Adopt Resolution No. ff-117 , approving an Agreement for Speedy Copy Service and authorizing the Mayor to execute same.
ITEM EXPLANATION:
There is a need for speedy copy service by various departments. In addition
to having specification books printed for Capital Improvement Projects, the
Police Department has monthly newsletters printed, while other departments
have manuals, reports and standards printed throughout the year. Currently,
quotations are being obtained on a project-by-project basis. If the City
has a contract with one printer for speedy copy service, there will be a
considerable time savings in the bidding processes and the printing will be expedited.
Proposals for annual speedy copy service were originally sent to eleven
vendors. From the nine responses received, Carlsbad Printing Company was selected as the lowest responsive bidder.
FISCAL IMPACT:
Sufficient funds have been appropriated as part of the Departmental Budgets
or individual Project Accounts, and are available in the respective accounts.
The Purchasing Department will establish and monitor a Blanket Purchase Order with this vendor for fiscal year 1988-89.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT
BETWEEN THE CITY OF CARLSBAD AND CARLSBAD PRINTING
COMPANY FOR SPEEDY COPY SERVICE.
The City Council of the City of Carlsbad, California, does hereby
5 resolve as follows:
6 1. That an Agreement between the City of Carlsbad and Carlsbad Printing
7 Company for speedy copy services, a copy of which is attached (Exhibit 2) ,and
a made a part hereof, is hereby approved.
9 2. That the Mayor of the City of Carlsbad is hereby authorized arid
10 directed to execute said Agreement for, and on behalf of, the City of Carlsbad.

SPEEDY COPY SERVICE
• THIS AGREEMENT, made and entered into this __ day of _____ _
1988, by and between the CITY OF CARLSBAD, California, a municipal corporation,
hereinafter referred to as "City" and CARLSBAD PRINTING COMPANY, hereinafter
referred to as "Contractor".
W I T N E S S E T H
WHEREAS, the City does find that the proposal tendered by the Contractor
for speedy copy services was a responsible proposal and of high standards;
WHEREAS, the City of Carlsbad does further find and determine that it would
be in the best interests of the City that said propostl be accepted and the
contract be awarded to the Contractor;
NOW, THEREFORE, for and in consideration of the mutual covenants and
promises of the parties hereto and upon the express terms and conditions
thereinafter set forth, it is agreed by and between them, and each with the
other, as follows:
1. This Agreement shall consist of and include the following document
attached hereto, as Exhibit A, Bid Proposal.
2. The Contractor agrees to furnish all labor and materials for speedy
copy services submitted in proposal dated May 20, 1988.
3. The Contractor shall provide pick up and delivery service, if required
by the City.
4. The Contractor shall furnish finished copies within 4 -5 days after
originals are received by Contractor.
5. The Contractor shall obtain and pay for a City of Carlsbad busi'ness
license at the time of signing this Contract.
6. The Contractor shall comply with all Federal, State, County and City
Statutes, Ordinances and Regulations, including Workers' Compensation and the
Immigration Reforms Control A\~ of ~986.
7. This Agreement shall be for a period of one {1) year commencing on
July 1, 1988 and ending on June 30, 1989. At the end of one (1) year, the City
has the right to re-bid or renew the Agreement for three {3) additional one (1)
year periods.
8. The Contractor shall also take and maintain during the life of this
Agreement, Workers' Compensation Insurance covering all of Contractor's employees
in a company satisfactory to the City and sha11 furnish to the City a certificate
issued by such company prior to the beginning of this Contract.
9. It is expressly understood and agreed that the Contractor herein named
in the furnishin~ of all labor and materials provided in this Contract, is acting
as an independent Contractor and not as an agent, servant or employee of the
City.
10. This Agreement or any part thereof shall not be assigned by Contractor
without prior written consent of the City.
11. This Agreement may be amended or modified only by written agreement
signed by both parties, and failure on the part of either party to enforce any
provision of this Agreement shall not be construed as a waiver of the right to
compel enforcement of such provision or provisions.
12. The Contractor shall be aware of the requirements of the Immigration
Reform and Control Act of 1986 and shall comply with those requirements,
including but not limited to verifying the eligibility for employment of all
agents, employees, sub-contractors and consultants that are included in this
Agreement.
13. Once each year, after the first six (6} months of this Agreement, upon
written request by the Contractor and approval of the Purchasing Officer, said
prices shall be subject to change in accordance with the Consumer Price Index,
San Diego as published by the U.S. Department of Labor, based on one-half of the
percentage change in the index from the first month of this Agreement to each
succeeding anniversary thereof.
14. This Agreement may be terminated by either party by giving thirty (30)
days written notice to the other, and this Agreement shall terminate forthwith
thirty (30} days following the date such notice is given.
IN-WITNESS WHEREOF, the parties hereto have executed this agreement in the
day and year first above-written.
