ITEM EXPLANATION There is a vacancy on the Planning Commission following Mr. McBane’s removal on May 10, 1988. The vacated term does not expire until April, 1990. Other Members of the Planning Commission are: Matthew Hall, Robert Holmes, Mary Marcus, Jeanne McFadden, C1 arence Schl ehuber and Sharon Schramm. A Notice Inviting Applications was advertised in the La Costan and the Carlsbad Journal on Wednesday, May 18, and the Blade Tribune, on Sunday, May 15, 1988. In February, due to citizen concerns, I was one of two individuals asked by the Carlsbad Planning Department to meet with the developers of the Batiquitos Lagoon Educational Park . . . . An area of contention had developed between the builder and the community and mitigation was needed (see attached). Marty Orenyak, Community Development Director Carlsbad Planning Department 2075 Las Palmas Drive Carlsbad, CA 92009 RE: Batiquitos Lagcon Educational Park Dear Mr. Orenyak, After extensive discussion with many members of the ccmmunity concerning the building pads along the Batiquitos Lagoon Sluff of planning area C, we are moving toward consensus for a recommendation that will mollify visual impact and help satisfy this aspect of the intent of the Batiquitos Lagoon Educational Park tlaster Plan. We acknowledge the engineering difficulties and expense invalved in lowering the building pads back to the original grade level. R practical solution may be to lower building pads and combine two story lots to build single story homes along the bluff. This approach is necessary Cdue to modifications of the bluff edge) in order to reduce the visual impact from adjacent scenic highways and properties. Although this alternative may result in the loss/two story lots, much of the loss would he offset by reduced grading and engineering costs. Additionally, this method would grant lagoon and ocean views to several homes in planning area C that.otherwise will not have views, increasing their selling price substantially. Another possibility would be to exchange two story lots For single story lots if available in planning area C. This, of course, should not include and exchange for single story lots already planned along the bluff. We are very concerned that Sammis Properties has placed 15' foot backyards (private open space) within the 95' setbacks and that structures such as spas, walls, barbecues and patio covers are also being placed within this setback. This is a clear violation of the intent and conditions set Forth in the Raster Plan. - The Raster Plan states (chapter IU, page 60, under Projsct-Development Standards), "Wh8re a conflict in davelopmont standards occurs, the standards spucifiod in this tlaster Plan shall take precmd8nt provided theg are comparable or more restrictive." In favor of this "highly touted educational park", the city made many lenient compromises, i.e., development standards, zone changes, including an exemption from the Growth Management Program. this, we do not feel that any further concessions should be made. Due to growing cammunity concern, we are confident that gour department will make every effort possible to correct violations and enforce compliance with the naster Plan. Jonathan Delling 2650 Caminc Del Ria North Suite 100 San Diego, CA 92108 RE: MARCH 11 MEETING SUMMARY RESPONSE Dear Mr. Delling, UFcn receiFt of your summary, we were somewhat surprised that cqies were sent to t5s Carlsbad Planning Department. It was our understanding that the meeting (due to your request) was informal, ts zpen lines of communication. As we expressed, we were not in a position at that time to make agreements without further investigation of points brought up in the meeting. We also emphasized the need to discuss possible soluticns with members of the community prior to agreements. We understood that there wculd one or two more meetings with you at which time agreements could 5s made. Please note the Following clarifications: 1. It was discussed that lcts 10 through 20 needed tc be regraded as low as Feasible. It was stated that your engineering study determined that lots could be lowered between 1.5 to 3.5 feet. 2. It was discussed that three two story lots Clots containing the most fill) could be combined and replaced with two single stzry homes. This would include lots 15 through 17 rather than 16 through 18. Lot 15, a two story lot, has been raised 12.5 feet above original grade level. 3. It was discussed that uniform wrought iron fencing would he beneficial Cprior to occupancy of homes) to prevent encrcachment and damage to lagoon bluffs. Side fencing was not discussed. NOTE: Wrought iron fencing should be placed on block base Ctwc feet block, three feet wrought iron) to discourage future hcmeowners from moving fencing. Block base will also help prevent damage to bluffs such as erosion, pets digging under fencing, etc. Fencing should he placed along the bluff top, approximately twc feet in from original and manufactured bluff edges. This alignment would allow all usable flat backyard area to be utilized by homeowners. Prior to physically studying each lot, we would have preferred that Fencing be setback ten feet from the bluff’s edge to reduce visibility of the fencing. In discussing the issue of structures, it was suggested by Dcn Sammrs that perhaps the arbcrs were too bulky, in size and could be scaled dcwn. Garden walls and pccls were nct discussed. It uas stated that spas, barbecues and trellis’ may Se acceptable on the ccndition that an easement is given to the city and that fencing is pravided prior ta occupancy of homes. NGTE: city. Festriztions should be incorporated into CI=&R’s limiting size, height, color, and distance of structures from rear cf homes, An easement cver the Lf5’ setback should be given tc the On Thursday March 17, we drcve to the property to study the lots and structures. Unfortunately, due to bluff edge modifications, structures in rear usable yard areas will be highly visible from view corridors. This is very apparent when viewing the structures that have been placed behind the model homes, i.e., spa equipment housing enclosures, barbecues, trellis’, garden walls, etcetera. In crder to reduce visibility, modifications will have to be made. We agree that the arbors are too bulky in size. If scaled dawn, perhaps four inches at the top and 6 inches at the bottom, the arbors wculd 13ok mare proportional in size Cconsidering the size OF homes and backyards). Spa equipment housing should be lowered into the ground as much as possible to reduce visibility and noise during operation. We found the barbecues to be unusually high, making them awkward to use f=r the average height person. Six inches lower would be much more suitable. Overall, we feel that the backyards of the model homes are overwhelmed by structures considering space. Garden walls, if used, should be no more than 12 inches in height to reduce additional visual impact. Although your project has taken much of our time and city staff time, we recognize the importance of the issues at hand. Hcpefully, we will be able to agree on solutions that will be of benefit to both the communi,ty and Uour development.
