELIVERY SCHEDULE
After receipt of purchase order, the agreed upon delivery date is established as
90 -120 calendar days after Beck Fire Apparatus receives the truck chassis.

1.11 FINAL ACCEPTANCE
Final acceptance will be recognized as payment in full from the City. The City
will retain ten percent (10%) of the total purchase price until final acceptance
is authorized by the Carlsbad Fire Department representative. The City,
together with its authorized representative, will be the sole judge of final
acceptance.
1.12 PAYMENT SCHEDULE AND TERMS
The City agrees to purchase from the Contractor a 1,500 G.P.M. Class "A" pumper,
Beck Model C-124TSB on an Ottawa custom fire cab and chassis designed and built
to the specifications contained in Exhibit B with options contained in Exhibit
C. The full ~urchase price for the 1,500 G.P.M. Class 11 A11 pumper, Beck Model C-
124TSB on an Ottawa custom fire cab and chassis is $168,557.00.
Payments shall be made based upon the following schedule:
A. After contractor receives the truck chassis, and aft.er inspection
. with acceptance by a Carlsbad fire representative, the City will pay the chassis
price in full within seven {7) days of the contractor receiving the chassis.
The Contractor is to submit a letter showing ownership of the chassis in the
City of Carlsbad's name upon receipt of chassis payment.
B. At delivery of the complete vehicle, after preliminary acceptance
test: 90% of balance due.
C. Accompanying written notification of final acceptance of vehicle; no
later than two {2) weeks after delivery, the remaining 10% due.

1.13 NOTICE
All notices, r_equests, demands and other communication shall be in writing and
sent by registered mail, certified mail, or hand delivery addressed to the
party's principal place of business.
