If Council concurs, your action is to adopt Resolution No. rF&- approving RHMP 87-l.
ITE3I EXPLANATION
The Council, at your meeting of January 26, 1988, directed the City Attorney to return with the documents approving the conversion of Solamar Mobilehome Estates to condominiums and waiving the tentative and final maps. The findings and conditions are those of the Planning Commission in Resolution No. 2708 except as noted in the attached Resolution. The Council should satisfy itself that the findings and conditions adequately reflect your intentions in the matter.

RESOLUTION NO. 88-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING THE WAIVER OF A TENTATIVE AND FINAL MAP FOR CONVERSION OF A MOBILEHOME PARK TO CONDOMINIUM OWNERSHIP ON PROPERTY GENERALLY IXXATED ON THE EAST SIDE OF CARLSBAD BOULEVARD, WEST OF THE AT&SF RAILROAD, SOUTH OF PAIdMAR AIRPORT ROAD IN THE RMHP ZONE, LFMP ZONFa 22 APPLICANT: SOLAMAR MOBILEHOME ESTATES CASE NO: RMHP 87-l
WHEREAS, on January 6, 1988 the Carlsbad Planning
Commission adopted Resolution No. 2708 recommending to the City
Council that RMHP 87-l be approved; and
WHEREAS, the City Council of the City of Carlsbad, on
January 26, 1988 held a public hearing to consider the
recommendations and heard all persons interested in or opposed to
RMHP 87-l; and
WHEREAS, this project has been declared to be
categorically exempt from environmental review per Section
15301(k) of CEQA,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission in
Resolution No. 2708 constitute the findings of the City Council i
this matter.
3. That RHMP 87-l together with the provisions for its
improvement and subject to the' conditions of this resolution are
consistent with all applicable general and specific plans of the
City of Carlsbad.
4. That RHMP 87-l is hereby approved subject to all
2 applicable requirements of the Carlsbad Municipal Code and to the
3 satisfaction of the conditions contained in Planning Commission
4 Resolution No. 2708 dated January 6, 1988, on file in the office
5 of the City Clerk, with the following exceptions:
6 a. The abatement program required by condition 10
7 and attached to Planning Resolution No. 2708 is amended by Exhibit
8 A, dated 1-21-88, attached hereto and made a part hereof and the
9 abatement period shall begin on the date the certificate of
10 compliance is recorded.

b. Condition No. 23 is amended to read as follows:
"On or before April 1, 1989, a public or private water system capable of delivering adequate water for fire protection purposes shall be installed to the satisfaction of the Fire Department. Prior to the recordation of the Certificate of Compliance the applicant shall enter an agreement satisfactory to the City Attorney that within forty five (45) days following the recordation of the Certification of Compliance, the applicant shall post securities acceptable to the City Attorney that guarantee the installation of said water system by the required date. This condition shall appear on the Certificate of Compliance."
C. Condition No. 13 is deleted.
