OBJECTIONS TO SANDAG GROWTH MANAGEMENT RECOMMENDATIONS TRASH TO ENERGY PLANT

RECOMMENDED ACTION:
That the City Council, by motion, object to the references to the San Marcos Trash to Energy facility included in SANDAG Draft Regional Growth Management Recommendations Report R-17B and direct Mr. Mamaux, the City's SANDAG representative, and the City Attorney to work in cooperation with the City of Encinitas to get these referenced deleted from the report.
ITEM EXPLANATION
SANDAG has circulated a report for public comment entitled ''Draft Regional Growth Management Recommendations1' (Report R- 17B). The report is being reviewed by City staff and it will be placed on a future Council agenda when that work is complete. However, because of the ongoing trash litigation the attorney representing the City of Encinitas and myself are recommending that the Council go on record at this time strongly objecting to the inclusion of references to the trash to energy plant in the report. Management Plan which contains a reference to their project everytime the need for the facility is questioned. references to the project remain in the SANDAG report it is anticipated it will be used against us by NCRRA. recommendation that the City Council by motion authorize the City's SANDAG representative, Council Member Mamaux, and myself to work in cooperation with the representatives from the City of Encinitas to obtain satisfaction for our concerns regarding the trash to energy plantls treatment in the SANDAG draft report
