Adopt Resol uti on No. rr-79 accepting a Grant Deed for sf purposes.
ITEM EXPLANATION
FOR SEWER PURPOSES
At the request of Centre Development, developer of the new Air1 Business Center, a public sewer line was relocated to accommoc future development of their property. The sewer1 ine was constructec its new location and the old sewer easement was Quitclaimed by prev Council Action. The current owner MTK Corporation of America is presenting for Counci 1 acceptance the rep1 acement easement 1 ocatec Lot 10 of Carlsbad Tract 81-46 at the west end of Owens Avenue.
Engineering staff has reviewed the sewer easement and finds satisfactory for its intended purpose.
FISCAL IMPACT
Requiring dedication as a condition of development will save the expenses in future acquisitions.

RESOLUTION NO. 88-79 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED.
WHEREAS, Centre Development on behalf of IITK Corporation of Arr
has submitted a Grant Deed conveying an easement to the City of Carlsba
sewer purposes over a portion of Lot 10 of Carlsbad Tract 81-46; and
WHEREAS, the City Council of the City of Carlsbad has determin
to be in the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ci
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deed from MTK Corporation of America
February 18, 1988 conveying an easement for sewer purposes over a porti
Lot 10 of Carlsbad Tract 81-46 to the City of Carlsbad which is on filr
the City Clerk and is incorporated herein by reference, is accepted.
3. That the City Clerk is authorized to cause the original D
be recorded in the Office of the County Recorder of San Diego County, St
California, with the appropriate Certificate of Acceptance attached.
