SUBJECT: ZCA 87-2 - RECYCLING FACILITIES - An amendment to the City's zoning ordinance to require and to conditionall allow recycling facilities.
I. RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 2705 recommending APPROVAL of ZCA-87-2 based on the findings contained therein.
11. PROJECT DESCRIPTION AND BACKGPOUND
This proposed zone code amendment (see Exhibit A) would revise
the zoning ordinance to address recyclinq facilities. The
amendment defines within which zones and under what general conditions the City would allow recycling facilities. The amendment would also make it a general requirement for sellers materials in redeemable recyclable containers to have small on- site redenption facilities.
This amendment is necessary due to the enactment of the 1986 Caifornia Beverage Container Recycling and Liter Reduction Act (Public Resources Code Section 14500 et. seq.). That act
establishes redemption values for the recycling of glass, aluminum, plastic and metal beverage containers. The act also
requires a recycling facility to be located within a "con-
venience zone" of 1/2 mile radius from any supermarket that grosses over two million dollars in sales a year. Presently
Carlsbad has four such "convenience zones" 1/2 mile around: 1
VGNS at El Camino Real and Highway 78, 2) BIG BEAR at Elrr and
5, 3) SAFEWAY at Tamarack and 1-5, and 4) VONS at El Camino Re and La Costa Avenue. There is potential for several other suc zones within Carlsbad. These convenience zone recycling facilities must be in place prior to 1-1-88 or stores face a
$100.00/day fine from the State Division of Recycling.
This amendment utilized the Model Zoning Ordinance and Local Government Guidelines developed by the State's Division of Recycling. These materials were developed by individuals with significant experience in recycling. Staff has subsequently updated the material to reflect Carlsbad's unique concerns.

The first section of the amer.dment defines the terms used by recycling facilities. These definitions came from the State
Division of Recycling.
The second section of the amendment requires future land uses
which sell recyclable materials or have the potential to create "convenience zones" to have reverse vending machine facilities. Reverse vending machines (RVM) are similar to coin operated soda machines, but instead receive cans and bottles and give back the redemption value. The amendment establishes certain guidelines to assure these facilities will be a positive contribution to a sites' design, and to help establish a uniform recycling approach in Carlsbad.
The third section establishes within which zones and under what
situations recycling facilities would be conditionally allowed.
Reverse vending machines and small collection facilities would be
allowed by CUP in all zones except residential. These facilities
would basically be allowed if it was shown they are integral part
of a site's design and cause no negative land use impacts. Small
collection facilities are no more than 500 square feet in area.
These facilities basically allow people to conveniently drop off a small volume of recyclables. ?.!hen a sufficient amount of recyclables are collected they are transported to a processing
f acil i ty.
Large collection facilities would be conditionally allowed in R-
P, commercial and industrial zones, Larqe collection facilities are basically the same as sinal1 collection facilities, but are greater than 500 square feet in area and typically service larger scale recyclers.
Processing facilities primarily take collected recycled materials and process the material into a form for efficient shipment.
This material is shipped to a reuser of the material, such as an aluminum can or glass bottle manufactures. Processing facilities would only be conditionally allowed in industrial zones. Processing facilities must comply with all applicable development standards which effect a given site such as zonina, specific plans, site development plans, etc. In addition, certain conditions have been established to help assure processing facilities will be adeuuately sited, designed and operated.
In summary, this amendment represents an initial attempt in

legislation, Both the industry and the statewide regulations are

fairly new. However, staff believes this amendment will give adequate direction to provide appropriate recycling facilities within Carlsbad, consequently staff recommends approval.

