RECOMMENDED ACTION:
Adopt Resolution No. 8f-/os’ purposes. accepting a Grant Deed for sewer easer
ITEM EXPLANATION:
As a condition of approval of a Building Permit (BP 87-244) the owner, I Industries, was required to grant an additional 10 foot wide sewer easel through their property. In compliance with this condition, Dyna Indust is presenting for Council acceptance the attached Grant Deed for SI easement purposes.
Engineering Staff has reviewed the Grant Deed and finds it satisfacto fulfills the requirements for this project.

Legal Description
An easement over a portion of Lot 10 of Carlsbad Tract No. 73-49 in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 8054, filed in the office of the County Recorder of San Diego County December 31 , 1974 more par- ticularly described as follows:
A strip of land 10.00 feet in width being 5.00 feet on each side and parallel with the following described centerline.
Beginning at the most southwest corner of said Lot 10, said point also on the easterly right-of-way of Yarrow Drive; thence northerly along the west line of said Lot 10 and east- erly right-of-way of said Yarrow Drive N3"30'00"W 19.61 feet to the TRUE POINT OF BEGINNING; thence leaving said right-of- way line of Yarrow Drive and entering into said Lot 10 N86"lO' 49"E 280.45 feet; thence North 288.52 feet to a point of ter- minus of the herein described center line, said point of ter- minus also being a point in an existing easement to Buena Sanitation District recorded 9-16-74 as file no. 74-250080.
The sidelines of said easement to be shortened or lengthened at
all angle points.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED.
WHEREAS, Dyna Industries, Inc. has submitted a Grant Deed cc
an easement to the City of Carlsbad for sewer purposes over a portion
10 of Map No. 8054; and
WHEREAS, the City Council of the City of Carlsbad has detern
to be in the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
Carlsbad, California, as follows:

That the above recitations are true and correct.
That the Grant Deed from Dyna Industries, Inc., dated M
1988 conveying an easement for sewer purposes over a portion of Lot 3
No. 8054 to the City of Carlsbad which is on file with the City Cler
incorporated herein by reference, is accepted.
3. That the City Clerk is authorized to cause the original
be recorded in the Office of the County Recorder of San Diego County,
California, with the appropriate Certificate of Acceptance attached.
