QUITCLAIM OF EASEMENTS WINDSONG SHORES - CARLSBAD TRACT 83-4
- Adopt Resolution No. 8r- /25 approving the quitclaim of r of open space and public access easements over Carlsbad Tract 83-4.
ITEM EXPLANATION:
This is a developer request to quitclaim portions of two e;
previously dedicated to the City for open space and public acces
easements are generally located along the top of the bluff overlool
middle Agua Hedionda Lagoon within the development known as G Shores (AKA Windsong Cove or Papagayo).
These easements were originally dedicated on the final map for Tract 72-13 (Papagayo) . Subsequently the property was re-subdi\ Carlsbad Tract 83-4 (Windsong Cove). This re-subdivision redef. open space and public access requirements for the Windsong deve The areas of the open space easement above newly defined bluff to longer required and would interfere with the development of the project as approved by Council.
The area of the public access easement requested to be quitcl, below the bluff line and extends into the tideland boundary. This of the public access easement is no longer necessary as a rep access easement has been provided satisfactory to P1 anning staff Costal Commission staff.
Since the above noted portions of the easements are of no furthe the City, the owner/developer, Sears Savings Bank, requests that quitclaimed back to them. Engineering and Planning staff have the proposed Quitclaim Deed and find that it adequately meets th of the approval for the approved Windsong Shores project.