21.04 - Recycling Facility
A recycling facility is a center for the collection ai
processing of recyclable materials. A certified recyc facility or certified processor means a recyclinq fac. permitted by the City of Carlsbad, and certified by California Department of Conservation as meeting the require1
of the California Eoverage Container Recycling and L:
Reduction Act of 1986. A recycling facility does not inc
storage facilities or processing activity located on the prer of a residential, commercial, or manufacturing use and solely for the recycling of material generated by residential property, business, or manufacturer. Recyc
facilities nay include the following:
(1) Collection Facility
A collection facility is a center for the accepi

an area of more than 500 square feet and may
include permanent structures.
(2) Processing Facility
A processing facility is a building or enclosed
space used for the collection and processing of recyclable materials. Processing means the preparation of material for efficient shipment, or
to an end-user's specifications, by such means as balins, briquettinq, compacting, flatteninq, grinding, crushing, mechanical sorting, shredding, cleaning. Processing facilities include the
following:
(9) A light processing facility occupies an area of under 45,000 square feet of gross collection, processing and storage area and is limited to two (2) outbound truck shiprnents per day. Light processing facilities are limited to baling ,
briauetting, crushing, coqpacting, grinding, shredding, and sorting of source-separated recyclable materials. ?I light processing
facility shall not shred, compact, or bale ferrous metals other than food and beverage
containers.
(8) A heavy processing facility is any processinq facility other than a light processing facility.
21.04 - Reverse Vending b!achine(s)
A reverse vending machine (RVM) is an automated mechanical device
which acccepts one or more types of empty containers including, but not limited to aluminum cans, glass, and plastic bottles, and issues a cash refund or a redeemable credit slip with a value not less than the container's redemption value as determined by the State. A RIG? may sort and process containers mechanically
provided that the entire process is enclosed within the machine.
A bulk RVM is a RWI that is larger than 50 square feet; is designed to accept more than one type of container at a time; and
will pay by weight instead of by individual container.

21.04 - Mobile Collection Facility
Mobile collection facility means an automobile, truck, trai or van licensed by the Department of Motor Vehicles and o ancillary facilities permitted by the City which are used for collection of recyclable materials.

Chapter 21.53 of the Carlsbad Manicipal Code is hereby amende( adding the following:
21.53 REVERSE VENDING MACEIINE FACILITIES
A reverse vending machine facility includes features such as, not limited to, lighting, screening, and landscaping which necessary to assure a reverse vending machine's compatibi with the site and surrounding area and incorporates one or
reverse vending machines (FVM's). A RVM facility may include vending machines.
A RVM facility shall be required to be located and maintained
site according to the followinq standards.
(1) A RVM facility shall be located next to
vending machine which sells items containel

(3) A RVM facility shall have located within 30 fe trash can for use by the general public. A facility shall be maintained in a clean, li and odor free condition.
(4) A RVM facility shall be an integral part sites' design and shall not interfere pedestrian or vehicular movement.
(5) A RVM facility shall have operating hours that at least as long as the operating hours of
host use or vending machine(s).

(6) Each RVM within a RWI facility shall:
(A) Be constructed and maintained with durable waterproof and rustproof material from which no r'luids or odors are allowed to emit.
(B) With a maximum of four square feet of
instructions clearly indicate:
(1) The type of recyclable material to be

(4) A current list of similar RVN's within the City of Carlsbad.
(7) A 2VFl facility shall be identified with a two foot

Chapter 21.42 of the Carlsbad Nunicipal Code is hereby amended by
adding the following:
Unless already a requirement accordinq to Chapter 21.53, reverse
vending machine facilities may be permitted by conditional use permit in all zones except residential, provided that the
following conditions are met:
21.42.010 (5)(EE) - Reverse Vending Machine Facilities
A reverse vending machine facility includes features such as, but
not limited to, lighting, screening, and landscaping which are necessary to assure a reverse vendina machine's compatibility
with the site and surrounding area and incorporates one or more reverse vending machines (RVM's). A RVM facility may also
include vending machines.
A RVM facility shall be required to be located and maintained

