MP 04/19/88 RECOMMENDED ACTION: TITLE: APPROVAL OF SECOND AMENDMENT TO STATE AGREEMENT FOR CARLSBAD BOULEVARD SHORELINE PROTECTION Adopt Resolution No. #;V-I20 approving the Second Amendment to an existing agreement with the State of California, Department of Boating and Waterways for the Carlsbad Boulevard Shoreline Protection project (Carlsbad Boulevard Seawall). ITEM EXPLANATION: The existing agreement between the City of Carlsbad and the State of California, Department of Boating and Waterways for the construction and financing of the Carlsbad Boulevard Seawall project expires on July 1, 1988. The attached Second Amendment to this agreement extends the contract an additional year until July 1, 1989. Staff recommends approval of the attached Second Amendment. FISCAL IMPACT: The State of California, Department of Boating and Waterways contributed $2,915,000 to the construction of the Carlsbad Boulevard Seawall project which was completed in June, 1987. There currently exists approximately $110,000 of this amount within the project account representing savings otherwise available for the project. An original element of the Seawall project which was bid but not constructed in 1986-87 is the elevated walkway along the west side of Carlsbad Boulevard. The proposed Carlsbad Boulevard Walkway project was approved and authorized for advertisement of construction bids by the City Council on April 5, 1988. Staff has secured preliminary approval from State Boating and Waterways personnel to apply the balance of State funds toward the walkway project. Theref ore, the attached Second Amendment will extend the City/State agreement an additional year during which time the Carlsbad Boulevard Walkway project will be constructed and the balance of the State funds utilized . Second Amendment to City/State agreement. 1 2 3 4 5 6 7 a 9 1CS 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 88-126 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE SECOND AMENDMENT TO A CITY/STATE AGREEMENT FOR THE CARLSBAD BOULEVARD SHORE PROTECTION PROJECT WHEREAS, the City of Carlsbad and the State of California, Department of Boating and Waterways, entered into an agreement on July 1, 1985, Contract No. 85-42-100, for the construction and financing of the Carlsbad Boulevard Shore Protection project; and WHEREAS, said agreement, including previously executed Amendment No. 1, terminates on July 1, 1988; and WHEREAS, the City of Carlsbad and the State of California, Department of Boating and Waterways find it necessary, desirable, and in the public interest to extend said agreement until July 1, 1989; and WHEREAS, the extension of said agreement will continue the shore protection and bluff stabilization work originally contemplated by the parties to said agreement and furthered by the construction of the Carlsbad Boulevard Seawall project; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That following the execution by the Mayor and City Clerk of said Second Amendment, the City Clerk is hereby authorized and directed to forward copies of this Resolution and the eight (8) copies of the Second Amendment to the State of California, Department of Boating and Waterways, attention: George A. Amstrong, 1629 S Street, Sacramento, California, 95814. RAUTENKRANZ, City hlerk (SEAL) .. *' Second Amendment To 1 2 3 4 5 6 7 8 9 10 Carlsbad Boulevard Shore Protection Project Agreement This amendment to agreement is entered into on April 1, 1988, between the California Department of Boating and Waterways (DEPARTMENT) and the City of Carlsbad (CITY). The DEPARTMENT and the CITY agree to mend the agreement of July 1, 1985, (Contract No. 85-42-100) as follows: Paragraph 3e of the agreement shall read: "CITY shall diligently prosecute and complete work within 48 months from the date of this agreement."