Small collection facilities may be permitted provided they

containers, papers and reusable items as allowed
by the specific conditional use permit;
(5) Shall use no power driven processing equipment;
(6) Shall use attractive containers, that are compatable with the site and surrounding area and are constructed and maintained with durable waterproof and rustproof material. The containers
shall be covered when the site is not attended and
be secure from unauthorized entry or removal of material. The containers shall be of a capacity sufficient to accommodate materials collected according to an a6opted collection schedule:
(7) Shall store all recyclable material in containers or in a mobile collection facility. Recyclable materials shall not be left outside of containers or a mobile collection facility when an attendant is not present;
(8) Shall be maintained free of fluids, odors, litter,
rubbish, and any other non-recyclable materials,
and shall be swept and cleaned at the end of each
collection day:
(9) Noise levels shall complv with City ordinance an2 standards.
(10) Attended facilities located within In0 feet of a property planned, zoned or occupied for residential use shall operate only during the hours between 9:OO a.m. and 7:OO p.m.;
(11) Containers for the 24-hour collection of materials
shall be at least 30 feet from any property zoned or occupied for residential use.
(12) Containers shall be clearly marked to identify the
type of material which may be deposited. The
facility shall be clearly marked to identify the nane and telephone number of the facility operator and the hours of operation, and display a notice stating that no material shall be left outside the recycling enclosure or containers.

Conservation;

21.42.10 4B - Large Collection Facilities
A large collection facility may be permitted provided the facility meets the following conditions:

(1) The facility is not within 150 feet of a property planned, zoned or occupied for residential use;
(2) The facility is completely screened from the public view by operatinq in an enclosed building Within an area completely enclosed by landscaping
and a permitted opaque wall or fence of sufficient
height to completely screen the facility from the public view. Large collection facilities proposed in the PM zone shall only be allowed to operate completely within an enclosed building.
(3) The facility complies with the applicable requirements for the site in which the facility is located;
(4) Any storage of recyclable material shall be in sturdy containers, baled or palletized. Storage of such material shall be covered, secured, and maintained in a clean and orderly condition. Storage containers for flammable materials shall
be approved by the Fire Department.
(5) The site shall be maintained free of fluids,
odors, litter, rubbish, and any other non- recyclable materials, and will be cleaned on a daily basis.
(6) Space shall be provided on site for a minimum of
six (6) vehicles or the anticipated peak hourly
customer load, whichever is higher, as determined by the .Planning Director. In addition, parking shall be provided for each employee and for each commercial vehicle of the recycling facility.
(7) Facilities located within 500 feet of property planned, zoned, or occupied for residential use, shall not be in operation between 7:OO p.m. and 7:OO a.m.;
(8) Any containers provided for after hour collection
of recyclable materials shall he at least 250 feet
) from any property planned, zoned, or occupied for
residential use. All containers shall be of
sturdy, rustproof, and leakproof construction, shall have sufficient capacity to accommodate materials collected, and shall be secure from
unauthorized entry or removal of materials.

(2) The facility shall not abut a property plan zoned or occupied for residential use;
(3) The facility shall operate in an enclo building, or:
If not within the PM zone in an area cornplet enclosed on all sides by landscaping and permitted opaque fence or wall of suffici height to completely screen the facility from public view; and Located at least 250 feet f property planned or zoned or occupied residential use.

(6) The site shall be maintained free of fluids,
odors, litter, rubbish, and any other non- recyclable materials. The site shall be cleaned of debris on a daily basis and will be secured from unauthorized entry and removal of materials when attendants are not present;
(7) Space shall be provided on site for the anticipated peak load of custopers to circulate, park and deposit recyclable materials. If the facility is open to the public, space will be provided for a minimum of ten (10) customers or
the peak hourly load, whichever is higher.
(8) Space shall be provided to park each commercial
vehicle operated by the processing facility and
* for each employee of the facility;
(9) Noise levels shall conform with City ordinance and standards;
(10) If the facility is locate6 within 500 feet of
property planned, zoned or occupied for residential use, it shall not be in operation between 7:OO p.m. and 7:OO a.m. The facility will be administered by on-site personnel during the
hours the facility is open;
(11) Areas where recyclable materials are collected shall be kept free of fluids, odors, litter,
rubbish, and any other undesirable material, and
The collection area shall be clearly marked to identify the type of material that may be deposited, and shall display a notice stating that no naterial shall be left outside. A
rubbish container shall be provided and emptied
daily;
(12) No dust, fumes, smoke, vibratiorr or odor above ambient level shall be detectable on neighboring properties.
